You have our approval, in accordance with the attached conditions and those listed below, to impact 98
linear feet (including 73 linear feet of stream relocation) of unnamed tributaries to Stoney Fork Creek in
order to improve SR 1503 (Lawrence Greene Road) in Watauga County. The project must be constructed
in accordance with your application dated June 27, 2002 (received July 3, 2002). After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Nos. 3366
and 3375, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Numbers 33 and 14. In
addition, you must acquire any other federal, state or local permits before you proceed with your project
including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise
specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and submit a new application.
If the property is. sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed, below.

trout spawning season of October 15 through April 15, or other conditions as determined by the
North Carolina Wildlife Resources. Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
3. Stream Relocation:
The new channel must be built.in the dry and fully stabilized before turning the stream into it.

stream shading. Note that silky dogwood, silky willow and black willow can be planted as live
stakes collected during the dormant growing season. Cuttings should be randomly planted and done
on 4-foot centers from the waters edge to the top of the bank. Trees should be planted on 10-12 foot
centers. Stream banks in these areas should also be stabilized with matting or seeded with an
approved wetland seed mix or temporary crop of wheat or rye.
4. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
5. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.
6. The dimension, pattern, and profile of the stream and floodplain above and below the structure shall
not be modified by widening the stream channel or reducing the depth of the stream.
7. All work shall be performed during low flow conditions.
8. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
9. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
10. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the 401/Wetlands
Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to grade, drain, base and pave SR 1503 in
Watauga County. Total project length is approximately 0.74 miles. The roadway will be widened
from 14 feet to 16 feet and paved. Impervious surface area will increase by 0.18 acres or 4%.
This project will require the replacement of one (1) wet cross line as shown below:
1) Replace existing 35'x 18" CMP at station 37+90 with a 50'x 24" CMP.
In addition to the above noted pipe replacement impacts at station 37+90, an unnamed tributary
to Stony Fork must be relocated approximately 10 feet to the west from stations 22+15 - 22+88.
Our inability to acquire right-of-way on the east side of the road has prohibited widening away
from the creek through this area. The dimensions of the 73-foot long newly constructed channel
will mimic existing conditions. The new channel will be constructed in the dry and will be
permanently stabilized before water is released into the newly constructed channel.
Just prior to releasing the water into the new channel, a sandbag dike will be placed in the existing
channel just north of the proposed relocation. Clean water will temporarily be pumped around the
construction area and discharged back into the natural stream channel approximately 100 feet
downstream. The dewatered area will equal approximately 300 square feet or 0.007 acres. Once
this has been accomplished, natural stream substrate material will be excavated from the dry
channel and placed into the realigned section. Once that is complete, the water will slowly be
allowed to enter the newly constructed channel.

In order to protect the roadway fill slope, we are proposing to line the eastern bank of the creek
with erosion control matting with class B rip-rap on top. The western creek bank will be lined
with erosion control matting and seeded. WRC may also request that we use live-stakes along the
western bank. If that is requested, we will rely on WRC for recommended species.
New stream impacts including piping and riprap placement at station 37+90 and the channel
relocation from 22+15 - 22+88 = 98 linear ft.
Construction of this project will require impacts to waters of the United States in the Yadkin
River Basin. The above noted wet cross line at station 37+90 and the stream relocation from
stations 22+15 - 22+88 involve different unnamed tributaries to Stony Fork (Class: C, Trout).
The Division 11 Environmental Officer reviewed this project for the presence of threatened and
endangered species on June 20, 2002. This project will have no effect on any federally listed
endangered plant or animal species. Historic compliance work will be scheduled and concurrence
with the State Historic Preservation Office will be obtained if required.
The proposed project impacts should not remove or degrade existing water quality uses. Pipe
sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion
control measures outlined in the attachments to this application, downstream water quality
standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. Please note that a trout water buffer zone
encroachment variance will be requested from stations 18+50 - 24+50 (UT to Stony Fork).
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetlands Unit, for her review. It is
requested that any comments related to the 401 certification be forwarded directly to me with a
copy sent to the US Army Corps of Engineers.

Attach a vicinity map clearly showing the location of the property with respect to local landmarks such
as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Since this is an existing _road, the maintenance impacts are unavoidable. Our inability to acquire
additional right-of-way prohibits widening the roadway away from the creek from 22+15 -
22+88 The remaining project impacts are minor in nature and should not remove or degrade
existing water quality uses Pipe sizes used will be the minimum necessary to create a safe
roadway. By utilizing the erosion control measures outlined in the attachments to this
application downstream water quality, standards will be protected All appropriate BMPs will be
used during construction

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strrngide.html.

SUBJECT: North Carolina Department of Transportation (NCDOT), SR1503,
Lawrence Greene Road, Unnamed Tributary Stony Fork Creek, Watauga
County
These comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina
Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT
proposes to grade, drain, base and pave SR1503. A 35' x 18" CMP will be replaced at
Station 37+90 with a 50' x 24 CMP. Channel relocation will impact a 73' section of
stream. The channel relocation will mimic existing conditions. Riprap impacts will be
minimized. Temporary dewatering will be required.
Based on our review of the submitted application and our knowledge of the area, we will
not object to project as proposed providing the following conditions are implemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the brown and brook trout spawning season of October 15 through
April 15 to protect the egg and fry stages of trout from off-site sedimentation during
construction.
2. Culverts 48" or larger should be buried approximately 1' into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to or
greater than 20% their size to allow for aquatic life passage. These measurements
must be based on natural thalweg depths.
3. Riprap should be minimized and installed in a manner so as not to interfere with
aquatic life passage during low flow conditions.
4. If any concrete will be used, work must be accomplished so that wet concrete does
not contact stream water.

5. The new channel must be built in the dry and fully stabilized before turning the
stream into it. Naturally occurring vegetation on site should be stockpiled and used
for the new streambanks. If this is not possible, disturbed banks should be
revegetated with silky dogwood (Corpus amonum), silky willow (Salix sericea), tag
alder (Alnus serrulata), black willow (Salix nigra), and sycamore (Platanus
occidentalis) or other lower growing native species to provide long term bank
stabilitq an?d' *m aMig: Note that silky dogwood, silky willow and black
willow',-c= be gfanted.as five stakes collected during the dormant growing season.
Cuttings should be randomly planted and done on 4 foot centers from the waters edge
to the top of the bank. Trees should be planted on 10-12 foot centers. Stream banks
in these areas should also be stabilized with matting or seeded with an approved
wetland seed mix or temporary crop of wheat or rye.
