Fuel Alcohol Permit of Dennis McCall, Transylvania County
Dear Ms. Becker:
I would appreciate some direction.in the above matter in a clear and understandable
format and that is why I am writing to you. Our problem, it seems, is that neither Mr.
McCall nor I are able to understand what is required of him to be permitted as a Fuel Alcohol
Producer in North Carolina.
Mike Luckey of the ATF has been somewhat helpful in that he recently told me that
when the State approves a permit for Mr. McCall, then the ATF will grant him a permit. A
review of my file indicates that we have made a number of inquiries to the State as to what
was necessary to get approval. At some point in this process Mr. McCall received a "Short
Form C" Application For Permit To Discharge from the State. After this, I spoke with you
by phone on December 2nd at which time you told me the application would have to be filled
out only if the local health department desired. I contacted the local health department and
the local health department could care less. Therefore, I concluded that the application did
not need to be filled out.
Next, we were requested by ATF to seek permission to have a test run for the purpose
of submitting the waste product to, presumably, your agency for inspection. This was done
on June 3rd.
Please help me understand the process here. Precisely what do I need to advise Mr.
McCall that he has to do in order to obtain a Fuel Alcohol Permit? It is extremely frustrating
x-e. r

to be dealing with two (2) governmental bureaucracies and without any direction whatsoever
as to the way to get this thing done and that is why I am writing for your assistance.

There has evidently been some confusion regarding this
agency's involvement with the Fuel Alcohol Permit Mr. McCall is
attempting to obtain. The Division of Environmental Management
(DEM) does not issue Fuel Alcohol Permits; these are, instead,
issued through the Bureau of Alcohol, Tobacco, and Firearms.
DEM's involvement is limited to the final disposal of wastes
generated by gasohol operations.
At the Bureau's request, I inspected Mr. McCall's operation
on November 22, 1994. Although the facility was not in
operation, I could find no means in which Mr. McCall would be
able to handle the waste from the alcohol process. Some months
after the inspection, I received a letter from your office
(October 12, 1995) stating that Mr. McCall would be feeding the
waste from the alcohol process to his pigs. As long,as he is
able to do this and does not cause a water quality problem with
respect to the waste from the gasohol operation or from the pigs,
this office will consider Mr. McCall's operation in compliance
with North Carolina's water quality regulations. I have conveyed
this information to.the Bureau of Alcohol, Tobacco, and Firearms.

your distillation -operation. At that time,'a leak from one of
the distillation tanks was exiting the building and flowing down
the bank toward the stream. The discharge of wastewater, even in
small volumes, without a permit constitutes a violation of N. C.
General Statute 143-215.1.
Although a large storage tank has been installed to contain
` the wastewater from the operation, piping within the building has
to be manually changed to allow the flow of wastewater to the
storage tank on the one hand or the flow of excess raw water to
the creek on•the other hand. At the time of Ms. Becker's visit,
the wastewater from the leaking distillation tank was draining
into the pipe leading to the creek. All wastewater from the
tanks .... leak, spill, or otherwise should be routed to the
storage tank. The alcohol and sugar that are part of this type
of operation generate a very high oxygen demand in the stream and
even minute amounts can create environmental problems.
The storage tank was full and in need of pumping. Also,
there is a sizable hole on the top corner of the tank that is
allowing inflow of rainwater into the tank. This will
unnecessarily increase the number of times the tank will have to
be pumped. The hole should be repaired.
The condition of the road is so poor (steep, narrow, and
rutted) that Ms. Becker was skeptical a septage hauler would

Thank you for .calling me back in response to my letter of October 12th. In our phone
conversation you clarified that the "Short Form C" Application would be unnecessary in Mr.
McCall's case and that in order to finally permit Mr. McCall, you would need a statement
relative to how he planned to dispose of the waste/by-product from his operation. I have
conferred with Mr. McCall and would respond as follows:
Mr. McCall will dispose of the waste/by-product by feeding it to his
pigs. As I am sure you know, the pig is believed to be the most intelligent of
animals and is therefore quite capable of assisting Mr. McCall in the thorough
and safe disposition of the waste/by-product. Because of the location of their
current residence, their is no danger of runoff into any stream or water source
in the area.
I hope that, with this new information, you will be able to expedite Mr. McCall's
permit. He is a very nice man and will be more than happy to comply with any request for
information concerning his operation.

Again, please accept my gratitude for your willingness to simplify this confusing

Dear Mr. Dodson:
• On November 22, 1994, Ms. Kerry Becker of the Division of
Environmental Management inspected your gasohol distillation
operation for the purpose of determining whether or not this
operation would be subject to N. C. General Statute 143-215.1.
This statute states that no person will be allowed to discharge
wastes either upon the land or into state waters without first
obtaining a permit from this Division. Based upon results of
effluent samples collected on October 13, 1994, by the Alcohol
Law Enforcement Agency and upon observations made by Ms. Becker
during the November 22 inspection, your distillery is indeed in
violation of this statute and could lead to the initiation of
enforcement proceedings against you.
It would be impractical to consider treatment of the
discharge due to initial capital costs for construction and costs
due to operation. If the Transylvania County Health Department
cannot approve a disposal method, your only recourse may be to
haul the mash residue to a nearby municipal wastewater treatment
plant. Care should be taken, however, that this waste does not
cause the receiving wastewater treatment plant to violate its
NPDES permit. Permission must be obtained by the municipality
prior to discharging to the treatment plant. The municipality
may require some form of pretreatment prior to accepting any
waste. The wastewater from the distillery is characterized by
• low pH, excessive concentrations of total and suspended residue,
and most significantly an extremely strong oxygen demand. The
strength of this waste is such that even a moderate amount of it
could upset the municipal treatment plant.

On November 22, 1994, Ms. Kerry Becker of the Division of
Environmental Management inspected your gasohol distillation
isoperation for the purpose of determining whether or not this
operation would be subject to N. C. General Statute 143-215.1.
This statute states that no person will be allowed to discharge
wastes either upon the land or into state waters without first
obtaining a permit from this Division. Based upon results of
effluent samples collected on October 13, 1994, by the Alcohol
Law Enforcement Agency and upon observations made by Ms. Becker
during the November 22 inspection, your distillery is indeed in
violation of this statute and could lead to the initiation of
enforcement proceedings against you.
It would be impractical to consider treatment of the
discharge due to initial capital costs for construction and costs
due to operation. If the Transylvania County Health Department
cannot approve a disposal method, your only recourse may be to
haul the mash residue to a nearby municipal wastewater treatment
plant. Care should be taken, however, that this waste does not
cause the receiving wastewater treatment plant to violate its
NPDES permit. Permission must be obtained from the municipality
before this waste can be discharged to the treatment plant. The
municipality may require some form of pretreatment before
accepting this waste. The wastewater from the distillery is
characterized by low pH, excessive concentrations of total -and
suspended residue, and most significantly an extremely strong

The Division of Environmental Management inspected three
gasohol distilleries on November 22, 1994, to evaluate whether or
not the distilleries would be subject to N. C. General Statute
143-215.1. This statute states that no person will be allowed to
discharge wastes either upon the land or into state waters
without first obtaining a permit from the Division. Based upon
results of effluent samples collected on October 13, 1994, and
upon observations made during the inspections, these distilleries
would indeed be subject to this statute.
Analyses of samples collected of the discharges from the
distilleries owned by George McCall and Thomas Dodson indicate
wastewaters characterized by low pH, excessive concentrations of
total and suspended residue, and most significantly an extremely
strong oxygen demand. In addition, lead analysis of the McCall
discharge showed a concentration of 141.2 ppb; by comparison, the
water quality standard for lead is 25 ppb. In addition, if there
are concerns that the alcohol generated from these distilleries
is sold for human consumption, you should be aware that the
drinking water standard for lead is 15 ppb. Concentrations in
excess of this standard could cause acute and/or chronic health
problems.
A Notice of Violation (NOV) will be sent to each of the
distilleries regarding their discharge. Those owners present
during the inspection have already been informed that the .
discharges are a violation of N. C. General Statute 143-215.1 and
that they are, as a result, subject to enforcement proceedings
especially if any future discharges occur.

It would not be practical for any of the distilleries to
install a wastewater treatment plant much less operate one.
Unless the Transylvania County Health Department can assist the
distillers with either an approval of an on -site disposal system
or approval for disposal by a septage hauler on a permitted site,
the only other recourse may be disposal at a municipal wastewater
treatment plant. Care should be taken, however, with this last
alternative. Because of the extremely strong oxygen demand
characteristic of this wastewater, large quantities of this could
upset the wastewater treatment plant and could cause it to
violate its NPDES permit. Permission must be obtained from the
municipality before this waste can be accepted. The municipality
may require some form of pretreatment before accepting it. The
distillers will be asked to respond to the NOV and to submit
what, if any, actions will be taken to eliminate the discharge.
