Location description: The project area is located on Wynne Fork Road(SR 1338)approximately 0.32 miles west of the
intersection with US 17 approximately 1.25 miles south of the town of Hertford in Perquimans County,North Carolina.
Description of projects area and activity: The project involves the replacement of an existing 4 span 150'long X 26.5'wide
bridge with a 3 span 160'long X 30'wide bridge.The bridge approach will be widened requiring 0.03ac of permanent wetland
fill,0.03 ac of wetland excavation and 0.16 ac of temporary impacts to Racoon Creek associated with two phases of sheet piling
and dewatering during the installation.Utilities existing within the ROW will be relocated to approved bore areas.

1. ® There are waters,including wetlands, on the above described project area that may be subject to Section 404 of the Clean
Water Act(CWA)(33 USC § 1344)and/or Section 10 of the Rivers and Harbors Act(RHA)(33 USC§403). This preliminary
determination is not an appealable action under the Regulatory Program Administrative Appeal Process(Reference 33 CFR Part

SPECIAL CONDITIONS
A. The regional condition for NWP 3 excludes the use of this permit for discharges into Waters of the
United States designated by either the North Carolina Division of Marine Fisheries (NCDMF) or the
North Carolina Wildlife Resources Commission(NCWRC) as anadromous fish spawning areas
during the prohibited period of February 15 and June 30. This project shall adhere to that
moratorium.
B. The applicant shall maintain adequate flow and circulation of waters of Racoon Creek within the
project area and not restrict flow during high rain events.
