DEQ is providing this correspondence to Duke Energy as documentation of compliance with part of Session Law 2016-95 (House Bill 630) referred to as the Coal Ash Management Act (LAMA) for the closure of the Riverbend Steam Station (Riverbend). On December 6, 2019, DEQ sent Duke Energy a letter titled Documentation of Compliance with the Coal Ash Management Act of 2014, Session Law 2014-12Z Section 3. (b), 3. (c)(1) and 3. (c)(2) Coal Ash Impoundment Excavation and Closure, Riverbend Steam Station — Ash Basin 1 and Ash Basin 2) in which DEQ concurred that Duke Energy complied with CAMA Session Law 2014- 122 Section 3.(b), 3.(c)(1), and 3.(c)(2). Within the December 6, 2019 letter, DEQ requested that Duke Energy provide a closure report for the facility in order to further satisfy the requirements under CAMA House Bill 630 General Statue 130A-309.214(a)(4). Please also note that Duke Energy has yet to comply with CAMA Session Law 2014-122 Section 3.(c)(3), as corrective action is ongoing at the facility as stated in DEQ's December 6, 2019 letter.
