Dear Mr. Bryan:
You have our approval, in accordance with the attached conditions and those listed below, to impact 40
linear feet of an unnamed tributary to the Middle Fork of Little Ivy Creek in order to improve SR 1516
(Eldridge Hill Road) in Madison County. The project must be constructed in accordance with your
application dated April 10, 2003 (received April 15, 2003), including the environmental commitments
made in the application letter. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification No. 3404, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits
before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying
404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and submit a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below. M
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and adhere to Design Guidelines for Sensitive Watersheds [15A NCAC 4B .0124;

prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources. The
Middle Fork Little Ivy Creek is classified as WS-II High Quality Waters. Temporary or permanent
herbaceous vegetation shall be planted on all bare soil within 10 days ofground-disturbing activities
to provide long term erosion control.
2. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
3. Stormwater should be directed to vegetated buffer areas, grass lined ditches or retention basins and
must not be routed directly into streams. Mowing of existing vegetated buffers is strongly
discouraged, so that they may be utilized for stormwater sheet flow.
4. The culverts shall be designed and installed to allow for fish and other wildlife movement as well as
prevent headcutting of the streams..

5. NCDOT must submit a plan for written DWQ approval to address any headcutting that will occur as a
result of this project.
6. Use of riprap for bank stabilization is to be minimized; rather, native vegetation is to be planted when
practical. If riprap is necessary, it must be limited to the stream bank above the high water mark.
Riprap shall not be placed in the stream bottom.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
8. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
9. The presence of equipment in the channels must be minimized. Under no circumstances must rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
10. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the 401/Wetlands
Unit of the NC Division of Water Quality upon completion of the project. NCDOT is strongly
advised to send in photographs upstream and downstream of each structure to document correct
installation.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Lund:
I have enclosed a straight-line diagram with erosion control plan, a PCN application for
NW? #14, and a vicinity map relative to the proposed project on SR 1516, Eldridge Hill
Road, Madison County, NC.
Eldridge Hill is currently a 12-14 feet wide gravel road. Division of Highways plans to
pave the road 18 feet wide and increase the typical section. Grading will be light.
We propose to extend one existing culvert on an UT to Middle Fork Creek. Total culvert
extension will be 40 feet. Existing channel morphology will be maintained upstream and
downstream of the culvert. The culvert will be placed below existing streambed
elevation. Riparian vegetation will be reestablished along disturbed areas associated with
the culvert extension. Stormwater will be diverted through grass-lined ditches or
vegetated buffers prior to entering streams.
No stream relocation will be performed for the project. In situations where a stream
parallels the existing roadway, best management practices adopted by DOT require that
the proposed widening occur on the side opposite the stream. To the extent practical, the
shoulder adjacent to the stream will also be widened to, increase the vegetated buffer area
between the roadway and streams. In addition, erosion control measures for sensitive
areas will be installed, including silt fence and a diversion berm.

No significant effect on federally listed species (threatened or endangered) or their
habitats is anticipated.

Commission Mountain Region Coordinator, to comment directly to the Corps concerning
the permit request.
By copy of this letter, we are asking Ed Ingle, Area Roadside Field Operations Engineer,
to comment on the above project. Temporary encroachment into the buffer zone of the
UT will be required. The stream is not classified as trout. A buffer variance will not be
required. The stream is within a WS-II water supply watershed.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing secondary road must be improved to meet current safety standards for paved
roads. The culvert extension requested is the minimum necessary to establish an appropriate
typical section for the roadway. Riparian vegetation will be established on disturbed areas
associated with the project construction.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http:/ih-o.enr.state.nc.us/ncwetlands/strm.aide.html.

Describe impervious acreage (both existing and proposed) versus total acreage on the site.
Discuss stormwater controls proposed in order to protect surface waters and wetlands

The existing compacted gravel roadway acts as an impervious surface. Paving of the roadway
should eliminate sedimentation from fines associated with gravel surface treatment. The
roadway surface will be 40% of right of way acreage. Stormwater will be diverted through
settling basins or grass lined buffers prior to entering the streams.

It is the applicant's responsibility to submit the application sufficiently in advance of desired
construction dates to allow processing time for these permits. However, an applicant may
choose to list constraints associated with construction or sequencing that may impose limits on
work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and
Threatened Species, accessibility problems, or other issues outside of the applicant's control).
With regard to hazardous spill basins, the road is not classified as an arterial route, therefore
hazardous spill basins are not required.

Silt fences and temporary silt ditches shall be installed after clearing and
before grading.
Temporary stone ditch checks shall be installed as soon as ditch-line is
established.
Pipe outlet and inlet protection will be done as soon as the pipe is installed.
Silt basins (Type B) will be constructed to the dimension of nine feet by
three feet by two feet unless otherwise noted on plans. (See SB-9 on
dimension sheet)
Seeding and other permanent erosion control measures are to be
implemented as soon as practical.
Temporary rock silt checks (Type B) will be spaced as required by percent
of grade.

PIPE INSTALLATION NOTES
1) Install erosion control devices. In streams, where necessary, rock silt
screens will be used.
2) Remove material and existing pipe while limiting, as much as possible,
material and sediment from entering the stream and/or escaping from the
project.
3) Prepare pipe foundation while again taking care to limit, as much as
possible, material and sediment from entering the stream and/or escaping
from the project. Where possible, new grade will be below the existing
streambed. If needed, bedding material will be clean stone.
4) Place the new pipe and compact backfill.
5) Install slope protection on outlet and inlet ends of pipe. Also complete
installation of erosion control measures and perform maintenance as
needed on existing measures.
6) Establish permanent vegetation as soon as possible.

PIPE OUTLET ENERGY DISSIPATOR: •
A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS:
• Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type II filter
fabric.

TEMPORARY SILT DITCH:
- TSD -
A temporary silt ditch shall be used in place of silt fence in many situations.
Temporary silt ditches shall be used at the toe of fill slopes to divert mnoff into
sediment basins, temporary rock sediment dams, temporary rock silt-checks and/or-
other sedimentation control measures. Temporary silt ditches are approximately 1
ft: deep, 2:1 side slopes with an optional earth berm.
AREAS of USE:
• Toe of fill slopes where fill exceeds 3 ft in vertical height.
• Along streams to intercept flow and/or divert to a controlled outlet.

TEMPORARY SILT FENCE:
A temporary silt fence is commonly used at the toe of a fill section to prevent off-
site sedimentation. It is made of permeable filter fabric buried at the bottom;
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining the sediment. They may also be used to divert water flow to protected
outlets.. Silt fences need to be. checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall not be
installed across streams, ditches, or waterways.
AREAS OF USE:
• At toe of fill sections where sediment runoff can be stored and contained
inside the project limits.
