Director Division of Water Quality March 30, 2007 DWQ Project # 2007-0421 Wake County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Paul Feldman 103 Kingussie Court Cary, NC 27511 Subject Property: 103 Kingussie Court, Cary , NC UT to Swift Creek [030402, 27-43-(1), WSIII, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Feldman: On March 9, 2007, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit received your Minor Variance application dated March 5, 2007 regarding your request for a Minor Variance from the Neuse Buffer Rules (15A NCAC 2B .0233) for the subject property. The Division of Water Quality (DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. Site Plans Please revise your site plan (revised plat dated July 7, 1999) to show Zones 1 and 2 of the protected buffers. 2. Area of impact In your application, you state that 6 feet of Zone 2 buffer will be impacted. Please revise your plan sheet to state and show the area (in square feet) of buffer impact in Zone 2. 3. Stormwater Management Stormwater management will be required as a condition if you choose to proceed with the Minor Variance. Please provide a stormwater management plan depicting how you intend to treat the stormwater running off the proposed impervious surfaces. One option you could use, is to show that the stormwater gutter(s) on your home will be directed out of the buffers. Please show your stormwater management devices on your plan sheet.
