My records consist of tenants, revenue and expenses, audit, etc. pertaining to management, but none concerning the documents of original construction. The cattails that had filled in the wet detention pond near the parking area have been removed and I now consider the system to be operating in accordance with the original permit/design. You responded on August 3, 2011 stating that Mr. Koss, the architect/engineer, was going to inspect the site again and issue a certification. To date, we have not received or heard anything. If there is an issue with payment of the certification and it involves the previous owners, it is up to the current owner to make payment and resolve the issue later with the other party, in court if necessary. The bottom line is that you must submit an engineer certification for the stormwater system. I will need to have the engineer's certification by February 10, 2012. If it is not submitted by then, I have no choice but to start this whole process over again. This means that I will have to re -inspect the site and, most likely, will issue a Notice of Violation with recommendation for enforcement. Please note that in my inspection report, I did mention that the pond had a nice grouping of arrowhead type aquatic vegetation along the banks of the forebay. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in either pond is 118 horsepower. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. :y 8. If the stormwater system was used as an Erosion Control device, it must be restoredF:to design condition prior to operation as a stormwater treatment device, and prior, to occupancy of the facility. 9. Free access to the stormwater facilities must be provided via appropriately maintained easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. These are emergency access drives for fire trucks to get to the sides of the building in case of a fire. Ideally, there would never be any vehicle traffic that would access these drives which would pack down the stone to an impervious surface as is expected with a parking area. To the contrary, since marl is a limestone material we expect most rainfall to infiltrate and filter rather than become runoff to the ponds. We have accounted for the walkways in the impervious areas as we expect these paths to become somewhat imperious due to walking traffic. We agree with the numbers in the attached note but have not included these areas in the temporary water quality pool calculations for the reasons provided. The drawing showing the enlarged pond plans have been update to include the dimensions for the forebay areas. Two copies of Sheet C-6.3 are enclosed; the cooperation of the DWQ is greatly appreciated. The flow spreader for a vegetated filter needs to be something that promotes sheet flow. A timber placed above the ground will only back up water behind it. A better flow spreader is a half -round pipe sunk into the ground with notches on the lower downstream side so that water falls into the flow spreader without backing up in the swale, and then just sheet flows across the filter. 7. The 11/16" orifice in Pond 2 is still too small, even with the changes to the surface area and. -volume: Only the minimum 1" volume should be routed through the orifice (1,042 cubic feet). Your 7/6/04 revised calculations already indicated that the maximum flowrate for this pond is .0066 cfs. An 11116" orifice provides a flow rate of .0071 cfs (again, per your calculations), which is too fast. Please specify an orifice which delivers a flowrate between .002 cfs and .006 cfs. 8. The required minimum surface area of the pond includes the forebay surface area at permanent pool. Therefore, the permanent pool surface area to be reported on the supplement is 3242 for Pond I (2657 + 585) and 1500 for Pond 2 (1212 + 288). The easiest way to design the pond is to not worry about the exact location of the forebay wall initially. Just calculate the required surface area and sketch out a pond that will provide that amount of surface area. Calculate the permanent pool volume (again, without a forebay wall) and then calculate the 20% forebay volume. Sketch in the forebay wall such that the required volume is provided (18%-22% range). 9. A better flow spreader is a half -round pipe sunk into the ground with notches on the lower downstreamtside so that water falls into the flow spreader without backing up in the Swale, and then just sheet flows across the filter. 7. The 11/16" orifice in Pond 2 is still too small, even with the changes to the surface area and.volume. Only the minimum 1" volume should be routed through the orifice (1,042 cubic feet). Your 7/6/04 revised calculations already indicated that the maximum flowrate for this pond is .0066 cfs. An 11/16" orifice provides a flow rate of .0071 cfs (again, per your calculations), which is too fast. Please specify an orifice which delivers a flowrate between .002 cfs and .006 cfs. 8. The required minimum surface area of the pond includes the forebay surface area at permanent pool. Therefore, the permanent pool surface area to be reported on the supplement is 3242 for Pond 1 (2657 + 585) and 1500 for Pond 2 (1212 + 288). The easiest way to design the pond is to not worry about the exact location of the forebay wall initially. Just calculate the required surface area and sketch out a pond that will provide that amount of surface area. General Description Site is one of last undeveloped areas along this section of Princess Place Drive. Local area consists of multi -family housing and light commercial buildings; lot immediately north and adjacent to the entrance drive is a daycare center, lots to the west include a school and commercial warehouse, lots to the south are commercial development and the lot to the east/along a portion of the entrance drive is an apartment complex/hotel and a small vacant lot. B. Existing Drainage Site is generally very flat with most surface drainage running north towards Princess Place Drive following existing ditches along the east and west property lines. Most of the surface runoff originates within the site area; there appears to be some minor contribution from the adjacent commercial property along the east boundary. Stormwater from the surrounding residential areas drains to Smith Creek. With all of the existing development surrounding this site, most of the stormwater runoff is already collected in storm drains and transported to the City storm sewer system. C. Proposed Drainage Plan Runoff from the roof areas of the apartment buildings will flow via gutters and downspouts to a collection system of underground piping which will discharge to the shallow wet detention basin (#2) as indicated on the grading plan. Runoff from the lawn areas will travel via sheet flow to the perimeter and will not be concentrated in swales or ditches. All runoff from the parking area and the entrance drive will be directed to a designated wet detention basin (#1). The new impervious surface represents about 42% of the total site area, the remaining areas include mostly lawns, landscape buffers, and the area reserved for stormwater management features.. A walking path (consisting of wood chips) runs around the facility and has been included in the total impervious area. A portion of the walk surface (40% of about 1200 sgft) cannot be routed through one of the detention ponds, however, this small runoff volume will be filtered through a grass buffer strip before exiting the site. D. Stormwater Management Plan Due the restricted site area, the extent of the surrounding development and the location of the existing drainage ditches, a wet detention basin BMP concept (Best Management Practices) has been selected for this development. For the impervious surfaces associated with the roofs of the new structures, a wet detention basin with a catch basin/sediment trap at the inlet and a release structure to regulate the outflow is proposed. For the parking area, a second wet detention basin/release structure will be constructed. Both features will have an emergency outlet to grass lined swales/existing drainage ditches. Runoff from the remaining lawn areas will travel via sheet flow to the two existing perimeter drainage ditches. Although the City regulations allow the first 2000 sqft of the entrance drive to flow directly to the existing storm drain system, all of the driveway runoff is being directed to the detention basin for water quality. E. Detailed BMP Description The first wet detention basin associated with the parking lot will accept runoff from 31,865 sgft of impervious pavement and sidewalk including the entrance drive. The design features of this device includes: • All of the runoff from the impervious area will be directed through a curb cut to a forebay area to accommodate a trap for a majority of the sediment. • A low dike with a riprap weir separates the forebay from the primary basin. • The temporary water quality pool is sized to capture and treat the first 1" of runoff (2612 cu ft). • The permanent water quality pool has sufficient surface area based on the SA/DA ratio for a 3.5 ft deep pond as recommended in the BMP Guidelines Manual. • A 30 ft long by 3 ft wide vegetated buffer is provided immediately downstream of the basin outlet structure as required before discharging to the existing drainage ditch. • The release structure consists of a concrete basin with a PVC pipe/orifice to regulate the outflow rate, a weir/trash rack top to pass flows in excess of the first 1" of runoff (and to satisfy the City of Wilmington's maximum release rate) • The outlet structure is provided with an emergency drain and temporary pump to completely drain the pond area for maintenance. • The permanent pool is provided with a 6 ft wide vegetated shelf (6:1 slope) for plant material as recommended in the BMP guideline manual. • The dimensions of the basin provide a semi -rectangular shape that will achieve the 3:1 length to width ratio. Theory of Operation — Basin # 1 Since the wet detention basin is an on-line BMP device, this device will need to meet the water quality requirements and the City of Wilmington stormwater flow limitations. All parking area/sidewalk drainage (and a portion of the roof drainage) will enter the forebay area via a curb cut and riprap swale (Elev 38.25). Sediment from the parking area will be captured in the forebay as the runoff is allowed to slowdown and any sediment has a chance to settle out. Depending upon the water level in the primary pool, runoff will seep through the riprap cross -over channel or flow through the 10 ft opening in the separating dike and fill the temporary water quality pool up to a maximum level of 37.75. The PVC orifice at the release structure will slowly discharge water in storage above the permanent pool level over the next 48 hours. Flow in excess of the first 1" of runoff will continue to flow into the wet detention basin up to a maximum level of 38.25'; a weir will limit outflow to the pre -development rate (I0-yearstorm event). Flows greater than the 10-year will submerge the outflow weir and discharge through a grass lined emergency spillway. The second infiltration basin associated with the roof areas will accept runoff from 12,060 sq ft of impervious roof/sidewalk and the grass courtyard area within the four structures.
