During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept for each permitted BMP. The reports will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. - 6. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for thos,e deviations. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below.. a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form to the Page 4 of 7 State Stormwater Management Systems Permit No. SW7101003 Division of Water Quality, signed by both parties, and accompanied by the appropriate documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6.. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. Need documentation to support if the Articles of Incorporation do not list the members or managers of the LLC. If an agent signs, then a letter of authorization is needed from the 80president, vice president, general partner, member or manager. 1q For subdivided projects, a signed and notarized deed restriction statement must be n provided. Spray irrigation is not acceptable as the sole means of drawdown. 2. The design storm is 1.5" if the project is subject to Phase II or is sited within'/2 mile of and draining to SA waters. The design storm for projects subject to Phase 11 sited within % mile of and draining to SR waters must treat the difference between the pre and post development conditions for the 1-yr 24-hr storm. Otherwise, use 1" design storm. 3. Report the bottom surface area. 4. Report the surface area at the overflow elevation. 5. Show the calculation for the minimum required volume. 6. Provide a table of elevations, areas, incremental volumes and accumulated volumes to, demonstrate that the minimum required volume has been provided. 7. Calculations are signed, sealed & dated. 8. Report the Drainage Area and Built -upon area for each basin or trench. 9. The seasonal high water table must be at least 24" below the proposed bottom elevation of the system. For Phase II projects, at least 12" of this must be in naturally occurring soils. 10. All runoff in excess of the design storm must bypass to a vegetated filter prior to entering the basin or trench. If the system is designed to store a larger design storm (generally 2-3 times the minimum), the requirement for an offline bypass can be waived. Sincerely, 6 cy� odd Simmons, PE EXPRESS MC ®ENR LOWE'S - KILL DEVIL HILLS, NC STORMWATER NARRATIVE The site is currently an approximate +/-12.8 acre property and it is within the Town of Kill Devil Hills in Dare County, NC. The site is located in the northwestern quadrant of the intersection of North Croatan Highway (US Hwy 158) and Landing Drive. Wetlands (0.17 acres) exist on the site. A USACE 404 permit is currently in process and a cou esy copy for the 401 permit application will be included with the state stormwater submittal. The stormwater from the site will drain to Colington Creek and then to Albemarle Sound. The stream class has been determined as SC. CAMA has been consulted and the site is not within CAMA jurisdiction. The stormwater design is high density, commercial. The proposed lot coverage far the site is 72%. Since the site utilizes pervious concrete, the proposed impervious area is 57.4%. Pre -developed Condition Currently the site is undeveloped with much of the site being densely wooded with understory shrub and immature trees. An approximate 10,500 sf slab on grade structure, most recently occupied by Times Printing Company, is located in the southeastern corner of the site. Paved parking areas adjoin this structure to its east, south, and west and a paved driveway adjoins it to its north. A drainage canal extending generally south —north is located near the site's western , boundary which has approximate 12 to 16 inches of standing water. In pre -developed condition, entire site drains to an existing 48" CMP located on south side of the site. Proposed Condition The property will be developed to contain an approximately +/-120,000 sf Lowe's building and +/- 39,000 sf garden center. Construction will include the building area and accompanying parking and landscape areas. Storm water management will be accomplished by providing pervious pavement in the majority of the front parking lot area, two infiltration basins — one on the south side of the property and one on the east side of the property. The infiltration basins will be hydrologically connected via a 36" storm drain equalization pipe to allow them to act as one basin. The infiltration basin and pervious concrete have been provided to meet the Town of Kill Devil Hills and NCDENR requirements. The Town of Kill Devil Hills requires retention of runoff expected from a ten-year, two-hour storm (4.3 inches of rainfall) which will be achieved by infiltrating the entire drainage area into the ground. NCDENR requires treatment of first 1.5" of runoff. Since this requirements is less than the 4.3 inches required by the Town, this requirement will be satisfied by meeting the Town's requirement. Infiltration testing has been performed in both the uncompacted and compacted states to simulate the subgrade condition for the infiltration basins and pervious concrete, respectively. (EAS) has prepared this addendum to the above referenced report. The purpose of the addendum is to provide the results of double -ring infiltrometer testing (ASTM D 3385) to more accurately assess the infiltration rates of the site subgrade soils. For purposes of initial/preliminary Hydrological Design of the planned pervious concrete pavements for the proposed new Lowe's Home Improvement store, EAS previously recommended using a saturated infiltration rate of 1 inch/hour for the stabilized/compacted site sandy soils or similar planned borrow fill soils placed and compacted per the recommendations within geotechnical report. Additionally, we recommended that EAS be retained to perform Double -Ring Infiltrometer testing of the site soils that have been stabilized/re-compacted to provide the civil designer a more accurate infiltration rate for the site subsurface soils to allow for the optimization of the hydrological design, including possibly reducing the footprint of the planned storm water management areas. As per our recommendations, EAS performed double -ring infiltrometer testing to determine the infiltration rates of 1) subsurface soils within the planned area of infiltration/ex-filtration basin and 2) compacted/densified subgrade soils for the pervious concrete subgrade. Attached to this addendum letter are the results of the double -ring infiltrometer testing. In -situ Soils (Storm Water Management Area) An area within the location of the planned storm water management area, adjacent to Landing Drive, was excavated to a depth of approximately 12 inches below existing site grades in order to perform infiltration testing of in -situ (un-compacted) site subgrade soils. The double -ring infiltrometer test was performed for a period of 270 minutes (4'h hours) and resulted in a total maximum infiltration rate of approximately 19 to 19.5 inches/hour. GEOTECHNICAL AND CIVIL ENGINEERING - CONSTRUCTION MATERIALS TESTING - ENVIRONMENTAL LABORATORY TESTING - LAND SURVEYING - SPECIALTY INSPECTIONS PROFESSIONALS. INC. Compacted Subgrade (Pervious Concrete Areas) An approximate 10-foot by 10-Foot area was excavated to a depth of approximately 2 feet below existing site grades. The sandy subgrade soils within the bottom of the excavation were moisture conditioned (wetted) and densified with a vibratory smooth -drum roller. The excavated sandy subgrade soils were subsequently moisture conditioned and placed (compacted) within the excavation to achieve a compacted subgrade for infiltration testing. The fill soils were placed and properly compacted in general accordance with the structural fill placement and compaction criteria per Lowe's Section 600 requirements (compacted to at least 95 percent of the materials standard Proctor maximum dry density value as determined by ASTM D 698 — 100 percent in the upper 18 inches). Upon completion of compaction, the double -ring infiltrometer test was performed on the compacted subgrade soils for a period of 270 minutes (4% hours) and resulted in a total maximum infiltration rate of approximately 6 to 6.5 inches/hour. (EAS) has prepared this addendum to the above referenced report. The purpose of the addendum is to provide recommendations for the seasonal high ground water elevation. We understand that the seasonal high ground water elevation is used to design the bottom elevation of the planned storm water management basins. Our subsurface exploration was performed during the first week of May 2010 (May 3 — 7). The observed ground water elevations at the boring locations within the vicinity of the planned storm water management area adjacent to Landing Drive (south portion of site) were generally observed at approximately 1 to 1.5 feet, mean sea level (msl). EAS returned to the site on September 21 and 22, 2010 to perform double ring infiltrometer testing of the site soils during the anticipated, normal, high ground water time of year. The infiltrometer testing was performed to provide accurate infiltration rates for design of the storm water management basins as well as the planned pervious concrete pavements. The infiltration testing was performed in the vicinity of the planned storm water management area adjacent to Landing Drive. A trench/Test Pit excavated adjacent to the infiltration test locations indicated a ground water elevation approximately 4 feet below existing site grades (approximately 1.75 to 2 feet, nisi). Based on published rainfall data for Kill Devil Hills, the area had received 36.24 inches of rain prior to our site visit for infiltration testing, including a 3.39 inch event on September 3, 2010 (2 '/2 weeks prior to our site visit and ground water measurement). Based on our site observations and measurements on September 22, 2010 and the published rainfall data for the Kill Devil Hills area, we recommend using a seasonal high ground water elevation of 2 feet, msl. The aggregate base course should be maintained in a drained condition at all times. Water build- up in the base course could result in premature pavement failures. Subsurface drains are typically utilized beneath a pavement where water may enter the pavement from below or above. Based on the anticipated subgrade improvement and structural, fill depths below the planned pavement sections, we do not anticipate that sub drains are required for this site. Proper drainage may be aided by grading the site such that surface water is directed away from pavements and by construction of swalcs adjacent to the pavements. All pavements should be graded such that surface water is directed towards the outer limits of the paved area or to catch basins located such that surface water does not remain on the pavement. A minimum pavement grade of 2 percent is recommended. Concrete pavements and bases should be constructed in accordance with the guidelines of the latest applicable North Carolina Department of Transportation Specifications. Materials, weather limitations, placement and compaction are specified under appropriate sections of this publication. Concrete pavement construction should be in accordance with applicable American Concrete Institute (ACI) guidelines. Recent pavement studies by the American Concrete Pavement Association (ACPA) have indicated that jointed plain concrete pavements perform at least as well as, and usually somewhat better than, jointed reinforced concrete pavements. These studies also conclude that transverse joint spacing has a very significant effect on pavement performance. Decreasing the longitudinal joint spacing to more equally spaced transverse and longitudinal joints and square sections has the following beneficial effects: • Decreases thermal curl stress • Decreases transverse cracking • Decreases upward curling of slab at joint • Decreases joint spalling • Decrease seasonal and daily joint opening (which increases joint load transfer effectiveness and reduces sealant extension) Recommendations for Previous Concrete Pavements In general, the construction and long-term performance of pervious concrete pavement requires the following: Proper engineering of the pavement subgrade to insure stability of the pavement sections and provide adequate infiltration rates to satisfy the projects hydrological design parameters. Based on the preliminary site grading plan, the planned pavement subgrade will be constructed primarily using offsite borrow fill soils. Once the offsite borrow source is selected a representative sample of the borrow soils should be sent to EAS Laboratory for testing. Basic testing of the planned subgrade soils should include particle size analysis (ASTM D422), soil classification (ASTM D2487) and standard Proctor (ASTM D698). (SP) with little or no fines (less than 5% passing the No.200 sieve — onsite soils tested had only approximately 1% passing the #200 sieve). • Engineering of proper mixtures using available/local aggregates with cement, water, and admixtures to achieve a proper workable consistency that allows placement of the previous concrete with minimal or no jobsite adjustments and yields the required strength and permeability/infiltration values. Admixtures such as silica fume, fly ash, blast furnace slag, set retarders, hydration stabilizers, viscosity enhancers, and other chemical additives that will improve the workability and durability of the pervious concrete should be considered. Mix designs and the final approved mix should be tested using a minimum of 2 — 225 ft2 test panels for each mix design as described in ACI 522,1-08 and ACI 522R-06. EAS's materials engineer should be retained to observe, document, and test the panels per ACI 522.1-08.; • Qualification of project construction personnel prior to placement of the site pervious concrete pavements (reference ACI 522.1-08 for minimum requirements). The previous concrete pavement contractor should have current National Ready Mix Concrete Association (NRMCA) Certifications. The NRMCA Certifications will ensure that knowledgeable pervious concrete contractors are performing the site work and thereby minimize the chance of poor quality/unsuitable results. The concrete installation crew members, installation crew Forman, and installation Quality Assurance officer should have current Pervious Concrete Technician Certifications, Pervious Concrete Installer Certification and Pervious Concrete Craftsman Certification, respectively. EAS's project engineer should be provided the contractors certification well in advance of field work and EAS's certified engineering technician will confirm the contractors personnel match - up to the submittal documents and/or that the crew meets the ACI 522.1-08 and this reports minimum requirements; • Qualification of project onsite engineering inspection personnel. The Owner's onsite construction materials testing engineering technician should have a current Pervious Concrete Technician Certification. • Engineering of a detailed, pavement joint plan/drawing in general accordance with ACI 522.1-08, ACI 522R-06, and Pervious Concrete specialist, which includes accurately dimensioned locations and depths of all contraction, construction and isolation joints. As with conventional concrete pavement, decreasing the longitudinal joint spacing to more equally spaced transverse and longitudinal joints and square sections has significant beneficial effects; • Engineering of planted areas and drainage swales to avoid introducing potential foreign debris onto the surface of the pervious pavements; • Develop a cost effective long term maintenance program that includes periodic inspection of the pervious concrete field to identify structural distress and/or clogging of the surface pores with foreign debris. The long term maintenance plan should also include periodic vacuuming and/or light pressure washing of apparent clogged areas. For purposed of a the initial/preliminary Hydrological Design we recommend using a saturated infiltration rate of 1 inchihour for the stabilized/compacted site sandy soils and the planned borrow fill soils placed and compacted per the recommendations of this report. A relatively small test area can be prepared by our engineers and tested with minimal disturbance to the site. The purpose of the testing is to provide the civil designers a more accurate infiltration rate for the site subsurface soils. We also recommend Double Ring Infiltrometer testing (ASTM D3385) of the offsite borrow soils placed and compacted per the project recommendations to verify the suitability of the offsite borrow soils in advance of mass hauling of the borrow soils to the site. 5.9 TEMPORARY EXCAVATION RECOMMENDATIONS Mass excavations and other excavations required for construction of this project must be performed in accordance with the United States Department of Labor, Occupational Safety and Health Administration (OSHA) guidelines (29 CFR 1926, Subpart P, Excavations) or other applicable jurisdictional codes for permissible temporary side -slope ratios and/or shoring requirements. The OSHA guidelines require daily inspections of excavations, adjacent areas and protective systems by a "competent person" for evidence of situations that could result in cave-ins, indications of failure of a protective system, or other hazardous conditions. Based on the results of the 52 soil test borings for this evaluation, the upper site soils are very loose and will likely cave off during trench excavations below 3 to 4 feet. The operation of heavy and/or vibratory equipment adjacent to open trenches will likely cause additional instability. 6.0 CONSTRUCTION QUALITY CONTROL As previously discussed, the Geotechnical Engineer of record should be retained to monitor and test earthwork activities, and subgrade preparations for foundations, floor slabs and pavements. It should be noted that the actual soil conditions at the various subgrade levels and footing bearing grades may vary across this site and thus the presence of the Geotechnical Engineer and/or his representative during construction will serve to validate the subsurface conditions and recommendations presented in this report. We also stress the importance of conducting hand auger borings and Dynamic Cone Penetrometer (DCP) or Static Cone Penetrometer (SCP) testing in the footing excavations in order to confirm the anticipated subsurface conditions and identify footings that should be undercut and repaired as outlined in this report. We recommend that EAS be employed to monitor the earthwork and foundation construction, and to report that the recommendations contained in this report are completed in a satisfactory manner. Our continued involvement on the project will aid in the proper implementation of the recommendations discussed herein.
