The existing site contains the Bridge Pointe Hotel, and is approximately 95% impervious overall. Work associated with the project includes preparation of the site for construction of 3 residential condominium buildings, a new marina office, the destruction of the existing hotel and construction of a new hotel. Modification of the existing stormwater management system, construction of an additional stormwater management system, parking and roads will also be performed. The disturbed area created by the proposed work includes most of the existing 16.42 acres. SITE DESCRIPTION The project site is located along the James City waterfront at the confluence of the Trent and Neuse Rivers, opposite from downtown New Bern. The Division of Coastal Management Area of Environmental Concern (AEC) at this location measures 75 feet landward from the normal water line of the Trent River, and contains approximately 3.07 acres of the project site. The project site has approximately 1,830 feet of shoreline and 1,865 feet of existing bulkhead/retaining wall. The existing configuration includes approximately 1,050 feet of concrete capped, - concrete sheet-pile bulkhead, 258 feet of tongue and groove wooden bulkhead and 557 feet of tongue and groove wooden retaining wall. (Where there is land on one side and water on the other of the wall, we refer to it as a bulkhead, and where there is land on both sides of the wall, we refer to it as a retaining wall.) In its existing configuration, the project site is approximately 90-95% impervious, primarily due to a compacted gravel surface that is present throughout most of the site. The site also contains the existing Bridge Pointe Hotel, a marina office building, and parking areas. PHASED CONSTRUCTION Construction of this project is proposed to be divided into three phases. Understanding the phases requires knowledge of the assumed building numbering that is as follows; building one is located on the peninsula, building two is located south of building one, and building three is located where the existing hotel is currently. The location of these three buildings is within the waterfront portion of the project site (north of Outback Steakhouse) .The proposed hotel will be located on the landward portion of the project site (south of Outback Steakhouse). During phase one, the existing stormwater basin will be modified to the proposed dimensions, a new outlet structure constructed, the proposed forebay wall constructed, and the stormwater pipe network for buildings one and two installed. Construction of buildings one and two will follow, with appropriate site preparation NARRATIVE (cont'd) and manipulation. Both proposed driveways and connecting road portions will also be constructed during this phase to the extent that access to the existing hotel, the new buildings, and Outback Steakhouse will be established or improved. Phase two will probably begin with demolition of the existing hotel and associated improvements, and conclude with the construction of building three. Replacement of the existing wooden bulkhead/retaining wall will occur during this phase. Replacement of the existing wooden bulkhead will be performed by installing a new bulkhead in an alignment no more than two feet waterward of the existing bulkhead's alignment. Replacement of the existing wooden retaining wall will be performed by removing the existing and installing a new bulkhead in the same alignment. In some places, the height of the existing retaining wall structure will be increased. Replacement or new construction of sidewalks immediately behind the bulkhead (similar to those already present), new connections to the existing marina, and other provisions required to provide public access along the bulkhead will be installed. The stormwater pipe network intended to serve building three will be installed toward the beginning of this phase. Construction of the proposed new stormwater basin and associated pipe network will initiate phase three. Construction of the proposed hotel, attendant parking and drives will follow. It is unclear which phase will involve the demolition of the existing dock master's/marina office or during which phase construction of the proposed dock master/marina office will occur. It is anticipated that construction of the new office will precede demolition of the existing office, with construction probably occurring as a final portion of phase one. Accordingly, demolition of the existing office will likely occur during the demolition portion of phase two. Depending upon information that arises during construction, phases two and three as described above may be reversed. It is also likely that there will be some overlap of activities within the phases herein described. Phases one and two construction is primarily located within drainage area one, and improvement or modification of the existing stormwater system will be correspond with the proposed construction. Phase three construction is contained entirely within drainage area two. Construction of the stormwater system proposed for this drainage area will occur prior to construction of any impervious surfaces other than roads. Upon completion of the proposed construction, approximately 54% of the AEC will be impervious. This represents an approximate 25% reduction in the amount of impervious surfaces within the AEC from the existing configuration. ("Bridge Pointe Hotel/Marina Site") Proposed use of property: Multi-family residential use Meeting date: March 28, 2006 Having heard all the evidence and argument presented at the hearing, the Board finds that the Applicant has offered competent, material, and substantial evidence to satisfy the six (6) elements established in Code Section 15-56(d) for the issuance of a conditional use permit as follows: (1). The requested permit is within the Board's jurisdiction according to Section 15-146 of the Code of the City of New Bern and all relevant sections of the Code of the City of New Bern. (2). The pedestrian walkway easement shall be conveyed by the Applicant to the City by Easement and Agreement substantially in the form of Exhibit B attached hereto, such easement to become effective and be delivered to the City upon (a) the completion and opening to public use of the presently planned new Trent River Bridge containing a pedestrian walkway thereon of not less than five (5) feet in width and with a protective barrier from the vehicular lanes of travel over said bridge and (b) completion of Building 3 as described on the application for this permit, such completion to be evidenced by the request for a Certificate of Occupancy from the City by the owner of such building.
