Please provide cross section details showing the provisions for aquatic life passage The proposed provisions for aquatic life passage for the pipe roadway crossings will be designed and installed as per the USA CE Nationwide General Conditions including burying the pipe below the streambed of the channel to allow for the passage of aquatic organisms. Where multiple pipes are required one will be buried for passage. As the transportation plans are finalized they will be forwarded. 3. Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans. Building envelopes are shown on all lots with wetlands streams are buffers C3, C4 and C21 and of the civil plans. 4. Please indicate proposed lot layout as an overlay on the site plan. The proposed lot layouts are shown on drawings C3 and C21. 5. Please locate any planned sewer lines on the site plan. The proposed sewer lines have been designed and located as shown on the Utility Plan C- 21 however, the utilities have not been designed to construction level detail. The civil drawings show the potential sewer outfall locations are out of the way of the impacts. 6. Please provide an inventory of imperviousness surfaces in each drainage area. The inventory should include all proposed building footprints, roads, driveways, sidewalks, gravel-surfaced areas, amenity areas, etc. A Stormwater Management Plan (SMP) must be provided for any drainage areas that exceed 24 percent imperviousness. For each BMP, provide a completed BMP Supplement Form with all the required items (see http: Hh20.enr.state.nc.us/su/bmpforms.htm). Per NCAC 2B 15A: 02H.1 000, a "drainage area" is defined as "the entire area contributing surface runoff to a single point." If you intend to phase this project, you must provide the DWQ a conceptual stormwater plan for the entire property. An inventory of impervious surfaces is shown on Storm Water Plan SW-X. An exact inventory is included in the preliminary nitrogen export calculations in the storm water plan included with this submittal. 7. If this 401 Water Quality Celtification is issued you will need to provide documentation of the local government's approval of the stormwater management plan (SMP) for this project by providing EITHER: • A valid approval letter and one copy of the approved SMP (including plans and calculations), OR • One set of storm water plan details and calculations stamped as "Approved" by the local government. The development studies showed that the significant growth already occurring in the area has created demand for additional retail space. The addition of these desired commercial retail development will substantially reduce the amount of travel required of Holly Springs residents to obtain comparable brands. The development of the roadway for the project will significantly improve the flow of traffic in the area. With regard to cumulative impacts, the construction of the east-west connector for Holly Springs will likely result in additional development in the area. However, the areas at three of the four quadrants of the intersection that will be created have y been developed or have already been approved for development at this time. The area surrounding the connector roadway has been heavily developed with industrial commercial and residential uses and is in need of better access. With regard to cumulative impacts in the area the Wake County landfill is not likely to be developed into hard surfaces but once closed will likely be developed into open space such as parkland or golf course use. Because the thoroughfare was already on Holly Spring's transportation improvement plan the cumulative impact of the development does not significantly affect the long- term development of the area. The thoroughfare plan and the proposed commercial and residential developments are consistent with the town of Holly Springs long-term development plans area therefore, the cumulative impact of the development is not likely to be greater than the eventual development anticipated currently by the town I'll express. The Holly Springs development plan is attached. Transportation projects do have an impact on long-term development of an area. However, because the transportation plan and development plan has already been established and accounted for in the development scheme the only question is when the development will occur. Millbrook Rd Suite 121 Raleigh, NC 27604 Phone: 919-871-0999 Fax: 919-871-0335 REVISED AVOIDANCE AND MINIMIZATION AND IMPACT JUSTIFICATION: Holly Springs is a rapidly growing community in Wake County. The need for additional retail space in Holly springs is driven by this rapid growth. This site was initially selected for the accessibility to surrounding roadways both current and future. The owners desired a development that would serve the needs of Holly Springs and surrounding communities and yet have a minimal impact on the environment. The owners have employed a professional design team who has utilized modern design techniques to ensure a minimal impact on the environment throughout the building process and maintenance upon completion. Alternative sites were considered in the service area which consists of the NC 55 corridor in Holly Springs. The requirements for development were: • Adequate access for a regional retail center to serve Holly Springs and surrounding communities. • A site where the required utilities are in place that precludes the need for additional impacts for long utility connections. • Access to the nearby 1-540 corridor which is just north of the adjacent closed landfill site. • To be large enough to accommodate the proposed scope of development. • That could be improved to a marketable state to justify lot prices to keep the lot sizes large. • Improvements would justify a return on investment. • Could be developed with minimal impact on the environment when compared to other sites with comparable hydrogeologic characteristics. Because of the wish of the Springs Investors to sell the property for a development which would be the highest and best use at a fair market price and to create a development that would keep environmental impacts to the property to a minimum the development plan required the creation of lot sizes that would generate revenues to make the land purchase viable. After researching the area it was determined that no other sites met the aforementioned criteria. Page 7A The site selected and property in the surrounding area is shown on Figure 1 below in red along with the streams shown on the Wake County iMaps site. While many of the "blue lines" shown below are not intermittent or perennial streams as defined by either the NCDENR rules or the US Army Corp of Engineers guidelines and as noted by the approved jurisdictional determination on the site they do indicate that all of the property in the area have geology that is eroded and has ephemeral channels, as well as intermittent and perennial streams. 3 5? -4 lµ ' r 1 - _ ? ?L. - y ?';(? {:III 4y S C]yy ?rS I ?I. Page 7B The town of Holly Springs is located on a fault line at the the edge of the contact point between the Deep River Triassic Basin and the metamorphic rocks of the Carolina Slate Belt as shown on the geologic map below (Figure 2). r Figure 2- Wake County Geologic Map Page 7C Because of this geologic location the area has a number of eroded drainage features due to the easily erodible soil structure and the associated groundwater hydrology. These features result in perched water and ephemeral flow immediately following rainfall. As such the Wake County iMaps show a number of features that only flow during rainfall events (See Figure 3 Below). Many of the "blue lines" shown below are ephemeral channels and are not intermittent or perennial streams as defined by either the NCDENR rules or the US Army Corp of Engineers guidelines as noted by the approved jurisdictional determinations. However, the Town of Holly Springs and the NCDOT indicated that the location of the parcel made it conducive to the extension of the Holly Springs Connector Parkway. The majority of the impacts of the project are due to the extension of this roadway which would have occurred at or near these locations whether regardless of the development of the property. Avoidance and minimization has been achieved by moving the Parkway as far south as possible. This reduced the amount of streams impacted by the roadway project. The impacts of the roadway have been reduced by using retaining walls where possible as well as using buried culverts to facilitate pathways for aquatic life. All of the commercial developments and access roadways were placed on high ground where possible and were planned for areas of the site that minimized impacts to jurisdictional streams either for NCDENR rated intermittent or perennial streams or Corp of Engineers rated intermittent or perennial streams. Water quality has been protected by using Best Management Practices as required by the Town of Holly Springs in accordance with the 2007 NC DENR Best Management Practices Manual which is the most recent version. The development is also providing 30 feet buffers on both sides of the intermittent and perennial streams in accordance with the Town of Holly Springs storm water rules. The storm water BMPs will include ponds for nitrogen reduction and stormwater control in accordance with the ordinances of the Town of Holly Springs which are similar to the Neuse River Rules. Page 7E ADDITIONAL RESPONSE AVOIDANCE AND MINIMIZATION AND IMPACT JUSTIFICATION: NCDENR in a letter dated January 25, 2010 indicated the opinion that the impacts proposed for Impact Area Nos. 1, 2, 3, 12, 13 and 14, could be avoided by bridging the stream at these areas. In addition, NCDENR indicated the opinion that the impacts proposed for Impact Area Nos. 4, 5, 6, 7, 8, 9, 10, II, and 15, could be avoided by configuring the site layout and by proposing parking decks where applicable. These items are addressed as follows: First it should be noted that overall many of the streams impacts are ephemeral streams required to be noted by the US Army Corps of Engineers. These streams do not meet the 19 point criteria used by NCDENR. The actual stream impacts under the 401 rules are significantly less than the impact in linear feet noted on the various tables in the Preconstruction Notification documents. In fact in the shopping center area the streams impact using the 19 point criteria is less than 250 feet. This has been accomplished by dividing the shopping center in to 4 separate parcels with large cutout areas to avoid streams and by the extensive use of retaining walls to minimize impacts to streams. The remainder of the impacts for streams under the NCDENR 19 point method are due to the construction of the Holy Springs Thoroughfare. As you noted in your letter, some of the impacts proposed for Impact Area Nos. 1, 2, 3, 12, 13 and 14 could be avoided by bridging the streams, however, the cost of bridging these streams would make the overall cost of the development impractical. The impacts for this roadway have also been reduced by the use of tall headwalls and by alignment of the roadway perpendicular to the streams and by alignment of the low points in the roadway as much as possible and still meet the NCDOT roadway standards. Many of these impacts are located off of New Hill Partners property. And some of these impacts are to ephemeral streams noted by the USACE. Page 7F As you noted in your letter, some of the impacts proposed for Impact Area Nos. 4, 5, 6, 7, 8, 9, 10, II, and 15, could be avoided by configuring the site layout and by proposing parking decks, however, the cost of parking decks as well as the difficulty of accessing the buildings from parking decks would again make the development impractical. The site layout has already been configured to reduce impacts to streams and wetlands to the maximum extent possible. As can be seen on drawings C3 and C4, all of the roadways, building and parking areas, storm water management ponds, and other site improvements have been laid out to avoid streams and wetlands to the maximum extent and still have an economically viable site. A parking deck is not feasible in a suburban shopping development. In order to have an economically viable development parking decks were avoided for this center. It should again be emphasized that the design of the development has avoided streams by separating the development into 4 areas. Further minimization, including the use of parking decks, is not economically practical, or practical for attracting shoppers. It should also be noted that several of the stream crossings are intermittent streams on the main roadway corridor and all of the streams noted in that shopping center area are either ephemeral or intermittent. Reducing impact to these streams would have minimal effect on the preservation of water quality. Also, as noted on the drawings, the Town of Holly Springs requires a 30 foot buffer around all streams. The Storm Water Management Plan is also required to meet nitrogen reduction requirements and Best Management Practice requirements.
