WATER OUAUTY SECTION
You have our approval, in accordance with the attached conditions and those listed below, to impact 235 linear feet
of an unnamed tributary to Richland Creek (100 linear feet of new pipe and 135 linear feet of stream restoration) in
order to construct a Salt Storage Facility at the DOT Maintenance Yard in Haywood County. The NC Division of
Water Quality understands that this project constructed in accordance with your after the fact application dated
October 28, 2003 (received October 31, 2003). Staff of the NC Division of Water Quality reviewed the repair work
on October 9, 2003, and is satisfied with the stream restoration and bank stabilization.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Nos. 3399 and 3402, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Numbers 27 and 39. In
addition, you must acquire any other federal, state or local permits before you proceed with your project including
(but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This
approval will expire with the accompanying 404 Permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified below).
Should your project change, you must notify the DWQ in writing and submit a new application. If the property is
sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for
complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of
total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as
described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions
listed in the attached certification and anv additional conditions listed below.
1. NCDOT shall monitor this site for a period of one year from the date of issuance of this document to ensure that
bank stabilization and stream restoration procedures are working properly.
2. If NCDWQ determines that the bank stabilization area has become unstable, NCDOT will be required to stabilize
this area. Should repairs be necessary, NCDOT must submit all repair designs to and receive approval from the
Division of Water Quality before the repair work is performed.
3. Riparian vegetation must be reestablished within the construction limits of the project by the end of the
growing season following completion of construction.
4. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of Completion"
form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible
party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water
Quality upon completion of the project. NCDOT is strongly advised to send in photographs upstream and
downstream of each structure to document correct installation.

ask for a hearing.

Dear Mr. Lund:
The North Carolina Department of Transportation (NCDOT) is applying for a Nationwide
After-the-Fact permit for the grading and draining of a new salt storage facility adjacent to the
Haywood County Maintenance Yard. NCDOT had purchased the subject property in June of
1996 (Deedbook 453 Page 1708). Shortly thereafter, approximately 100 linear feet of 10-inch
perforated corrugated metal pipe was placed in a draw to allow for the site to be filled. At that
time, no "live water" was observed on the site. NCDOT used the site as a waste pit from 1996
until the present.
In September 2003, NCDOT began the grading phase of the salt storage facility. In mid
September, Mr. Mark Gibbs, P.E., District Engineer and Mr. Don Carpenter, County
Maintenance Engineer, conducted an onsite investigation to determine if any "live water" was
present on the site. At that time no "live water" was observed. During the final clearing phase of
the project, the track hoe operator cleared soil and debris from the outlet end of the perforated
pipe, which had been installed approximately 6-7 years ago. He also cleaned out 115 linear feet
of a ditch leading to a culvert under the railroad, in addition to 20 linear feet of a spring seep to
the east. At that time, the drainage tile began to discharge water resulting in visible flow in the
excavated ditch.
On October 2, 2003, I was contacted by Mr. Keith Haynes of the Division of Water Quality and
he expressed concerns involving erosion control and the excavation of a small "stream/ditch" at
the site. I conducted an onsite investigation on October 2, 2003, to assess the situation. It
appeared that NCDOT had installed a perforated drain tile and cleaned out a small "stream/ditch"
in order to complete grading of the site and had not implemented proper erosion control

measures.

Following the October 2, 2003 site visit, I contacted Mr. Mike Parker of the Division of Water
Quality to discuss the situation and a site visit was scheduled for October 9, 2003. Prior to the
site visit, NCDOT completed the fine grading of the site. The drainage ditch was stabilized,
seeded with native vegetation (no fescue), and the banks were matted with coir fiber matting.
The fill slope was graded on a 3:1 slope, seeded and matted. All stormwater controls were
installed including riprap slope drains and retention basins. We intended to explain the situation
leading up to the incident and obtain a site assessment from Mr. Parker on October 9; however,
the Division of Water Quality issued a Notice of Violation 3 days prior to the site visit and
indicated that an after-the-fact permit would be required.
During the site visit on October 9, 2003, Mr. Parker and Mr. Haynes both indicated they were
pleased with the final site preparation. The only suggestions were to restore riparian vegetation
along the ditch and for NCDOT to apply for an after-the-fact permit. The reforestation plan will
be submitted with the PCN application and will include the following species: Silky Dogwood,
Dog Hobble, Buttonbush, Elderberry, and Virginia Sweetspire.
I am sending photos, a site plan drawing and reforestation plan, as well as a marked county map
and USGS quad map. Natural channel design techniques (pattern, dimension, and profile) were
used to restore the stream/ditch and the stream banks were stabilized with coir fiber matting and
vegetation. No threatened or endangered species are known to be present in or near the project
area; therefore, no significant impacts are anticipated from project construction. If the State
Historic Preservation Office (SHPO) and the Office of State Archaeology determines that further
investigations are required, NCDOT will conduct the appropriate site investigations and obtain
compliance from SHPO.
Impacts to Waters of the United States
In order to construct this project, it will be necessary to impact waters of the United States in the
French Broad River Basin. Specifically, NCDOT is requesting authorization for the dredging
activities and placement of one perforated metal pipe in an unnamed headwater tributary to
Richland Creek (DWQ Class C). Listed below is a summary of the proposed impacts.

NCDOT is requesting authorization under Section 404 of the Clean Water Act for the
unauthorized activities. By copy of this letter, I am asking the North Carolina Wildlife
Resources Commission (NCWRC) to comment directly to you concerning the 404 Nationwide

Permit request. All unauthorized work appears to be compliant with the applicable nationwide
regulations and should have caused minimal adverse impact to the aquatic environment.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water
Act from the North Carolina Department of Environment and Natural Resources (DENR),
Division of Water Quality (DWQ). In addition, I am asking the NCWRC and Mr. Ed Ingle,
(NCDOT) to comment directly to me concerning this permit request.
It is neither NCDOT policy nor their intention to work in jurisdictional areas without proper
authorization and/or concurrence from the various regulatory agencies. If you have any questions

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
This site is the onlv available area for the construction of a salt storage facility in nroximity-to
the NCDOT maintenance yard. It is essential to have an adequate salt storage facility to provide
for deicing of mountain roads and to keep the salt out of the weather to protect the environment.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
htti3:Hh2o.enr.state.nc.us/ncwetlands/strmgide.html.

of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
The fill slope has been stabilized with erosion control matting and seeded. Appropriate
stormwater controls have been installed. The riparian area has been heavily mulched and
seeded. The riparian vegetation of the disturbed intermittent stream has been restored by
planting a variety of native vegetation suitable for the site conditions The species planted
include: black willow, silky dogwood buttonbush and elderberry. (See attached planting
diagram).
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the
