Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.] 000. We are forwarding Permit No. SW8 000523 dated February 15, 2001, for the construction of House of Silk Flowers. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required, If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (N:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access. 6. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. SCHEDULE OF COMPLIANCE Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. The permittec is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The Director may notify the permittec when the permitted site does not meet one or more of the illilllnlum requirements of the permit. Within the time frame specified in the rloticC, the pernlittce sllal l submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of'revised plans and certil-ication in writing to the Director that the changes have been made. 4. Prior to the sale of this project, in whole or in part, the following deed restrictions must be recorded with the Office of the Register of Deeds and submitted to DWQ: a. "Construction of additional built -upon area in excess of 79,279 square feet will require a permit modification." "Construction of additional impervious areas such that low density requirements are no longer met must be submitted to DWQ and a permit modification must be issued prior to construction. An appropriate engineered system will be required to collect and treat the runoff from all built -upon area associated with the project, including that area permitted under the low density option." C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development, except for average driveway crossings, is strictly prohibited by any persons." d. C. Projects within CAMA's Area of Lnvironillcntal Concern (Al C) are subject to a reduction of the permitted amount of built -upon area due to CAMA jurisdiction within the AEC. 7. A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale. The following items will require a modification to the permit. Revised plans, specifications and calculations must be permitted prior to the permittec beginning construction oil the modification: a. Any revision to the approved plans, regardless of size. b. Project name change. C. 'Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. 1'. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 9. The Director may determine that other revisions to the project should require a modification to the permit. ] 0. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. 1 1 Dining construction, erosion shall be kept to a mini slum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 1!. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. C. Maintenance of side slopes in accordance with approved plans and specifications. 3. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 14. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. Ill. GI:NEAZAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance ol' this permit does not prohibit the Director from reopening; and modifying the permit, revoking; and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 21-1.1000; and North Carolina General Statute 143-215.1 et. al. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee grants permission to D17NR Staff to ellter the property for the purpose of inspecting all components of the stormwater management facility. 7. The permittee shall notify the Division of any name, ownership or mailing; address changes within 30 days. 8. The issuance of this permit does not preclude the Permittee from complying; with any and all statutes, rules, l-egulatlons, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. Built -upon area in excess of the permitted amount requires a state, stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. The first is to account for all the built -upon area (pre-1988, post-1988 and proposed (3.14 acres) and divide by the total site acreage for an overall percent impervious (3.14 / 7.95 = 39.5%). Since this method yields a site that is more than 30% impervious, the second method must be used. Find the adjusted site arecr'by subtracting all pre-] 988 impervious area (I get 1.35 acres)-from.the.total site acreage (7.95 - 1.35 = 6:6). The Site is 7,95 acres located in Deaufort Township, Carteret County, North Carolina. The site io covered in grassy vegetation, 5ee Plan. Land use in the vicinity is undeveloped wooded land, The land immediately to the South along NC Hwy 101 is commercial. During wet weather it may be necessary to wash vehicle tires at this location. The entrance will be graded so that runoff water will be directed away from proposed roadway. As soon aS final grade is reached on the proposed roadway, the subgrade will be Stabilized with a 6-inch course of NC DOT Standard Size A6G Stone to prevent erosion and dust during the construction prior to paving. Slopes will be lightly roughened by disking just prior to vegetating. Surface Stabilization will be accomplished with vegetation and mulch as specified in the vegetation plan. Roadway base courses will be installed as Soon ao finished grade iS reached. Dust control is not expected to be a problem due to the small area of exposure. Should excessive dust be generated, it will be controlled by sprinkling with water. M The project site soils consists mainly of Sand, sllt and clay. Collection of all runoff from the Site during development with controlled discharge. 2. Seeding specifications shall be as specified in the approved Erosion and Sedimentation Control Plan. RM MAINTENANCE PLAN The Owner shall maintain the pond during the construction phase of the project and after construction is completed for all routine and non -routine maintenance tasks. The Owner shall also be responsible for the perpetual care of the stormwater retention pond. All erosion and sediment control practices shall be checked for stability and proper operation following every runoff producing rainfall and in no case less than once every week during construction. All repairs shall be made immediately and shall be in accordance with the approved Erosion and 5edimentation Control Plan. Owner Shall be responsible for all routine and non -routine requirements associated with the maintenance of the rock dams. Upon completion of earth disturbing activities and for 12 months following completion of the work, the owner shall inspect the site following every runoff producing rainfall, A written log shall be maintained of any needed repairs noted at the inspection, the name of the Contractor completing the repairs, and the date such repairs are completed. Remove the structure and any unstable sediment immediately after the construction site has been permanently Stabilized. Smooth the basin site to blend with the surrounding area and stabilize. All water a sediment should be removed from the basin prior to dam removal. 5ediment should be placed in designated disposal areas and not allowed to flow into streams or drainageways during structure removal. The side -Slopes, embankment, buffer area, areas within the fence, areas adjacent to the emergency spillways and the grass -lined swales shall be mowed at least once a month during the main growing season and at least two other times during the year to prevent woody growth and to control weeds.
