APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 145
linear feet of Stag Creek in order to replace Bridge No. 320 on SR 1342 in Ashe County. The project
must be constructed in accordance with your application dated December 3, 2001 (received April 28,
2003). After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Nos. 3366 and 3404, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit Numbers 33 and 14. In addition, you must acquire any other federal, state or local
permits before you proceed with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and submit a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and adhere to Design Guidelines for Sensitive Watersheds [15A NCAC 4B .0124 (a) -
(d)] prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources.
Temporary or permanent herbaceous vegetation shall be planted on all bare soil within 10 days of
ground-disturbing activities to provide long term erosion control. The "+" indicates that these
streams are subject to special management conditions and drain to Outstanding Resource Waters
according to the DWQ stream classification schedule.
2. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, as determined by the North Carolina Wildlife
Resources Commission, to protect the egg and fry stages of trout from sedimentation during
construction. In addition, NCDOT shall be subject to any other conditions determined by NCWRC as
necessary to protecting species and habitat.

4. The dimension, pattern, and profile of the stream and floodplain above and below the base flow barrel
(pipe number 1) shall not be modified by widening the stream channel or reducing the-depth of the
stream. The structure shall be designed and installed to allow for fish and other wildlife movement as
well as prevent headcutting of the stream.
5. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If rip-rap is necessary, it must be limited to the stream bank above the high water
mark. Rip rap shall not be placed in the stream bottom.
6. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
7. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
8. The presence of equipment in the channels must be minimized. Under no circumstances must rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
9. Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project. NCDOT is strongly advised to send in photographs upstream
and downstream of the structure to document correct installation.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The NC Department of Transportation is scheduled to replace the existing substandard Bridge
#320 on SR 1342 in Ashe County. The proposed new structure is a triple barreled @ 16' x 8'
reinforced concrete box culvert (RCBC) 105' long. The entire culvert will be buried l' below the
existing streambed grade. The two stormwater barrels with have 2' high sills (1' buried) thus
directing all base flow into the third barrel. Please note that sill height may be modified as per
WRC recommendations. Baffles will be installed as per WRC recommendations. All excavated
natural streambed material will be placed into the stormwater barrels as directed by WRC.
Miscellaneous rip-rap impacts will total 40 linear feet or less. New stream impacts =1451n. feet.
This culvert will be constructed approximately 200 feet downstream of the existing bridge in
order to eliminate a sharp curve in the roadway. This will also eliminate the need to construct a
temporary detour. The 105' length of the culvert is needed to accommodate the amount of fill
that is required to complete the roadway.
Construction of this project will necessitate impacts to waters of the United States in the New
River Basin. Bridge #320 crosses Stagg Creek (Class: C, Trout +). The Division 11
Environmental Officer reviewed this project for the presence of threatened and endangered
species on November 29, 2001. The subject project has been determined to have no effect on any
listed threatened or endangered plant or animal species. Historic compliance work will be
scheduled and concurrence with the State Historic . Preservation Office will be obtained if
required.

The replacement of Bridge #320 with the proposed RCBC will require temporary dewatering.
Impervious dike "A" will be installed followed by the construction of culvert barrel #1. Once
barrel #1 is complete, impervious dike "A" will be removed. The stream will then be routed into
barrel #1 by constructing impervious dike "B". Barrels #2 and #3 (stormwater barrels) will then
be constructed. Once barrels #2 and #3 are complete, impervious dike "B" will be removed and
the roadway will be completed (see attached erosion control plan for a diagram). Any dirty water
located inside the construction area will be pumped into a silt bag. The dewatered area will total
approximately 750 square feet or 0.017 acres. Acceptable impervious dike materials shall include
sheet piles, sandbags and/or the placement of an appropriate sized stone lined with polypropylene
or other impervious fabric.
The modifications proposed in this application should not remove or degrade existing water
quality uses. By utilizing the erosion control measures outlined in the attachments to this
application, downstream water quality standards will be protected.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letters it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North CarolinaVildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. A trout buffer zone encroachment
variance will be requested for this project. It is requested that Mr. Ron Linville contact me at his
earliest convenience to schedule a sight visit in order to finalize sill height and baffle dimensions.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetland Unit, for her review. A

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a requir6.4 mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An?dpplicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at

2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the
NCWRP is available as an option. For additional information regarding the application

SR 1342, northwest of NC 88, southwest of Lansing, North Carolina. The project is located
adjacent to, and below the headwaters of, Stagg Creek.
Description of Activity
Mechanized landclearing, excavation and the discharge of fill material associated with the
replacement of the existing bridge with a 105-foot long triple barreled 16' by 6' reinforced
concrete box culvert. The culvert will permanently impact 105 linear feet of previously
unimpacted stream cliannel along with the placement along 40 linear feet of stream bank for bank
stabilization. Permit also authorizes the placement of fill material for the proposed dewatering
during construction, impacting 0.017 acre of surface waters. Please note that the
recommendations in the attached letter, from. the North Carolina Wildlife Resources Commission
dated December 7, 2001,.are also permit conditions.

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact
145 linear feet of Stag Creek in order to replace Bridge No. 320 on SR 1342 in Ashe County. The
project must be constructed in accordance with your application dated 3 December 2001 (received 5
December 2001). After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits
before you proceed with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
brook and brown trout spawning season of October 15 through April 15, or as otherwise
determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry
stages of trout from sedimentation during construction.
2. Stormwater must be directed to buffer areas or retention basins and must not be routed directly
into streams. Mowing of existing vegetated buffers is strongly discouraged, so that they may be

3. Sediment and erosion control measures shall adhere to the design standards for sensitive
watersheds [ 15A NCAC 4B .0024].
4. Temporary or permanent herbaceous vegetation must be planted on all bare soil within 10 days of
ground-disturbing activities to provide long term erosion control. NCDOT is encouraged to use
existing on-site vegetation and materials for streambank stabilization.
5. The length of the RCBC shall be minimized to the extent possible and practicable.

6. The RCBC shall be designed and constructed so that it can be installed one foot below streambed
grade to enable waters to flow without freefalling or damming on either end during low flow
conditions and ensure passage of all aquatic life. Three barrels will be installed; only one barrel
should be placed so as to receive base flow. NCDOT is encouraged to implement natural stream
structures such as cross veins and W weirs to direct flow to the barrel. The other two barrels
should be elevated or silled to receive only storm flows. The dimension, pattern, and profile of
the stream and floodplain above and below the base flow barrel shall not be modified by
widening the stream channel or reducing the depth of the stream. Disturbed streams and
floodplains should be restored to natural geomorphic conditions.
7. The base flow barrel (westernmost barrel) should be baffled with 4-5 (approx. 8" high)
alternating baffles (approx. 11" long), in a manner that mimics existing stream conditions. The
baffles shall be placed in a manner that maintains stream pattern and that smoothly reconnects to
the existing stream.
8. The height of the upstream and downstream storm water barrel sills (4) should be determined by
the Division Environmental Officer after flow is turned into the base flow barrel. The height of
the storm water sills should only be as high as necessary to maintain.existing stream and
floodplain conditions.
9. All work shall be performed during low flow conditions.
10. Disturbance of the stream channel must be limited to only what is necessary to perform the
culvert installation. Heavy equipment must be operated from the banks rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of introducing other
pollutants into the stream.
Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification hasleen completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC. Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within. 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

Description of Activity
Mechanized landclearing, excavation and the discharge of fill material associated with the
replacement of Bridge No. 204 with two lines of 50-foot long 103" X 71" corrugated steel pipe
arch (CSPA) with a concrete headwall. The project will impact 50 linear feet of previously
undisturbed streamthannel and will involve the placement of rip rap along 40 linear feet of
stream bank for bank stabilization. The project also involves the temporary dewatering of 70
linear feet (0.01 acre) for culvert installation.
CONDITION: All recommendations in the attached letter, from the North Carolina Wildlife
Resources Commission dated January 3, 2002, are hereby incorporated as special conditions of
this permit.

You have our approval, in accordance with the attached conditions and those listed below, to impact
90 linear feet of Crab Fork in order to replace Bridge No. 204 on SR 1328 in Alleghany County. The
project must be constructed in accordance with your application dated 20 December 2001 (received
27 December 2001). After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit-,Number 14. In addition, you must acquire any other federal, state or local permits
before you proceed with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the .

1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
brown and brook trout spawning season of October 15 through April 15, or as otherwise
determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry
stages of trout from sedimentation during construction.
2. Stormwater must be directed to buffer areas or retention basins and must not be routed directly
into streams. Mowing of existing vegetated buffers is strongly discouraged, so that they may be
utilized for storm water sheet flow.'

be minimized and shall not impede the ability of aquatic life to move during low flow conditions.
4. All work shall be performed during low flow conditions.
5. Disturbance of the stream channel must be limited to only what is necessary to perform the
