Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing alignment of SR 2308 (Pinnix Road) in Wilkes County. The total project length
is approximately 1.1 miles. This project will require the replacement of two (2) small bridges and
one (1) wet cross line shown below:
1) Replace Bridge #289 at station 23+55 with (2) 55'x 112"x 75" CSPAs with a concrete
headwall.
2) Replace existing 25' x 24" CMP at station 27+16 with a 70' x 24" CMP.
3) Replace Bridge #310 at station 41+85 with (2) 60'x 66"x 51" CSPAs with a concrete
headwall.
Miscellaneous rip-rap impacts will total 90 linear feet or less. New stream impacts = 250 linear ft.
During construction, Bridge #289 will remain in place while the new crossing is constructed
approximately 40 feet to the west. Once the new culvert is constructed, Bridge #289 will be
removed. Bridge #310 at station 41+85 will be removed and the new culvert will be installed at
the same location. The road will temporarily be closed at this location during construction since
no temporary detour is proposed at this location. Both of the above noted proposed culverts will
have one base flow pipe and one stormwater pipe.

The replacement of Bridge #289 at station 23+55 with the proposed pipes will require temporary
dewatering. An impervious sandbag dike will be constructed approximately 20 feet upstream of
the existing bridge to create a small pool. Clean water will temporarily be pumped around the
construction area and will be discharged into a buffer area located approximately 110 feet
downstream of the sandbag dike. The dewatered area will total approximately 770 square feet or
0.018 acres. Any dirty water located inside the construction area will be pumped into a silt bag.
Once the new structure is in place, the impervious dike will be removed and preconstruction
streambed elevations will be restored.
The replacement of Bridge #310 at station 41+85 with the proposed pipes will also require
temporary dewatering. An impervious sandbag dike will be constructed approximately 20 feet
upstream of the existing bridge to create a small pool. Clean water will temporarily be pumped
around the construction area and will be discharged into a buffer area located approximately 100
feet downstream of the sandbag dike. The dewatered area will total approximately 500 square
feet or 0.011 acres. Any dirty water located inside the construction area will be pumped into a silt
bag. Once the new structure is in place, the impervious dike will be removed and preconstruction
streambed elevations will be restored.
Construction of the project will necessitate impacts to waters of the United States in the Yadkin
River Basin. The proposed structure at station 23+55 will carry East Swan Creek (Class: WS-
IV). The crossings at stations 27+16 and 41+85 will carry different unnamed tributaries to East
Swan Creek.
The Division 11 Environmental Officer inspected this project for the presence of threatened and
endangered species on March 27, 2002. The subject project has been determined to have no
effect on any federally listed endangered plant or animal species. According to the NCDOT web
site, the NCDOT Historical Architecture Section has reviewed this project and determined that
there are no NR/SL/DOE properties along this roadway that will be impacted by the proposed
project (see attachment).
Since this is an existing roadway, the modifications proposed in this application should not
remove or degrade existing water quality uses. Any widening of the existing roadway will be
directed away from any adjacent creek whenever possible with minimum fill placed in any buffer
area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the
erosion control measures outlined in the attachments to this application, downstream water
quality standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.

Attach a vicinity map clearly showing the location of the property with respect to local landmarks such
as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and
development plans in relation to surrounding properties. Both the vicinity map and site plan must include

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Since this is an existing road the maintenance impacts are unavoidable. The proposed pro'ee
impacts are minor in nature and should not remove or degrade existing, water quality uses. Pipe

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be installed before
clearing and grubbing operations begin.
(2) As construction progresses, temporary and permanent erosion control
devices shall be installed in a timely matter, according to any special permit
requirements and or requirements set out in G. S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S.113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be accomplished within 15
working days or 30 calendar days following completion of
construction or development, whichever period is shorter, except
as provided in 15A NCAC 413.0024 (e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G. S.113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be provided for any portion of a
land-disturbing activity in a HQW zone within 15 working days or 30
calendar days following completion of construction or
development, whichever period is shorter.
(3) All siltation and erosion control devices shall be properly maintained until no
longer needed.
(4) On projects performed by D.O.T. Maintenance Forces, request will promptly
be made to the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on the condition of established
ground cover of that area the device is serving.
CONSTRUCTION SEQUENCE FOR INSTALLING ROADWAY CULVERTS
1 - Clear only enough area and install the downstream measures such as silt check dams,
silt screens, and basins as noted on plans.
2 - Excavate the 2' base tail ditch.
3 - Excavate and install the roadway culverL
4 - install sediment control measures at inlet as noted on plans.
5 - Install additional pipe outlet protection and inlet protection as noted.

RIP RAP MATERIALS
1042-1 PLAIN RIP HAP.
Stone for plain rip rap shall consist of fieldstone or rough unllev.'n quarry
stone- The stone shall be sound, tough, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Where broken concrete from demolished structures or pavement is avail-
. e, it may be used in place of stone provided that such use meets with the
approval of the Engineer.. However, the use of broken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds.
At least 30 pel-cent of the, total weight of the rip rap shall be in
individual pieces weighing a rnininlum of 60 pounds each. Not more
than 10 percent of the total Nveight. of the rip rap rilay be in individual
pieces weighin' less than 15 pounds each.
2:`For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250
pounds. At least 60 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of 100 pounds each. Not more
than 5 percent of the total Weight of the rip rap niay be in individual
pieces weighing le Ss than 50 pounds each.

HIGH QUALITY WATERS
1. Uncovered areas are limited at any given time to a maximum total area of
20 acres.
2. Erosion and sedimentation control measures shall be designed to provide
protection from the 25-year storm.
3. Large Type-A basins shall be designed and constructed with a settling
efficiency of at least 70% for the 40 micron soil particle size transported
by runoff from the 2-year storm.
4. Newly constructed channels shall be constructed with side slopes no
steeper than 2:1, unless slopes are to be stabilized by methods other than
vegetation
5. A ground cover sufficient to restrain erosion must be provided for any
disturbed area.

SUBJECT: North Carolina Department of Transportation (NCDOT),
Bridge No. 289, SR2308, East Swan Creek,
Bridge No. 310, SR2308, UT East Swan Creek, Wilkes County
These comments are provided in accordance with the provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North
Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25).
Biologists with the North Carolina Wildlife Resources Commission are familiar with
habitat values in the area. The NCDOT proposes to replace an existing bridge with dual
CSPAs with concrete headwalls. The new bridge will be located 40' west of the existing
bridge, which will be used until the new bridge is completed. Removal of the existing
bridge should not be allowed to impact waters.
NCDOT proposes to replace Bridge No. 289 with two 55' x 112" x 75" CSPAs
with a concrete headwall. Likewise Bridge No, 310 will be replaced with two 60' x 66"
x 51" CSPAs. A 25'x 24" CMP at Station 27+16 will be replaced with 70'x 24" CMP.
Miscellaneous riprap impacts will be 90 linear feet and the total additional impacts will
be 250 linear feet. Temporary dewatering will also be necessary.
While our preference would be to replace the bridges with new spanning
structures, we will not object to the dual CSPAs provided the following conditions are
implemented:
1. Culverts 48" or larger should be buried approximately 1' into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to
or greater than 20% their size to allow for aquatic life passage.

2. As two barrels will be installed at each bridge site, only one barrel per site
should be buried 1 foot into the substrate for base flow. The second barrel
floor should be placed at bankfull elevation to prevent noxious or mosquito
breeding conditions. Although not preferred silling both ends and filling the
stormwater pipe floor to the floodplain bench elevation is also acceptable.
3. The dimension, pattern, and profile of the stream above and below the lower
barrel should not be modified by widening the stream channel or reducing the
depth of the stream. Previously disturbed floodplains, floodplain benches, and
streams should be restored to natural geomorphic conditions upon project
completion. Riprap should not interfere with aquatic life movement during
low flow conditions.
4. If concrete will be used, work must be accomplished so that wet concrete does
not contact stream water. This will lessen the chance of altering the stream's
water chemistry and causing a fish kill.
5. Heavy equipment should be operated from the bank rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of
introducing other pollutants into the stream.
6. Stringent erosion control measures should be installed where soil is disturbed
and maintained until project completion.
7. Temporary or permanent herbaceous vegetation should be planted on all bare
soil within 15 days of ground disturbing activities to provide long-term
erosion control. We encourage NCDOT to utilize onsite vegetation and
materials for streambank stabilization when practicable.

APPROVAL of 401 Water Quality Certification withAdditional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact
250 linear feet of East Swan Creek and its unnamed tributaries in order to improve SR 2308 (Pinnix
Road) and replace Bridges No. 289 and 310 in Wilkes County. The project must be constructed in
accordance with your application dated April 16, 2002 (received April 23, 2002). After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification No.
3375, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In
addition, you must acquire any other federal, state or local poFmits before you proceed with your
project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless
otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any, ,additional conditions listed below.
1. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A
NCAC 4B .0024) must be implemented prior to any ground-disturbing activities to minimize
impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation shall
be planted on all bare soil within 15 days of ground-disturbing activities to provide long term
erosion control.
2. Riparian vegetation must be reestablished within the construction limits of the project by the end
of the growing season following completion of construction.
3. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank
stabilization and to minimize the use of rip rap.
4. The dimension, pattern, and profile of the stream and floodplain above and below the structure
shall not be modified by widening the stream channel or reducing the depth of the stream.
5. All work shall be performed during low flow conditions.

of Completion" form to notify NCDWQ when all work included in the §401 Certification has
been completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
