All,
I have received the signed offsite supplement. Thank you!
In reading the transmittal letter, I understand there is a question on if recorded deed restrictions are required. This
specific lot is unique in that it is allocated 100% of the lot area as built -upon area. I looked back at the permit for SW8
890417 and confirmed that there were no requirements to record restrictions on this lot. Over time, this program has
adapted as lessons have been learned. One of those we are currently discussing is the benefit of referencing the permit
number in the chain of title so that future owners are aware of the permit. I'm not sure where that discussion will go,
but it is something to think about.
Thanks again and I should have enough now to finish up the transfer. Please let me know if there are any further
questions.

Dear Ms. Brinkman:
The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR)
received and accepted a signed Permit Transfer Application Form for the subject project on April 3, 2020,
The successor -owner of the property has requested to transfer the permit without consent of the permit
holder in accordance with 15A NCAC 02H.1045(1)(c) and G.S. 143-214.7(c5). A preliminary in-depth
review of the documentation submitted with the transfer request determined that the application is
incomplete and that additional information is needed.
Since the transfer was submitted under NCAC 02H.1045(1)(c) and G.S. [43-214.7(c5), please provide the
following documentation in a single, hard copy submittal package to complete the application:
1. 15A NCAC 02H.1045(2)(d): Please provide a signed and notarized operation and maintenance
agreement from the proposed permittee.
2. On April 28, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project to determine the status of compliance with this
permit, last issued on April 10, 2001. DEMLR file review and site inspection revealed that the
site is in compliance with the terms and conditions of this permit. A copy of the completed form
entitled "Compliance Inspection Report" summarizing the findings of the recent inspection is
attached to this letter.
All of the requested information listed above should be received in this Office by May 15, 2020, or the
application will be returned as incomplete. If additional time is needed to submit the requested
information, please email your extension request prior to this due date to the email address provided
below with a justification and a date of when the requested information will be submitted. which shall be
no later than 15 days past the original due date. Please note that only nvo letters requesting additional
information is allowed in the State Stormwater Program for a total of 30 days to submit the requested
additional information. The Division is allowed 90 days from the receipt of a complete application to
transfer the permit. If the information is not satisfactorily provided after either the second request or 30
days, the project will be returned. If the project is returned and you wish to re -submit later, you will need
to resubmit all required items at that time, including the application fee.
Please reference the State assigned permit number on all correspondence. If you have any questions

Dear Mr. Hill and Ms. Brinkman:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for issuance of the
permit.
On February 28, 2020, the Wilmington Regional Office conducted a file review of the subject project
currently operating under Stormwater Management Permit Number SW8 010230 originally issued to the
New Hanover County ABC on April 10, 2001. This file review and research of the tax records revealed
that the ownership of the property covered by this permit has changed and is now owned by SSG 2, LLC.
Please note that per Section 1I.12 of the permit SW8 010230, the permittee must notify the Division of any
owner name changes, project name changes, mailing address changes and ownership changes and must
receive approval from the Division -to transfer the permit.
Per ISA NCAC 02H.1045 and G.S. 143-214.7 there are three options (listed below) that are available for
transferring a state stormwater permit to the new owner, The options selected may be applicable to the
transfer of the subject permit:
® 1. Upon the request of the current and proposed permittee, where both the current and proposed
permittee sign the transfer application.
❑ 2. Upon the request of the current permittee to the HOA or POA, where only the current
permittee signs the transfer application. Specific submittal requirements are listed in
G.S.143-214.7(c2).
® 3. Upon the request of a successor owner of the property on which the permitted activity is
occurring or will occur. Specific submittal requirements are listed in G.S.143-214.7(c5).

It is your responsibility as the current permittee and current property owner to complete, sign and submit
the permit transfer form. Please submit a transfer application along with the required documentation
listed on the form or a plan of action detailing when the transfer will be submitted to this Office by March
31, 2020. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement procedures as set forth in NCGS
143 Article 21. Failure to provide the requested information, or to respond to this letter by the due date,
may initiate enforcement action including the assessment of civil penalties.
