What is the
The storm drainage system includes storm drains, roadside ditches, roadside gutter pans, drainage swales

Notice of
The Stormwater Inspection Notice of Violation (NOV) is issued by an Environmental Specialist for

stormwater ordinance violations noted during an inspection. The NOV describes the nature of the violations
and explains what must be done to correct the violations.
What you
Upon receiving a NOV for stormwater ordinance violations, the violations must be corrected as described

on the NOV. Proof of correction must be provided to the China Grove Stormwater Administrator within the
time -frame specified on the NOV.
Note: Failure to correct violations within the specified time -frame may result in an automatic re -inspection
with a re -inspection fee and possible fines.
Prohibited
Violations that are resulting in an actual discharge to the storm drainage system (storm drains, street, or
discharges
other drainage structures) or natural surface waters must be halted immediately. Any substances other

than clean, potable water that have been discharged into the system must be removed, and any
substances on the ground must be completely cleaned and prevented from being discharged into the storm
drain system.
Violations that have resulted in the discharge of substances other than clean, potable water or exempt
substances to the storm drainage system are prohibited by to the following sections of local stormwater
ordinances: Town of China Grove Section 54-361.

Violations that have not resulted in the actual discharge of substances other than clean, potable water or
conditions

Illicit connections to the storm drainage system are prohibited by the following sections of local stormwater

Failure to stop a prohibited discharge or to otherwise comply with the NOV is an additional violation of the
local stormwater ordinance for each day the violation continues. Additional enforcement actions, including

may apply. Stormwater violations are subject to daily fines for continued violations. Issuance of the NOV
does not prevent the Town of China Grove from pursuing additional enforcement actions. Town of China

Cost recovery
Businesses may be liable for costs incurred by the Town of China Grove or the local municipal agency in
correcting, enforcing, or investigating violations. Town of China Grove Section 54.450.
Right to appeal
The right to appeal violations and enforcement actions is set forth in Section 54-444 of the Town of China
Grove Stormwater Ordinance. To appeal this matter, submit a written request for appeal to
this office along with the appropriate fee. Call [phone] and ask to speak with a Stormwater Specialist
for more fee and appeal information. The fee will be returned if the appeal is upheld. A request for appeal
must be received within 30 calendar days of receiving the NOV.
