Funston Land & Timber, LLCBrunswick Forest Boat Ramp Page Two 9. PROJECT DESCRIPTION The project is located off of NC Highway 17, adjacent to Town Creek, in Leland, Brunswick County. To find the project site from Wilmington, travel approximately 3 miles south on US Highway 17. The main entrance to the development will be on the left. To find the "river club" site, travel an additional mile (approximate distance) to Kay Todd Road (NC1553) on the left. Turn left and follow Kay Todd Road approximately 1.5 miles to the end of the paved road. Continue another 0.6 miles on the dirt road until it forks. Veer right at the first fork and bear right again at the next fork (less than 0.1 mile in distance). Travel to the end of the dirt road, which terminates at the site on Town Creek. The entire Brunswick Forest development consists of approximately 4,200 acres of land, bordered by NC Highway 17 to the north, Town Creek and undeveloped land to the south, residential developments and NC Highway 133 to the east and undeveloped land to the west. A "river club" is proposed at the southwest corner of the development along Town Creek. This site consists of a 7-acre parcel which is currently undeveloped and labeled as Section 8 in the State Stormwater Master Plan. Coastal wetland vegetation is absent in the immediate vicinity of the project, however a small section of §404 wetlands has emerged at the toe of the old dirt ramp. Vegetation along the shoreline consists mainly of Pickerelweed (Pontederia cordata) and Marsh Spider Lily (Hymenocallis crassifolia). Woody vegetation consists primarily of Pine (Pinus spp), Oak (Quercus spp), Sweet Gum (Liquidambar styraciflua) and Cypress (Taxodium sp). Giant Cane (Arundinaria gigantea) and Sedges (Carex spp) appear to dominate the understory of the wetland portion of the tract. The existing dirt road terminates in a cul-de-sac at the river. There are no other existing man-made features on the tract. At this time, the applicant states that no additional development is being proposed within the boundaries of Section 8. Multiple sedimentation and erosion control plans and stormwater permits have been issued for the development (see attached list). A Nationwide Permit #29 (Action ID#SAW-2007-530) was issued by the US Army Corps of Engineers (USACE) on 3/4/09 for wetland impacts associated with Phases 3 and 5; an approved 401 Water Quality Certification (Project #07-2046) was issued by the NC Division of Water Quality on February 16, 2009 for Phases 3 & 5. Please refer to the Master Strormwater Permit and the Master Erosion and Sedimentation Control Plan for additional information related to these topics. The waters of Town Creek, adjacent to the project site, are classified as C by the North Carolina Division of Water Quality. They are classified as Inland Waters and therefore are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant is requesting approval to construct a community boat ramp and launch facility adjacent to Town Creek, in Section 8 of Brunswick Forest. The proposed development would include installing a 19' x 85' boat ramp along the southern property line bordering Town Creek. Site characteristics demonstrate that the ramp area has been historically used, although it does not appear that the area has been used for quite some time. The applicant's proposal states that improvements are being made to improve the quality of the site and to make the site more user friendly. The ramp would extend Funston Land & Timber, LLCBrunswick Forest Boat Ramp Page Three approximately 27.5', on average, below the elevation of Normal High Water (NHW). The entire docking facility, including the ramp, would be installed at a 60 degree angle (+/-) from the shoreline and would point toward the southwest. Construction of the ramp would result in the filling of approximately 41 sq. ft. of "404" type wetlands along the shoreline. As previously mentioned, the ramp is existing, however it is not being used on a daily basis and wetland vegetation has volunteed in the gully of the ramp. The applicant states that the ramp would be poured on the high ground portion of the property and then pushed in place. The head (top) of the ramp would be located within the same alignment as the existing dirt road leading down to the site. A total of eight (8) parking spaces would be created for the facility, two (2) located within the existing turn around and six (6) located along the northern side of the dirt drive leading down to the ramp. According to the applicant no improvements are being proposed at this time with respect to the parking spaces or dirt road leading down to the facility. According to the applicant, the boat ramp and boat launch site is the only development within Brunswick Forest which falls within any of the CAMA Areas of Environmental Concern (AEC's). The proposed pier and floating dock would be located immediately adjacent to the boat ramp, on the northern side, and would extend approximately 37' into the waterbody of Town Creek. The facility would consist of an 8' x 20' access pier and a 15' x 20' floating dock. The floating dock would be located in an area where water depths average approximately -3.0, below the elevation of Normal Low Water (NLW). The terminal end of the floating dock would measure approximately 37' from the NHW line, or just within'/4 of the width of the water body. As indicated, the proposed facility is to be used for transient docking only with no permanent slips. 10. ANTICIPATED IMPACTS The proposed boat ramp would result in the filling of approximately 41 square feet of Section 404 wetlands and approximately 484 square feet of open water. The proposed pier and transient docking facility would incorporate 404 sq. ft. of Pubic Trust Area. The proposed dock would not encroach into the adjacent 15' Riparian Corridor Setback requirement nor would the dock exceed 1/4 or the width of the water body or extend beyond the near shore channel edge. Minor increases in turbidity should be expected during construction. High ground disturbance associated with this development would be limited to 1,045 square feet. Submitted by: Jason Dail Date: 2/17/10 Office: Wilmington Project Narrative CAMA Major Permit, Express Review Brunswick Forest Boat Ramp Leland, Brunswick County, North Carolina Funston Land and Timber, LLC, Applicant This CAMA Major Permit proposes the construction of one fixed pier and associated floating dock and the redevelopment of the existing unpaved boat ramp. The dock is proposed in the open waters of Town Creek in Leland, Brunswick County, North Carolina. Town Creek is classified as inland waters by the Division of Marine Fisheries and features a 30' Public Trust Shoreline AEC. The water quality classification for Town Creek is C SW and the creek is not a Primary nursery Area (PNA). The proposed work includes the construction of 20' x 8' fixed pier, 20' x 15' floating dock with 2 temporary tie up slips and the redevelopment of the existing boat ramp with an 85' x 15' concrete ramp. The amenity will serve the residents of the Brunswick Forest Subdivision by providing water access for small craft. All of the proposed work is located in Phase 8. There is no other proposed work in Phase 8 at this time. Phase 8 is approximately 421 acres and there is approximately 669 linear feet of shoreline along Town Creek. The waterfront site is currently undeveloped. There is an existing soil access road leading to the site and existing unpaved parking areas along the soil road. There have been no previous permits for the River Club site. There is currently no upland development proposed at this site. There are no coastal wetlands on the site. A very narrow fringe of 404 wetland borders the creek in this location. The 404 wetland line has been re-staked here. The total amount of wetland impact from the proposed boat ramp is 41 square feet. Existing vegetation on the site consists of native grasses, trees and shrubs. Soils on the property are mapped by the Natural Resource Conservation Service (NRCS) as Norfolk loamy fine sand and Dorovan muck. In 2005, 0.1 acre of Waters of the U.S. was impacted using a No-notification Nationwide Permit 39. These impacts were needed to install two road crossings in Phase 1 of the 0. 1 IV ?J Q? -1- D FEB 0 a 2014 --It JIf%tfNKI ni: D - - - --- - ___ - - development. The applicant then obtained a Nationwide Permit 29 and a 401 Water Quality Certification for impacts located in Phases 3 and 5 of Brunswick Forest in 2009. The proposed impacts included six road crossings that disturbed 0.235 acre of 404 wetlands and 262 linear feet of stream. To mitigate for these cumulative impacts, the applicant was required to buy into the NC Ecosystem Enhancement Program (EEP) for the restoration of 0.19 acre of riparian wetlands, 0.14 acre of non-riparian wetlands, and 262 linear feet of stream. Because the EEP only allows purchase in 0.25-acre increments, Brunswick Forest purchased restoration credits for 0.25 acre of riparian wetlands, 0.25 acre of non-riparian wetlands, and 262 LF of stream. In addition, 135.59 acres of wetlands and 777 linear feet of stream were preserved. Based on this information, Brunswick Forest has 0.06 acre of riparian wetland restoration credit that can be used towards this project.
