RESOLUTION AFFIRMING THE TOWN OF RANLO'S SUPPORT REGARDING 1MPLLMENTATfON OF A
COMPLIANT NPDE9 M54 STOCtMWATER PROGRAM
A RESOLUTION to develop �unl implement a compliant stonnwater management program that meets the requirements of THE
TOWN OF RANLO's National Pollutant Discharge Elimination System (NPDES) Municipal Separate Stonn Sewer System (MS4)
Permit number NaO00417 to discharge stormwater, inclusive of the required Stormwater- Management Plan to be prepared byTFE
TOWN OF RANLO and approved by the North Carolina Department of Environmental Quality.
WHEREAS, Section 402(p) of the federal Clean Water Act required NPDES permits for stormwater discharges from mttnTipal
separate storm sewer systems; and
WHEREAS, in North Carolina, NPDES Permits are issued by the North Carolina Department of Environmental Quality; and
WHEREAS, the North Carolina Department of Environmental Quality issued THE, TOWN OF RANLO its third NPDES MS4
Permit fordischarge of stormwater on Febntary20, 2017; and
WHEREAS, THE TOWN OF RANLO was issued Notice of Violation number NOV-2020-PGO352 on August 31, 2020 for
noncompliance with the issued NPDES MS4 Permit; and
WHEREAS, THE TOWN OF RANLO acknowledges the specific Notice of Violation requirement to obtain an individual NPDES
IVLS4 Permit which does not include co-permittees; and
WHEREAS, THE TOWN OF RANLO acknowledges the specific Notice of Violation requirement to adopt a Board Resolution to
implement a compliant and enforceable stormwter management program as defined by both the NPDES MS4 Permit number
NCS000417 and the required approved Stonnwater Management Plan, and said resolution is to be submitted to the North Carolina
Department of Environmental Quality no later than December 31, 2020; and
WI IEREAS, 'IM TOWN OF RANLO acknowledges the specific Notice of Violation requitement to develop and implement a
Stormwater klarragement Plan in accordance with Section 402(p)(3)(B)(iu) of the Clean Water Act, 40 Ck R 122,34(b) and NPDES NL54
Permit requirements and to submit its StormwaterManagement Plan to the North Carolina Department of Environmental Quality for
approval no later than October 31, 2020; and
WHEREAS, THE 'TOWN OF RAM,.O aclnowledges the requirement to provide adequate funding and staffing to implement a
Stormwater Management Program that complies with its NPDES A+1S4 Permit and approved Stormwater Management Plan; and
WHEREAS, THE TOWN OF RANLO acknowledges that North Carolina Department of Environmental Quality enforcement
action and penalties could result from ran -compliance with the specific requirements in Notice of Violation mu-nber NOV-2020-PG
0352; and
WHEREAS, TTfE TOWN OF RANLO acknowledges that any North Carolina Department of Environmental Qualityeraforcement
action and penalties may not prohibit the U.S. Environmental Protection Agency front taking its orna enforcement action for non
compliance with the issued NPDES M34 Permit.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of THE TOWN OF RANLO hereby affirm its
support for development and implantation of a compliant NPDES MS4 Stormwater Program.
