Allen Pipkin 11030 Raven Ridge Road, Suite 109 Raleigh, NC 27614 Subject Property: SE 40 Centre Poplar Branch [030402, 27-34-11-1, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Pipkin: DWQ Project # 08-1832 Wake County On December 16, 2008, the Division of Water Quality (DWQ) received your application dated December 12, 2008, to fill or otherwise impact 4,312 acres of 404/wetland, 170 linear feet of reportedly ephemeral stream, and 0.00 square feet of Zone 1 Neuse River basin protected riparian buffers and 0.00 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential/commercial project at the site. On January 12, 2010, the DWQ returned your project to you, however, based on discussions with your attorney, Steve Levitas, the DWQ has agreed to reinstate your project and requests the following information as discussed below. The DWQ will require this additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The document "Downstream Channel Calculations for Southeast 40 Centre,' dated July 17, 2009, and submitted by your consultant, Bass, Nixon, Kennedy, Inc. shows that the flows are being discharged to the ephemeral channels at an erosive velocity. Therefore, the current configuration of the stormwater outfalls is not be considered by the DWQ to meet the criteria for "Existing drainage ditches, roadside ditches and stormwater outfalls" in Item (6) of the Neuse Riparian Buffer Rule (15A NCAC 2B .0233). 2. The riparian buffers are too steep to allow for diffuse flow in these locations. Please provide a BMP or series of BMPs that removal a minimum of 85 percent TSS and 30 percent TN from the stormwater discharged from the roadways. For each proposed BMP, please provide a completed BMP Supplement Form, with all the required items. The BMP Supplement Forms are available at: http://portal.ncdenr.org/web/wq/ws/su/bmp-manual. An estimation of the percentage imperviousness associated with each of the drainage areas. c. A preliminary calculation of the water quality volume associated with each drainage area. d. A depiction of the proposed BMPs (state the type of BMPs you plan to use) on the site plan that is correctly sized based on the water quality volume. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
