DANIEL SMITH Director NORTH CAROLINA Environmental Quality October 14, 2020 Certified Mail # 7018 1130 0000 1612 7963 Return Receipt Requested Michael Boaz, Town Manager Town of Pilot Mountain 124 West Main Street Pilot Mountain, NC 27041 Subject: NOTICE OF VIOLATION & INTENT TO ASSESS CIVIL PENALTY Tracking Number: NOV-2020-PC-0448 Compliance Evaluation Inspection Pilot Mountain Wastewater Collection System Permit WQCS00112 Surry County Dear Mr. Boaz: On September 25, 2020, Gary Hudson of the NC Division of Water Resources, Winston-Salem Regional Office, met with Mark King, Wastewater Treatment Plant Operator, and Darian Goins, collection system ORC, to conduct a Compliance Evaluation Inspection (CEI) of the Pilot Mountain Wastewater Collection System. This was a follow-up inspection for the CEI conducted on September 23, 2019, in which a Notice of Violation & Intent to Assess Civil Penalty (NOV-2020-PC-0448) was issued. During the August/September 2019 inspection, the pump stations were inspected. Out of the 19 duplex pump stations inspected, 11 of them had one pump out of operation for an extended period. During the September 2020 follow-up inspection, the pump stations were inspected again. Out of the 19 duplex pump stations inspected, 10 of them had one pump out of operation for an extended period of time, and one (Nelson Street — Station 12) has been completely off-line since January 2020. It is noted that new pumps/motors have been purchased for most of the inoperable pumps, but they still have not been installed. Therefore, a Notice of Violation and Intent to Issue Civil Penalty is being issued for the noted violations of the facility's wastewater collection system permit and the NC statutes and regulations under which it was promulgated. Please be aware that pursuant to NC General Statute (NCGS) 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to NCGS 143-215.1.
