You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct th~ifall(g:,lJ~~6~~~~~~I~'jCH
activity located on your property at 7162 Island View Drive in the Marice Acres Subdivision in Ocean Isle Beach, in
Brunswick County. This approval allows you to:
1. Add floating dock to existing pier.
2. Relocate an existing boat ramp pier.
3. Replace 375 linear feet of bulkhead within existing footprint.
4. Repair existing boat ramp and extend the ramp for an additional 20 feet (Total ramp dimension would be
IS' X 87' waterward of the bulkhead).
5. Dredge approximately 20 cubic yards of material within the footprint of the proposed boat ramp extension.
This approval is only valid for the purpose and design that you described in your CAMA Major application
received by the Division of Water Quality (DWQ) Wilmington regional Office (WiRO) on October 25,2005. After
reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this
activity. This Certification can also be found on line at: http://h20.enr,state,nc,lIs/ncwetlands/certs,htmI.This
Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please
keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but
not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and
Coastal Stormwater. In addition, this approval will cxpirc whcn thc accompanying CAl\IA Pcrmit cxpircs

Please be aware that if you change or modify your projcct, you must notify the Division
(DWQ) in writing and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H ,0506 (h). For this approval to be valid,
you must follow the conditions listcd in the attachcd ccrtification and thc additional conditions listcd below
and on the following pagc:
1. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre-construction Notice Application. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.

2. Marlee Acres recreation Club, Inc. and its authorized agents shall conduct its activities in a manner
consistent with State water quality standards (including any requirements resulting from compliance
with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and
federal law. Marlee Acres recreation Club, Inc. shall require its contractors (and/or agents) to comply
with all of the terms of this Certification, and shall provide each of its contractors (and/or agents) a
copy of this Certification. A copy of this Certification shall be included in the construction contract
and available on the job site at all times. If DWQ determines that such standards or laws are not being
met (including the failure to sustain a designated or achieved use) or that State or federal law is being
violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and
modify this certification to include conditions appropriate to assure compliance with such standards
and requirements in accordance with 15A NCAC 2H,0507(d). Before modifying the certification,
DWQ shall notify Marlee Acres recreation Club, Inc. and the US Army Corps of Engineers, provide
public notice in accordance with 15A NCAC 2H.0503 and provide opportunity for public hearing in
accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to Marlee
Acres recreation Club, Inc. in writing, shall be provided to the United States Army Corps of Engineers
for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also
become conditions of the 404 Pennit for the project.
3. Measures shall be taken to prevent live concrete from coming into contact with waters of the state until
the concrete has hardened.
4. Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to this office and a copy to the 40 1 Oversight/Express Review Pennitting Unit, North
Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Please notify this Office at the number listed below if any problem arises during the construction of the
project that may affect water quality.
Please read the conditions associated with General Certification # 3400 (enclosed) and if you do not
accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. You must act within 60 days of the date that you receive
this letter. To ask for a hearing, send a written petition confonning to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N,C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the DWQ Permit #051995 under Section 401 of the Clean Water Act. If

Dear Mr. Wicker:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the subject
Public Notice (PN), dated November 4, 2005. The applicant, the MarIee Acres Recreational
Club, has applied for a Department of the Arn1Y (DA) pennit to make improvements to an
existing docking facility. The proposed work is being considered under Regional General Permit
198000291, a permit/processing agreement for work that has been approved pursuant to the
North Carolina Coastal Area Management Act (CAMA). These comments are submitted in
accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16
U .S.c. 661-667 d). Comments related to the FWCA are to be used in your determination of
compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR
320.4) in relation to the protection of fish and wildlife resources. Additional comments arc
provided regarding the District Engineer's determination of project impacts pursuant to section 7
of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.c. 153 I -1543).
Project Area, Proposed Activities and Anticipated Impacts
The project area, proposed work, and anticipated impacts area discussed in the Field
Investigation Report (FIR), dated October 14,2005, of the North Carolina Division of Coastal
Management (NCDCM). The project area is on the Brunswick County mainland on the north
side of the Atlantic Intracoastal Waterway (AIWW). The project site consists of 0.7 of an acre
with 397 feet of shoreline on the AIWW. The entire shoreline has an existing wooden bulkhcad
landward of the normal high watcr (NHW) line. Watcrward of the bulkhead is a strip ofIow
marsh (15-45 feet wide) of smooth cordgrass (Spartina altern(jlora). The area is designatcd as a
Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries. Attachmcnt C
shows a tidal range of approximately four feet.
The applicant proposes to add a floating dock to the existing pier on the west side of the project
area. The FIR notes that this pier is now approximately 7.5 feet wide, but the usable walk arca is
only six feet in width. Water depths at the waterward end of the proposed dock are three fect at

mean low water (ML W). On the east side of the site the existing boat ramp pier would be
relocated. Thc cxisting boat ramp would be repaired and extended an additional 20 fcet
waterward for ovcrall dimensions of 15 feet by 87 feet. The current water depth at the end of the
boat ramp (-3 fect at NHW) would be incrcased to -5 feet at NHW by excavating 20 cubic yards
of matcrial. Excavation would be done by backhoe or dragline with the spoil material placed in
an upland containment site. Approximately 375 feet of the existing bulkhcad would be replaced.
The new bulkhcad would be landward of the NHW line and coastal wetlands.
The FIR states that excavation for extending thc boat ramp would impact 300 squarc fect (ft2) of
shallow bottoms. The proposed floating dock, boat ramp pier, and boat ramp cxtcnsion would
incorporate approximatcly 1,580 ft2 of estuarine watcrs and public trust arca.
Federally Protected Species
The Service has reviewed available information on federally-threatened or endangcred spccics
known to occur in Brunswick County. We havc also revicwed information from thc North
Carolina Natural Heritage Program (NCNHP) database which contains excellcnt data on special
status species, both fcderal and state. This database can be accessed by topographic quadrangle
(quad) ofthc U. S. Geological Survey (USGS). Data from USGS quads providc thc most
project-specific information on species which should be considered in pern1itting this projcct.

Our review indicates that the only federally listed species likely to occur in the project area is the
West Indian manatee (Tricheclws manatlls), a fcderally-endangered mammal. Thc species is
known to occur in the waters of Brunswick County and thcre is a current record of occurrence in
the Shallotte quad. Manatees move along the Atlantic Coast during summer months and are
seasonal transients in North Carolina, primarily from Junc through October. Manatces fccd in
watcr one to two mctcrs (3.3 -6.6 feet) deep that may support submerged aquatic vegetation. The
species moves extcnsivcly when in North Carolina waters and past occurrcncc records cannot bc
used to precisely detcrminc thc likelihood that it will be presencc at a particular construction sitc.
Plans for the proposed work indicate that manatces arc not likely to be prcsent at the project sitc.
Prior to construction, water depths in thc excavation area would be threc feet or less at high tide.
Furthermore, the work is likcly to be completed prior to June 2006. Therefore, the Scrvice
would concur with a dctermination by the District Enginecr that the project is not likcly to
adversely affect any fedcrally threatened or cndangcred species, or designated critical habitat for
such species. The Corps' requirements of section 7 of thc Endangered Specics Act would be
fulfilled. However, the Corps must rcconsider its obligations under section 7 of the ESA if: (1)
new information rcveals impacts of this identified action that may affect listed species or critical
habitat in a manner not previously considered; (2) this action is subsequently modified in a
manner which was not considered in this review; or, (3) a new species is listed or critical habitat
detern1ined that may be affected by the identified action.

Service Concerns and Recommendations
Overall, the Service does not believe that the proposed activities will have significant adverse
and/or irreversible effects on fish and wildlife resources under our jurisdiction. We support the
12 permit conditions recommended by the NCDCM. We also support the recommendation of
the NCDCM that the existing 7.5-foot-wide pier be reduced in width to six feet, the amount of
actual useable width. The FIR states that the applicant has expressed a willingness to make this
change.
With the implementation of the recommendations of the NCDCM, the Service has no objection,
from the standpoint of fish and wildlife, to the issuance of a permit for the activities described in
the FIR and P A. We appreciate the opportunity to comment on this permit application. If you

9. PROJECT DESCRIPTION
The project site is located at 7612 Island View Place, adjacent to the Atlantic Intracoastal Waterway
(AIWW), on the mainland side of Ocean Isle Beach, in Brunswick County. To locate the property
from the intersection of US Highway 17 Sand NC Highway 904, turn left onto NC HWY 904 and
travel approximately 3.6 miles to NC-179/NC-904/Beach Drive SW. Turn left onto NC-179/NC-
904/Beach Drive SW 0.3 miles to Harbor Drive SW. Turn right onto Harbor Drive SW and drive to
the end of the road. Harbor Drive SW dead ends at the subject property.
The project site is a 0.698-acre parcel of land with approximately 397 feet of shoreline frontage on the
AIWW. The property has an average elevation of approximately 4' above mean sea level. The high
ground property consists of lawn grasses, landscaping and a gravel driveway and parking area. The
entire shoreline of the property has an existing wooden bulkhead measuring approximately 412 linear
feet including the return walls, which is located landward of NHW. Waterward of the existing
bulkhead is an area of low marsh, which varies in width from approximately 15- 45' wide consisting
of Smooth Cordgrass (Sparlina altemiflora). In the northeast corner of the bulkhead there is a pocket
of rack which has collected over time resulting in a triangular shaped unvegetated area measuring
approximately 20' in width. On the eastern side of the property existing structures consist of a
concrete boat ramp (15' x 67'), with associated pier (4' x 58'), and a floating "L" shaped finger pier
(8' x 20') extending eastward at the terminal end. On the western side of the property there is a
second existing pier (7'7"x 132') with a fixed "L" shaped (13'2" x 30'4") finger pier extending
towards the east at the terminal end. There is an existing 412 linear feet long wooden bulkhead, which
encompasses the entire shoreline frontage adjacent to the AIWW.
The waters of the Atlantic Intracoastal Waterway are classified "SA" by the North Carolina Division
of Water Quality. The area is designated as a Primary Nurserv Area by the North Carolina Marine
Fisheries Commission and it is closed to the harvesting of shellfish.
PROPOSED PROJECT
The applicant proposes to add a floating dock to an existing pier, relocate an existing boat ramp pier,
repair and extend the existing boat ramp, and replace 375 linear feet of existing bulkhead. The floating
dock (10' x 20') addition would extend in an easterly direction, perpendicular to the AIWW, from the
existing "L" shaped finger of the existing pier located on the western side of the property. Water
depths at the waterward end of the floating dock would be approximately 3' at ML W.
The applicant also proposes to relocate an existing boat ramp pier/walkway, which is currently located
over the existing concrete boat ramp. The proposed relocation would connect to an existing 4'x 30' pier
resulting in the total pier dimensions of 4' x 58' with an existing 8' x 18' "L" shaped floating finger
dock. The applicant also proposes to repair and extend the existing boat ramp an additional 20'
waterward resulting in the overall dimensions of the ramp 15' x 87' waterward of the existing bulkhead.
The water depth at the terminal end of the existing boat ramp is approximately -3' @ NHW and the
applicant proposes to excavate approximately 20 cu. yds. of mud and sand in order to obtain a water
depth of approximately -5' @ NHW. The material would be excavated by backhoe and/or dragline and

the spoils would be contained by a silt fence in a 20' x 20' area of high ground on the northeast comer of
the property for dewatering.
Lastly, the applicant proposes to replace approximately 375 linear feet of the existing wooden bulkhead
with treated lumber. The new bulkhead would be located landward ofNHW and Coastal Wetlands.
Additional fill material would be placed landward of the bulkhead as needed.
10. ANTICIPATED IMPACTS
The proposed boat ramp extension would result in the excavation and subsequent filling of
approximately 300 sq. ft. of shallow bottom area. The spoil disposal site and the backfill associated
with the bulkhead and tieback system would result in approximately 6025 sq. ft. of high ground
disturbance. The proposed floating dock, boat ramp pier and boat ramp extension would incorporate
approximately 1580 sq. ft. of Estuarine Waters and Public Trust Area. Minor increases in turbidity
can be expected during construction.

This permit, issued on January 3, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) The authonzed project is located within a primary nursery area (PNA). Therefore, in accordance with
15A NCAC 07H.0208 of the Rules of the Coastal Resources Commission, and per the request of the NC
Division of Marine Fisheries, the proposal to extend the existing boatramp is hereby not authorized and
deleted from this project. Any references to the boatramp extension and associated dredging in the
application or attached workplan drawings are hereby deleted.
Docking Facilities
2) In order to comply with 15A NCAC 07H.0208(6)(D) of the Rules of the Coastal Resources
Commission, and in accordance with commitments made by the permittee, the existing 7 ft. 7 in. X 132
ft. pier shall be reduced in width to 6 ft.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Conunission.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.

XI 3) This permit authorizes only the addition of the 10 ft. x 20 ft. floating dock to the existing pier, and the ~
relocation and lengthening of the existing boat ramp walkway to final dimensions of 4 ft. x 80 ft., all as ~
expressly and specifically set forth in the attached permit application and workplan drawings. No other
( structure, whether floating or stationary, shall become a permanent part of this docking facility without
permit modification. No non-water dependent uses of structures shall be conducted on, in or over public
trust waters without permit modification.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit does not authorize the creation of any permanent boat slips. The addition of tie-downs,
pilings, or boat slips shall require modification of this permit. Contact a DCM representative at (910)
796-7215 to request this authorization.
NOTE:
The permittee is cautioned that this permit does not authorize the placement of tie piles in
association with the docking facilities. Furthermore, due to the proximity of the AIWW, boats
utilizing the docking facility shall be subject to frequent wavewash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the
integrity of the structure and the safety of moored boats. The permittee shall not hold the State
of North Carolina or the United States liable for any damage to the structure or moored boats.
Shoreline Stabilization
9) The alignment of the permitted bulkhead shall follow the alignment of the existing bulkhead, and shall
not extend more than 2 ft. waterward of the existing bulkhead.
10) The bulkhead shall be constructed prior to any backfilling activities.
11) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.

12) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which shall be required for the construction of the bulkhead wall, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved alignment.
13) The backfill material shall be clean and free of any pollutants except in trace quantities.
14) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
15) No backfill material is to be placed within 30 feet of the normal high water line, except that which shall
be used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkead cap immediately following completion of backfilling activities.
17) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
18) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
19) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
TI5A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
20) No wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Reference your application fora Department of the Army permit to add a floating dock to
an existing pier, relocate an existing boat ramp pier, extend the existing boat ramp, and replace
375 linear feet of existing bulkhead at 7612 Island View Place, adjacent to the Atlantic
Intracoastal waterway, on tlle mainland side of Ocean Isle Beach, Brunswick County, North
Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with the attached special conditions and the State authorization and
the approved plan (enclosed). Failure to comply with the Federal and State authorization or
conditions of the general permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for

4) Morlee Acres Recreation Club Incorporated is requesting permiSSion
to repair and extend our current boot romp - 20'-S' further waterward.
Currently ot low tide the woter line is opproximotely 4'-S' from
the end of our existing boot ramp concrete. We would like to reinforce
de extend the ramp as indicated on the site drawing and attached
sketch or modify existing ramp to provide deeper wolers at current
location. All construction sholl be performed in accordance with CAMA's
rules de guidelines. os well os local and state building code requirements.
