As a result of this audit, the City of Lexington was issued a Notice of Deficiency which included a report detailing the components in which the Stormwater Management Plan was deficient. As required by the Notice of Deficiency, the City of Lexington is to develop a draft Stormwater Management Plan to maintain compliance with the MS4 Permit. While developing a draft Stormwater Management Plan, it is our understanding that the City of Lexington is not required to submit an Annual Report for the 2019-2020 Fiscal Year, as is typically due by October 31 st. It is our intent that this letter serves to acknowledge the exemption this year from submitting an Annual Report. The City of Lexington understands our responsibility to comply with the Notice of Deficiency and our duty to maintain compliance with the MS4 Permit. As the City Manager of the City of Lexington, I would be considered the principal executive officer of the City. Please accept this letter officially appointing the City's Stormwater Administrator as the duly authorized representative for stormwater matters. This position is currently held by Zack MacKenzie. In the Stormwater Administrator's absence and serving as an alternate, I kindly request including the City's Public Services Director Chip Vanderzee.
