Page: 9 1 i I� -J TOWN OF RUTHERFORD COLLEGE NORTH CAROLINA COMMUNICATION ASSESSMENT And SPILL RESPONSE PROCEDURE PREPARED BY: COLLECTIONS ORC RUTHERFORD COLLEGE, NORTH CAROLINA PURPOSE: This plan is to be implemented in the event of a Sanitary Sewer Overflow, (SSO) or spill within the Collection System. The plan was developed to insure the key personnel response to ever spill event within sixty (60) minutes of a reported event. INITIAL RESPONSE: Spills reported to or detected by collection system personnel require immediate attention. The Collection System ORC or his appointed Back-up Operator will make the preliminary assessment of the spill within 15 minutes after receiving report. That assessment includes visiting the spill site. The ORC or Back-up will determine the appropriate response and request assistance from key personnel as necessary. The attached call back list will be maintained current and be ranked according to essential response including, i.e. equipment operators. Local contractor may be employed as deemed necessary. Key personnel will, upon assessing the site, continue to document the event and determine the severity, magnitude, and potential environmental impact. Ever effort should be made to minimize the spill event consistent with the containment and source control section of this plan. The safety of the response dent should in no way be compromised. Key personnel should implement recovery actions to eliminate the cause of obstruction and/or system failure as outlined in this plan. POST SPILL RESPONSE, (REPORTING): After containment is achieved, the Division of Water Quality, (DWQ) must be contacted as soon as possible but, in no case later than 24 hours after initial detection if, 1) The spill has reached surface waters, "Waters of the State"or 2) The spill exceeds one thousand gallons, (1,000 gals.) Every small spill must be logged on site including time,date, approximate volume, name of respondent. Spills that are fully contained and removed quickly and are less than one thousand gallons are not required to be reported to DWQ. Pump clean up materials and wash water into sanitary sewer. IN A CREEK OR STREAM 1. Take conductivity readings of the creek upstream and downstream to determine were temporary dam should be placed. 2. The dam should be constructed near a manhole which is accessible to the jet rodder and vacuum truck. 3. Dam should be placed below the spill as indicated by low conductivity reading. 4. Construct a dam sized to contain the flow of water plus any flush water added during clean up. 5. Station to pumps at clean up site, one to use one for back- up. 6. Have a back hoe at the site for dam repairs as needed. 7. Wash down all rip rap in stream bed until no residue is evident. 8. Put up warning tap "DANGER DO NOT ENTER". At spill site and 400 feet down stream. 9. Pull stream samples for fecal coliform. Upstream and Downstream. 10. Repeat sampling until normal, background counts 500 cts/100 MI. 11. If settled sludge evident sweep bottom until clean. 12. If creek or stream is recreational water notify the affected community and local officials as soon as the problem is discovered. During this time, staff checks wet wells, evaluates pump run times, ensures that the mission control dialer is operational and test both pumps to make sure that they are operating efficiently - Walk and inspect the force main twice a year because of the parallel gravity line next to it. The age of the infrastructure makes it's bi-annual assessment high priority During the time of this SSO, Utility staff ensured that the spill was completely contained. A pump truck kept the wet well empty and professional contractors abated all contaminated soil and covered it with hydrated lime. Staff secured the site by installing a fence and excavated the area with grass seed and straw. The Town was incorporated in 1977 and built it's first sewers in the 1980s. Part of the Town is sewered by Burke County and part is sewered by the Town of Valdese (Valdese Hospital). In early winter Max Presswood mows the right-of-way. Approximately half of righr-of-way requires mowing.Any problems observed are reported. The Town has a good collection system map and a spill response plan. The Town has no high priority lines.The Town will get into the Grease Control Program business probably by placing short notices regarding proper disposal of cooking grease on the water/sewer bill. Since a wide-spread power outage would likely be the incident triggering the need for back up power, Regional Staff quesiton the Town of Rutherford College' s ability to deploy one generator to effectively serve three pump stations. An ice storm would be a likely cause of a wide-spread power outage in the Rutherford College area. Such a storm (resulting in slippery road conditions) would likely make effective use of a portable generator nearly impossible in servicing 3 pump stations. Providing adequate back up power in the above described scenario would be especially difficult for a small town with limited personnel and vehicular resources. Another concern in approving a portable generator is that two of the three pump stations drain to WS IV & B CA waters. DWQ must receive adequate information to insure that "sufficient numbers of standby generators and personnel for distribution" exist in. Rutherford College, or DWQ must require that the applicant provide onsite standby power for the pump stations. . C . Summary, Conclusion, Recommendation The Town of Rutherford College is currently in need of a Town-wide sanitary sewer system. This is needed so that current septic and drain field problems can be eliminated. These prob- lems are a health problem to the land owner and to the community. To proceed with a project to solve these problems is expen- sive using current cost. It is important for the Town to pro- ceed; however , so the future problems do not arise to further deteriorate the area. As outlined below, the Town is located in terrain which is not acceptable for all methods of treating and transporting wastewater. The Town is located in Burke County in the foothills of western North Carolina. A total of six ( 6 ) alternatives were reviewed in the discussion below. These included doing nothing , optimum opera- tion of the existing system, land application, repair and/or replacement of existing septic/drain fields , installing a septic tank effluent pump system and a gravity sanitary sewer system. Since the Town of Valdese Lake Rhodhiss Wastewater Treatment Facility is a regional facility and as shown in the Burke County Complex 201 Facilities Plan, the Town of Rutherford College is to have its wastewater treated at this regional facility, treatment of wastewater is not the primary issue. The issue is to ade- quately and economically transport wastewater to the regional facility. R From the cost estimates and discussion, the most efficient method is by using, a gravity sanitary sewer system with limited pumping stations as may be required by the terrain. Therefore , it is concluded that the gravity method be used to transport the wastewater to the Town of Valdese regional wastewater treatment facility. It is recommended that the Town of Rutherford College apply for a grant and loans to construct the gravity sanitary sewer alternative . The average bill is excessive using loans ; grants will be necessary to make the average bill affordable. B. Current Situation Current System and Wastewater Plant Description: The Town of Rutherford College is located in Service Area #25 as outlined in the 201 Facilities Planning Study Burke County Complex - July, 1974 . There is currently the Island Creek pump station owned and operated by Burke County, a segment of force main and gravity line to the Town of Valdese outfall . Also, the Town of Rutherford College has a small number of collection lines which tie into the Burke County or Town of Valdese outfalls . The Town does not have a wastewater treatment facility. The Town and Burke County both flow wastewater to the Lake Rhodhiss Wastewater Treatment Facility, owned and operated by the Town of Valdese. Population and Demographics : The Town of Rutherford College has a population of 1 , 126 as per the 1990 Population data (WPCOG) . As stated earlier, the area is located in Service Area #25 of the Burke County 201 Complex. The Population Projections from Appendix C of the 201 Plan states that the 1970 Population for the entire area was 1 , 102 ; the 1995 Population was projected to be 1 , 324 , and for Effluent Limitations/NPDES Permit Status : The Town of Rutherford College does not have a wastewater treatment facility; therefore, the NPDES Permit will be through the Town of Valdese Lake Rhodhiss Wastewater Treatment Facility located on the Catawba River. Currently, the Town of Valdese is continuing to meet its permit limits as currently permitted. The Town of Rutherford College and the Town of Valdese have an existing agreement for the treatment of wastewater through percent purchase of volume at the wastewater plant. D. Alternatives 1 . No Action: The Town could do nothing to improve the waste- water problems in the community. To do this would result in there continuing to be wastewater septic system problems . This results in ground water and surface water contamination. Also , there is the potential for health problems resulting in doing nothing to help solve the existing problem. Because the Town is located in the foothills area of North Carolina, the Town has two ( 2 ) significant problems with septic systems . Generally, the terrain is hilly and not conducive to septic drain field layouts . Also, the ground is very rocky and in cases , solid rock. Even using innovative drain field systems, the waste loading cannot be adequately addressed. Therefore, to take no action is to continue with the same potential problems. This is not an acceptable alternative. 2 . Optimum Operation of Existing Facilities : This actually is occurring in the limited facilities the Town has to date. The sanitary sewer lines available are being used to their optimum. Since the existing facilities are only one-tenth ( 1/10 ) of total needs , the total problem is not being addressed. Also, since the existing facilities are gravity sewer lines , operation is limited to the areas which can drain into the existing lines . This is not a realistic alternative . 3 . Land Application: The same problem which currently exists with the current septic systems--rock and terrain--is ever more restrictive in land application. Also , being bound by the Town of Valdese to the west, Town of Connelly Springs- to the east , Catawba River to the north, and Mineral Springs Mountains to the south, firmly limits the availability of land for use as land application even if the rock and terrain were not existing . This is not an acceptable alternative . Moreover, the treatment of wastewater can be adequately addressed by the existing regional wastewater treatment facility. Also, the wastewater would need to be pumped under the Catawba River to available land areas . Because of the pumping, added force main, land cost and other added costs being compared to the treatment cost at an existing regional wastewater treatment facility, the cost of land application would be an added cost for the project . 4 . Existing Septic Tank/Drain Field Improvement : An alternative would be to repair each septic tank, drain field and other appurtenances as may be required to help alleviate existing problems . This would include new septic tanks , repair each drain line or extend where possible into a new drain field area. Installing innovative drain line methods where possi- ble and as needed. This alternative will be limited due to terrain and rock as described above and in areas where drain fields are not totally saturated and existing repair areas are available . Assuming the units can be repaired, the cost of repair and improvement would be $3 , 525 , 000 . The cost is outlined in the attached cost estimates . 5 . Installing Septic Tank Effluent Pumps and a Low Pressure System: This would include installing a new septic/pump tank at each location. Install a grinder pump with controls , force main to the street and the low pressure lines . This would also include area sewer pump stations . The total cost of this alternative is estimated to be $3 , 304 , 800 as outlined in the attached cost estimate . This alternative also would have a maintenance and operation cost which would be in addition to capital cost. 6 . Installing a Gravity Sanitary Sewer Collection System: This would include installation of gravity collection lines to each service area with the Town . There would be requirement for five ( 5 ) pump stations due to the terrain of the area. The estimated cost of construction will be $3 , 105 , 600 . With this system, operation and maintenance will have a cost which is addressed in the present worth analysis . a. Sludge Disposal : Using the Valdese Wastewater Treatment Facility, sludge would continue to be handled as is currently permitted at the plant . b. Flow Design : The flow will not exceed that allowable for an 8" sanitary sewer at 4 CFS . C. Mitigative measures ATTACHMENTS MAPS 1. Existing Environment The Town of Rutherford College is a small town which is located in Burke County. The Town is north of Interstate 40, east of the Town of Valdese and south of the Catawba River and Lake Rhodhiss. U.S. Highway 70 runs through the center of town along with the Norfolk-Southern Railroad. The total population of the Town according to the 1990 census is 1,126. All of the population of the town is considered rural. The median household income is $22,700 while the median family income is $30,769. The project area is the entire town of Rutherford College. This area is located in the Piedmont area of North Carolina. The geology of the area is composed of metamorphic rocks of the inner piedmont. The area is also part of the Milton belt which consists of gneiss, schist, and amphibolite. The topography in the project area and town consists of rolling terrain. The small area of the Town north of I-40 is the highest point at 13911 . The lowest point is north of Hwy. 70 near Lake Rhodhiss and the Catawba River where the elevation is 11501 . The soils in the area are in two associations. The Cecil Association is predominent occurring in the center of town. These soils are well drained, deep soils with firm clay subsoils on broad ridges and fairly short sloping to moderately steep side slopes; on uplands. The other dominant association is Pacolet-Cecil. These soils occur along the north, west and south edges of the project area. They are well drained, moderately deep and deep soils with firm to friable clay to clay loam subsoils on fairly narrow ridges and choppy sloping to steep side slopes; on uplands. The major surface water streams in the project area are Hoyle Creek at the western edge of the project area and Island Creek at the eastern edge of the project area. Both of these streams form in the Mineral Springs Mountain area south of I-40 and drain north to Lake Rhodhiss and the Catawba River. These are small class C streams. The entire Town drains to the Catawba River and Lake Rhodhiss. There has not been any monitoring conducted on either of these streams by NCDEM. Municipal water service is available to all citizens of the Town. This is supplied the Rutherford College Water Corporation which purchases their water from the Town of Valdese. No groundwater is used for municipal water supply. Land use throughout the project area is varied. The dominant land use is residential. Approximately 80% of the Town is zoned residential. The largest area of residential is north of Hwy. 70. A small portion of land north of Hwy. 70 is part of the Town of Valdese. This satellite annexation was done to include Valdese General Hospital in the Town of Valdese. Most of the industrial development has occurred along I-40, Connely Springs Road and Hwy. 70. The industrial development consists of textile manufacturing. A very small portion of the Town is served by sewer. This consists of the area near Valdese General Hospital . The remainder of the Town is on septic systems. The entire project area is included in the zoning and land development plans of the Town of Rutherford College. 2. Need The Town of Rutherford College has very little sewer service in the Town. The small area that is sewered around Valdese General Hospital does not include any of the residents in the town. Many of the houses in the Town are 20 years or older and since all are on septic tanks, failure is occurring. With the close proximity to Lake Rhodhiss and the Catawba River, this could pose a threat to the water quality by increasing fecal coliform readings. The Town currently has limited industrial and commercial growth due to the lack of sewer service. To attract more industry, the Town needs sewer service. Since providing sewer service to the entire town will be very expensive and with a limited number of users, the cost per user for sewer service will be very high. Without some type of assistance from the State or Federal government, Rutherford College will not be able to provide sewer service to its citizens. 3. Alternative Analysis 1. The existing lines feed into the Town of Valdese sewer system where it is ultimately treated at the Valdese WWTP on Lake Rhodhiss. Each major line segment is identified on an 8 1/2 x 11 map which can be found along with an index at the end of this report. 1. Line segment (1) (Map #1) begins at a proposed sanitary sewer pump station and is an 8" line. The proposed 8" sanitary sewer is 2,450 LF and goes through forest and grass land into the existing residential area. 2. Line segment (2) (Map #2) begins at a proposed sanitary sewer pump station which also picks up flow from line segment (1) . The gravity sanitary sewer line into the pump station is an 8" line which extends 3,200 LF through forest land into the existing residential area to be served. 3 . Line segment (3) (Map #3) begins at a pump station along Island Creek. There are two outfalls entering the pump station. The outfall to the west is an 8" line extending 2,400 LF to SR 1600. This line extends through forest and pasture land. The second outfall to the south extends 5,650 LF along Island Creek and through forest land into the existing residential area. 4. Line segment (4) (Map #4) begins at the existing outfall and extends 3 ,250 LF along an existing creek and forest land to Lovelady Road. This 8" sanitary sewer line extends into existing residential areas. 5. Line segment (5) (Map #5) begins at an existing outfall and along an existing street 2, 300 LF into a residential area. This line is an 8" sanitary sewer line. 6. Line segment (6) (Map #6) begins at an existing outfall and along an existing street. The 8" sanitary sewer line extends 800 LF into an existing residential area. 7. Line segment (7) (Map #7) extends 1,900 LF from an existing outfall through existing residential areas. The 8" sanitary sewer line will follow an existing draw through the existing subdivision. S. Line segment (8) (Map #8) extends 900 LF from an existing outfall along the rear property lines of the existing subdivision. The 8" sanitary sewer line extends through a forest and lawn area. 9 . Line segment (9) (Map #9) extends from an existing outfall through an existing residential area. The 8" sanitary sewer line extends 1,100 LF along rear yard areas. 10. Line segment (10) Map #10) extends 750 LF along West Street into the existing residential area. The 8" sanitary sewer line extends along the right-of-way of West Street. 11. Line segment (11) (Map #11) is a proposed 8" sanitary sewer off an existing outfall and extends 250 LF along SR 1001 in the business area. 12. Line segment (12) (Map #12) extends 1,650 LF along SR 1001 into the business area. The 8" sewer line extends from an existing outfall. 13. Line segment (13) (Map #13) extends along Island Creek through forest areas. The 8" sewer line extends 3 ,350 LF from a proposed pump station and picks up two major residential areas. The area is all residential in this portion of Town. 14 . Line segment (14) (Map #14) is an 8" line extending off an existing outfall 950 LF in the business district. The line extends into the residential areas to the south. 15. Line segment (15) (Map #15) extends 750 LF along the business district. The 8" sewer line extends from the existing outfall into the business area. 16 . Line segment (16) (Map #16) extends 650 LF from an existing outfall through a forested area to the existing residential area. The 8" sewer line extends along property lines. 17. Line segment (17) (Map #17) extends 700 LF along Hilltop Street from the existing outfall . The 8" sanitary sewer line extends from a residential area into the business district. 18 . Line segment (18) (Map #18) extends 1,200 LF from the existing outfall through the residential area. The 8" sewer line follows an existing draw and property lines to SR 1001. 19. Line segment (19) (Map #19) extends from an existing outfall along the right-of-way of US 70. The 8" line extends 1,790 LF through commercial areas. 20. Line segment (20) (Map #20) extends from an existing outfall through forest, lawn, and across a small creek into the existing residential area. The 8" sewer line extends 950 LF. 21. Line segment (21) (Map #21) extends from an existing outfall along the right-of-way of US 70 in a commercial and residential area. The 8" sewerline extends 400 LF. 22. Line segment (22) (Map #22) extends from an existing outfall along a creek which is forest-grass land; then, along existing street right-of-way into a residential area. The 8" sewer line extends 4 ,100 LF. (a) Changes in land The proposed sewer project in the Town will not have an immediate effect on land or land use. The lines and the small pump stations will not have an adverse visual effect. A secondary impact of the proposed project will be to change undeveloped areas into developable areas because of the availability of sewer. This future development will be made possible because of the sewer lines. All development will be in accordance with existing zoning ordinances. (b) Wetlands and Floodplains A review of National Flood Insurance Program, Flood Insurance Rate Maps for the Town of Rutherford College show no floodplains in the proposed project area. A wetlands delineation has been conducted by Steve Chapin of the U.S. Army Corps of Engineers. Mr. Chapin walked project area where construction activities from the proposed lines and pump stations will occur. Mr. Chapin found one small area located on map #3 in the northeast quadrant of town. A total of less than 0.1 acre of wetlands is located in the project area. A 404 nationwide permit application as well as a 401 general certification application has been submitted (see attachment A) . (c) Prime or unique agricultural lands There are no prime or unique agricultural lands located in the Town or project area. Undeveloped areas tend to be forested or open fields. Indirect effects on the above areas my occur from future development since the project area will see growth over the next twenty years. (d) Public lands such as parks (state, federal or local) The proposed elements of the project will not affect public lands such as parks since there are not any located in the project area. (e) Scenic and recreational areas The proposed project will not affect any of the above areas since there are not any in the project area. (f) Areas of Archeological or historical value A preliminary review of the overall project map by the State Historic Preservation Office found no properties of architectural, historic, or archeological significance which would be affected by the project (see attachment B) . (g) Air quality There may be a slight increase in the particulate level during construction. This will occur from the use of heavy construction equipment. However, this will abate upon completion of the project. No large amounts of emissions, including particulate matter, smoke or steam will be generated by facility operations. Therefore, no special control measures or permits are required. (h) Groundwater quality There will be beneficial impacts on groundwater quality because of the elimination of failing septic tanks. No adverse effects are anticipated for any of the elements of the proposed project. (i) Nuisance conditions (i.e. odor, noise, etc. ) There may be a slight increase in noise levels during the construction phase of the project. This will be temporary and will stop upon completion of the project. The slight increase in noise levels will occur during day time construction hours. Motors used at pump stations will be put in enclosures to minimize noise generated by plant operation. (j) Shellfish or fish and their habitats A preliminary review of the overall project map by NC Wildlife Resources Commission was made in August and September. Stephanie Goudrieu, Mountain Region Coordinator for Habitat Conservation Program responded that the project would have minimal impacts on fisheries and wildlife in the project area (see attachment C) . With the submission of the 404 Nationwide Permit previously discussed under Wetlands, this agency and others may comment further on the project. (k) Wildlife and their habitats 1 . This project as previously described will install sewer lines throughout the Town. Many of these will be along DOT right-of-ways and in developed areas. A more detailed description of the line work can be found under proposed lines and habitat. 2. The 22 project maps in the attachments clearly show the specific areas to be affected by the action. 3 . Overall project maps were sent to the Natural Heritage Program and NC Wildlife Resources Commission for their comments. The Natural Heritage Program responded conducted a review and sent back a list of all rare species that occur in Burke County. 4. As previously mentioned, the NC Heritage Program has no record of known rare species, high quality natural communities or significant natural areas occurring in the project area. However, they did enclose a listing of rare species in Burke County (see attachment D) . 5. The direct effects on species and habitat could mean in some cases temporary disturbance. However, no rare species have been recorded in the project area. Indirect and cumulative effects could occur as a result of sewer service being available in undeveloped areas and these areas being developed over a period of time. 6. If Species and critical habitat would exist in the project area they could be effected during the construction phase of the project by moving heavy equipment over land, land disturbing activities and increased noise. The NC Wildlife Resources Commission has recommended 8 guidelines to minimize impacts to fisheries and wildlife (see attachment C) . 7. The evaluation criteria consists of preliminary comments by the NC Wildlife Resources Commission and the Natural Heritage Program. These two agencies reviewed available literature and studies on the area. The NC Wildlife Resources Commission felt that the project would have only a minimal effect on fisheries and wildlife resources in the project area. 8 . From the comments by the NC Wildlife Resources Commission and Natural Heritage Program, it can be determined that there will be a minimal effect to wildlife and habitat in the project area. Much of the proposed line work will occur on previously disturbed land and Right-of-ways. (m) Introduction of Toxic substances There will not be any toxic substances introduced on this project. j; / (n) Impacts on receiving waters During the construction phase of the project, ground will be disturbed which will result in soil erosion. To minimize this, the Town will adopt a sedimentation plan as required by the law since more than 1 acre will be disturbed. The WWTP in Valdese will not be effected by the waste it will receive from the project. The quality of the water leaving the plant will not be effected by this project. (o) Indirect impacts Indirect impacts could result in undeveloped land being developed after the project is completed. This could happen since the availability of sewer will make the land more attractive for development. 5. Mitigative Measures Construction of the proposed project will cause some environmental impacts that cannot be avoided. However, use of appropriate control measures and good construction practices will minimize adverse effects. These impacts during the construction activity include: 1) Air pollution will occur from dust and engine exhaust 2 ) Some soil erosion will occur. The mitigation measures designed into this project are as follows: 1) Implementation of temporary and permanent anti-erosion and sedimentation control measures. 2) Sprinkling of dusty areas during construction to control dust. 3) Land disturbance will be limited to areas required for construction and operation. To protect fish and wildlife, the guidelines suggested in the attachment from NC Wildlife Resources Commission will be followed. In addition, there will be further guidelines that must be followed as part of the 404 and 401 certifications. Project sponsors propose to install sewer lines in town and construct four small pump stations. Many of the sewer lines will be placed along North Carolina Department of Transportation rights-of-way. No streams supporting trout will be impacted by the project. The U.S. Army Corps of Engineers has been contacted for a wetland delineation of the project area. Based on information provided and my knowledge of the area, this project will likely have only minimal impacts to fisheries and wildlife resources in the project area. However, we may provide additional comments regarding impacts to streams and wetlands if a Section 404 Permit is required under the Clean Water Act. For your general information, our guidelines for installing sewer lines to minimize impacts to fisheries and wildlife are as follows: 1) A 50-foot undisturbed vegetated buffer zone should be left between streams (except at crossings) and construction activities. This will minimize sedimentation into streams, preserve riparian vegetation that stabilizes stream banks, and maintain a travel corridor for wildlife. 2) In areas where existing development and/or topography prevent leaving at least a 25-foot undisturbed buffer zone, Mr. Samuel W. Erwin Page 2 August 29, 1994 extra sedimentation control measures should be placed between streams and construction activities.' These might include silt fencing in front of hay bales or brush piles. 3) Stream crossings should be made perpendicular to streams where possible to minimize impacts to riparian vegetation. Sewer lines should also be buried in the substrate at stream crossings or attached to bridges so that fish passage is not blocked and debris does not collect. Abandoned sewer lines should be removed where they cross streams. 4) If sewer lines will be encased in concrete at crossings, this must be accomplished so that wet concrete does not contact live stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 5) Excavated material should be stockpiled away from streams. 6) Riparian vegetation, especially trees, should be preserved as much as possible at stream crossings. Trees that must be removed should be cut near ground level, leaving the stump and roots in the bank for stability and to possibly sprout. 7) Natural materials should be used as much as possible to restore stream banks at crossings. Riprap should be limited to the stream bank below the high water mark, and vegetation should be used for stabilization above high water. 8) Permanent herbaceous vegetation in disturbed areas should be planted within 15 days of ground disturbing activities to provide long term erosion control. Construction of the sewers, pump station(s) and force main shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 1 7. Upon completion of c nstruction and prior to operation of thi permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. 9. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management,in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 10. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 11. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 13. This permit shall become voidable unless the agreement between the Town of Rutherford College and the Town of Valdese for the collection and final treatment of wastewater is in full force and effect.
