Loflin Dairy Phase II Bank Parcel Credit Release — Task 3
Dear Mr. Wilkerson:
On April 20, 2020, the Division of Water Resources (DWR) received an As -Built Report from
Wildlands Holdings V, LLC (Wildlands) for the Loflin Dairy Phase II site. According to the As -
Built survey submitted with the As -Built Report, there are slight adjustments in the total amounts of
buffer mitigation credits as compared to the approved Bank Parcel Development Package (BPDP).
The subject site has generated 366,883 ft2 of buffer mitigation credits. The credits being released
have been modified to reflect any changes to the creditable acreage as proposed in the BPDP.
By copy of this correspondence, DWR acknowledges that the performance bond (#107063169)
issued to Wildlands in the amount of $150,000 to cover performance obligations for the construction
of the subject site is no longer needed.
DWR received a performance bond (#107182450) in the amount of $100,000 issued to Wildlands
from Travelers Casualty and Surety Company of America, to cover monitoring and maintenance at
the subject site. The term of this bond applies beginning April 15, 2020 and with the approval of the
Year 1 Monitoring Report by DWR. Future credit releases will be dependent on both the renewal of
this performance bond and the annual monitoring reports.
In accordance with the MBI, signed on April 23,2019 the following Project Milestones have been
met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced site and therefore, 10% of your Randleman buffer Restoration, Enhancement
and Preservation credits (0.10 x 366,883 ft2 = 36,688.30 ft2) plus 2,482.48 ft2 yields 39,170.78 ft2
now available to sell.

Watershed according to guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B
.0295, which became effective on November 1, 2015.
