The Wilmington Regional Office received a complete Stormwater Management Permit Application for House of
Silk Flowers on January 22, 2001. Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.] 000. We are forwarding
Permit No. SW8 000523 dated February 15, 2001, for the construction of House of Silk Flowers.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein, and does not supercede any other agency permit that may be required,
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

I. DESIGN STANDARDS
This permit covers the construction of 79,279 square feet of built -upon area.
2. The overall tract built -upon area percentage for the project must be maintained at 30%, as required by
Section .1005 of the stormwater rules.
Approved plans and specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum
side slopes of 3:1 (N:V) as defined in the stormwater rules and approved by the Division.
5. No piping is allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access.
6. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines
established in the North Carolina Erosion and Sediment Control Planning and Design Manual.
Roof drains must terminate at least 30' from the Mean High Water line.

11. SCHEDULE OF COMPLIANCE
Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and surface waters.
The permittec is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
The Director may notify the permittec when the permitted site does not meet one or more of the illilllnlum
requirements of the permit. Within the time frame specified in the rloticC, the pernlittce sllal l submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of'revised plans and certil-ication in writing to the Director that the changes have been made.
4. Prior to the sale of this project, in whole or in part, the following deed restrictions must be recorded with
the Office of the Register of Deeds and submitted to DWQ:
a. "Construction of additional built -upon area in excess of 79,279 square feet will require a permit
modification."
"Construction of additional impervious areas such that low density requirements are no longer met
must be submitted to DWQ and a permit modification must be issued prior to construction. An
appropriate engineered system will be required to collect and treat the runoff from all built -upon area
associated with the project, including that area permitted under the low density option."
C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this
development, except for average driveway crossings, is strictly prohibited by any persons."
d. "A minimum of 30' of' vegetated buffer area shall be provided between surface waters and all
impervious surfaces."

C. Projects within CAMA's Area of Lnvironillcntal Concern (Al C) are subject to a reduction of the permitted
amount of built -upon area due to CAMA jurisdiction within the AEC.
7. A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale.
The following items will require a modification to the permit. Revised plans, specifications and calculations
must be permitted prior to the permittec beginning construction oil the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. 'Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property
owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought.
1'. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
9. The Director may determine that other revisions to the project should require a modification to the permit.
] 0. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational
for their intended use prior to the construction of any built -upon surface.

12. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted
stormwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
C. Maintenance of side slopes in accordance with approved plans and specifications.
3. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been
constructed in accordance with the approved plans.
14. The permittee shall submit all information requested by the Director or his representative within the time
frame specified in the written information request.
Ill. GI:NEAZAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes
143-215.6A to 143-215.6C.
The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance ol' this permit does not prohibit the Director from reopening; and modifying the permit,
revoking; and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations
contained in Title 15A of the North Carolina Administrative Code, Subchapter 21-1.1000; and North Carolina
General Statute 143-215.1 et. al.
The permit is not transferable to any person except after notice to and approval by the Director. The Director
may require modification or revocation and reissuance of the permit to change the name and incorporate
such other requirements as may be necessary. A formal permit request must be submitted to the Division
of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits,
and may or may not be approved.
6. The permittee grants permission to D17NR Staff to ellter the property for the purpose of inspecting all
components of the stormwater management facility.
7. The permittee shall notify the Division of any name, ownership or mailing; address changes within 30 days.
8. The issuance of this permit does not preclude the Permittee from complying; with any and all statutes, rules,
l-egulatlons, or ordinances which may be imposed by other government agencies (local, state and federal)
which have jurisdiction.

The following italicized deed restrictions and protective covenants are required to be recorded for all

4. Built -upon area in excess of the permitted amount requires a state, stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

runoff primarily through vegetated conveyances. Low density projects should not have a discrete stormwater
collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can be

2. All of paragraph 2, except for the last sentence, was in your letter of November 3,
2000. In your November 3 letter you stated that "If the chlorides level is less than
500 ppm, the density level can be increased to 30%, and a low density permit can
be issued." My letter of January 5 provided the chloride test showing a chloride
level of 180 ppm. We at no time have received page 2 of the application. (It was
not returned with your letter of November 3, 2000.) You did, however, send us
your original handwritten computation.

The Wilmington Regional Office received the resutls of the chlorides test for the Stormwater Management
Permit Application for House of Silk Flowers Parking Expansion on January 1 I; 2001. In the letter your engineer
indicates that he thinks the chlorides test is the only item left to complete the application. This is not true. As
requested on November 3, 2000, the following information is still needed to continue the stormwater review:
Please provide a more complete vicinity map. Please show the nearest major intersection, the State
road number for Laurel Road, and. the.approximate distance beyond Laurel Road to the project.
2. A portion of -this project was constructed prior to 1988 and is not subject to the rules. The portion
of the site built after 1988 is subject to the rules. It appears that a total of .32 acres of new gravel
parking is proposed, and there are 1.5 acres of post -I 988 impervious area, for a total of 1.82 acres.
In order to demonstrate compliance with the low density option under the rules, there are two
methods available. The first is to account for all the built -upon area (pre-1988, post-1988 and
proposed (3.14 acres) and divide by the total site acreage for an overall percent impervious (3.14 /
7.95 = 39.5%). Since this method yields a site that is more than 30% impervious, the second method
must be used. Find the adjusted site arecr'by subtracting all pre-] 988 impervious area (I get 1.35
acres)-from.the.total site acreage (7.95 - 1.35 = 6:6). Then d.ividethe total post-1988 arid currently
proposed built -upon area (1.82 acres)by the.adjusted site area (6.6 acres) to determine the percent
impervious of the post-] 988 site (1.82 / 6.6 = 27.5%). The calculation the engineer presented used
the total site area and only the post-1988 impervious areas to demonstrate compliance, which is not
correct. Page 2 of the application was returned to you on November 3, 2000 and must be revised to
show this method of calculation.
Please provide dimensions for all buildings and.parking areas.
4. DeIineate all wetlands on site, or note on the plans that none exist.
Since I am unable to locate this project on a map, I am unable to verify the receiving stream and river
basin. if this project is within the Neuse River Basin, there are buffer requirements that must be

In reply to your letter of November 3, 2000, please find enclosed the laboratory test
results for determination of the chloride level taken at a point two-thirds of a mile from
the proposed project. The chloride level was 180 ppm.
As to the site location: Site is 0.9 miles from the east end of the Core Creek high rise
bridge on Highway 101. As shown on our drawing, it is also tied to a North Carolina
Monument #CAR 81 on Highway 101. The longitude and latitude are given in the
application.
The property is in the White Oak River Basin. According to the White Oak River
Basinwide Water Quality Management Plan, Eastman Creek drains into Core Creek,
which has an SA classification. (A copy of page A-1-28 from aforesaid Plan is
enclosed.)
We assume that this completes our application and that an approval will be given.soon as
our client cannot complete his projects until a permit is issued.

3. A copy of a survey by Priest Surveying, P.C. was submitted to you, which shows
the building sizes. We are enclosing another copy for your use. We are also
enclosing a copy of our site plan, which will show the gravel parking areas.
4. There are no wetlands on this site.
I believe there are sufficient maps to show you where the site is located. As to
the drainage basin, as indicated in my letter of January 5, 2001, the site is in the
White Oak River Basin. You will note on page A-I-28 that Eastman Creek drains
into Core Creek and is, therefore, in the White Oak River Basin. (All of our
correspondence regarding our approved "Erosion and Sedimentation Control Plan
(Project 000510CA) says it is in the White Oak River Basin.

NARRATIVE
The purpose of the project is to construct a grave[ parking lot and drive and to regrade exist[ng ditches
along property line, Approximately 2.4 acres will be disturbed during this construction period. The Site is
7,95 acres located in Deaufort Township, Carteret County, North Carolina.
The site io covered in grassy vegetation, 5ee Plan.
Land use in the vicinity is undeveloped wooded land, The land immediately to the South along NC Hwy 101 is
commercial. The land immediately to the northwest along NC Hwy 101 is used as a County Refuse Collection
Site.

A temporary gravel construction entrance/exit will be installed at the Southern project entrance. During
wet weather it may be necessary to wash vehicle tires at this location. The entrance will be graded so that
runoff water will be directed away from proposed roadway.
As soon aS final grade is reached on the proposed roadway, the subgrade will be Stabilized with a 6-inch
course of NC DOT Standard Size A6G Stone to prevent erosion and dust during the construction prior to
paving.
Slopes will be lightly roughened by disking just prior to vegetating. Surface Stabilization will be
accomplished with vegetation and mulch as specified in the vegetation plan. Roadway base courses will be
installed as Soon ao finished grade iS reached. Dust control is not expected to be a problem due to the
small area of exposure. Should excessive dust be generated, it will be controlled by sprinkling with water.

The project site soils consists mainly of Sand, sllt and clay.

The otormwater collection system described herein and on the attached plan will provide the following
methods for control of sediments and for removal of pollutants from the developed Site runoff.
1. Collection of all runoff from the Site during development with controlled discharge.
2. Seeding specifications shall be as specified in the approved Erosion and Sedimentation
Control Plan.

MAINTENANCE PLAN
The Owner shall maintain the pond during the construction phase of the project and after construction is
completed for all routine and non -routine maintenance tasks. The Owner shall also be responsible for the
perpetual care of the stormwater retention pond.
All erosion and sediment control practices shall be checked for stability and proper operation following every
runoff producing rainfall and in no case less than once every week during construction. All repairs shall be
made immediately and shall be in accordance with the approved Erosion and 5edimentation Control Plan.
Owner Shall be responsible for all routine and non -routine requirements associated with the maintenance of
the rock dams.
Upon completion of earth disturbing activities and for 12 months following completion of the work, the owner
shall inspect the site following every runoff producing rainfall, A written log shall be maintained of any needed
repairs noted at the inspection, the name of the Contractor completing the repairs, and the date such
repairs are completed.
Remove the structure and any unstable sediment immediately after the construction site has been
permanently Stabilized. Smooth the basin site to blend with the surrounding area and stabilize. All water
a sediment should be removed from the basin prior to dam removal. 5ediment should be placed in
designated disposal areas and not allowed to flow into streams or drainageways during structure removal.
Mowirig. The side -Slopes, embankment, buffer area, areas within the fence, areas adjacent to the
emergency spillways and the grass -lined swales shall be mowed at least once a month during the main
growing season and at least two other times during the year to prevent woody growth and to control
weeds. Grass shall be mowed to a "meadow -like" condition and shall be maintained according to
Section C.11 Permanent Seeding of the approved Erosion and Sedimentation Control Plan.

deterioration from use and age causes them to fail and function properly. Owner shall be responsible
for all costs incurred with their replacement. Replacement shall be in accordance with original plans

On April 20, 2000 and May 4, 2000, personnel of this office inspected a project located on Hwy 101
in Carteret County, North Carolina. This inspection was performed to determine compliance with the North
Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity
of approximately 2.4 acres being conducted.
It is our understanding that you and your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter4. If you feel that you are�not responsible
for the following violations, please notify this office immediately.
The violations that were found are:
Failure to file an erosion and sedimentation control plan with this office at least 30 days prior to
beginning a land -disturbing activity on a tract comprising more than one acre, when more than one
acre is to be uncovered, failure to secure this office's prior approval of the plan for any land -
disturbing activity prior to beginning the land -disturbing activity. NCGS. 113A-54(d)(4), G. S. 113A-
57(4) and 15A NCAC 413.0007(c).
A land -disturbing activity of 2.4 acres has occurred prior to plan approval.
An acceptable erosion and sedimentation control plan must be filed with and approved by this office

Erosion and sediment control meausres are not present.
3. Failure to maintain on graded slopes and fills and angle which can be retained by vegetative cover
or other adequate erosion control devices or structures. G.S. 113A-57(2) and (if in HOW Zone) 15
NCAC 4B.0024(d).
Eroded vertical cut slopes border the land -disturbance on 3 sides.
4. Failure within 15 working days of 30 calendar days (whichever period is shorter) of completion of
any phase of grading to plant or otherwise provide exposed, graded slopes or fills with ground cover,
devices, or structures sufficient to restrain erosion. G.S. 113A-57(2).
The disturbed area has not been provided with groundcover or structures sufficient to
restrain erosion.
To correct these violations, you must:
Prevent sediment from moving off -site.
2. Install erosion and sedimentation control measures. Grade slopes to a 2 horizontal to 1
vertical angle or flatter.
3. Submit and erosion and sedimentation control plan.
4. Seed, mulch, and fertilize unprotected exposed slopes.
Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover'
or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until a standing
cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or
man-made erosion.
Please be advised that if you fail to respond to this notice or if these violations are not corrected
within 30 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take
appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of
a civil penalty and the amount may be up to $5000 per day for each day of the violation. The penalty may
be assessed from the date of the violation, NCGS 113A-51 (a) (1). If these violations are corrected within
the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project must not begin
until the area presently disturbed is brought into compliance with the Act. When corrective actions are
complete, you should notify this office so the work can be inspected. You should not assume that the
property is in compliance with the Act until we have notified you. After installation, all erosion control
measures must be maintained in proper working order until development is complete and the site is
completely stabilized.
