APPROVAL of 401 Water Quality Certification with Additional Conditions: MODIFICATION

Dear Mr. Hunsinger:
You have our approval, in accordance with the attached conditions and those listed below, to
permanently impact 38 linear feet of stream, and temporarily impact 40 linear feet of an unnamed
tributary to Troublesome Creek for the purpose of upgrading SR 2404 (Butler Dairy Road) in
Rockingham County. The project must be constructed in accordance with your application dated 11
December 2001 (received February. 19, 2002). After reviewing your application, we have decided
that this project is covered by General Water Quality Certification Number 3289. This certification
corresponds to Nationwide Permit 14 issued by the Corps of Engineers. In addition, you must acquire
any other federal, state or local permits before you proceed with your project including. (but not
limited to) Sediment and Erosion Control,- Non-Discharge and Water Supply Watershed regulations.
This approval will expire with the accompanying §404 permit, unless otherwise specified in the
Water Quality Certification. For this approval to be valid, you must follow the conditions listed in the
attached certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing, and submit a
new application. If the property is sold, the new owner must be given a copy of this Certification and -
approval letter, and is thereby responsible for complying with all the conditions. If the proposed fill
is in excess of 150 linear feet of stream length or 1 acre of wetlands, compensatory mitigation will
required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed below.
1. Nonpoint Source and Stormwater Pollution requirements for WS-IV Waters as specified in 15A
NCAC 2B .0216.
2. Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0024)
must be implemented prior to any ground-disturbing activities to minimize impacts to
downstream aquatic resources. Temporary or permanent herbaceous vegetation must be planted
on all bare soil within 15 days of ground-disturbing activities to provide long term erosion
control. See also NCDOT's Best Management Practices for the Protection of Surface Waters
(March 1997).
3. The culvert required for this project shall be installed in such a manner that the original stream
profile is not altered (i.e. the depth of the channel must not be reduced by a widening of the
streambed). Existing stream dimensions are to be maintained above and below locations of
culvert extensions. The pine shall be installed one foot below the stream to allow for fish and

other aquatic movement. If the existing pipe is perched, then it shall be taken out and installed to
allow for passage of aquatic life.
4. All work shall be performed during low flow conditions.
5. All mechanized equipment operated near surface waters must be regularly inspected and
maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or
other toxic materials.
6. The presence of equipment in the channels must be minimized. Under no circumstances must
rock, sand or other materials be dredged from the wetted stream channel under authorization of
this permit, except in the immediate vicinity of the culverts.
7. Existing vegetated buffers shall not be mowed in order to utilize it for storm water sheet flow.
8. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If necessary, rip-rap must be limited to the stream bank below the high water
mark, and vegetation must be used for stabilization above high water.
Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mrs. Manuele:
The North Carolina Department of Transportation (NCDOT) proposes to upgrade Butler Dairy
Road (SR 2404) from an unpaved to a paved secondary road to reduce future maintenance needs
and increase traffic safety. This activity will result in impacts to a stream due to the replacement
and extension of a crossline pipe to facilitate travel lane and shoulder widening. Total project
length is 0.8 miles. The replacement, which is occurring in a US water within the Cape Fear River
Basin, is as follows:

Permanent impacts will result from stream enclosure and placement of rip rap energy dissipaters
above the ordinary high water mark on each side of the newly installed pipe (energy dissipaters will
be included within the confines of the temporary work area). Temporary impacts will result from
the placement of ABC aggregate or a less intrusive dewatering device within the stream during the
dewatering operation. Dewatering devices will be placed on both side of the pipe being replaced.
The road being upgraded is a dead end; therefore, a temporary travel lane will be needed for an on-
site detour. Within 15 working days of the of the pipe replacement activity all dewatering structures
will be entirely removed and natural stream contours will be restored and seeded.

Required mitigation is not anticipated, as the impacts to any individual stream do not exceed 150
feet. The project is not located in a High Quality Water. The project will not impact an Essential
Fisheries Habitat. No Threatened or Endangered species were observed during field surveys
conducted by Len Smith for species known to occur in Rockingham County (See the attached
Endangered Species Review Sheet for further information).
Records from the NCDOT Historic Architect indicate that no National Register, Study List, or
Determination of Eligibility properties are located within the project area
Secondary impacts will be minimized by strict enforcement of Best Management Practices for the
protection of surface waters, restrictions against the staging of equipment in or adjacent to waters of
the US, and coordination with the Division Environmental Officer.
The NCDOT anticipates that the pipe replacement activity will be authorized under Nationwide
Permit (NWP) 14 and the dewatering operation will be authorized under NWP 33. This application
is intended as a request for formal written authorization from the USACE for dewatering activities
occurring under NWP 33. This application is also intended as request for written authorization from
the NC Division of Water Quality to replace the pipe under General Water Quality Certificate # 3289
(NWP 14). Enclosed please find the project site map and the pre-construction notification form for
the above referenced project. Construction is anticipated to begin
as soon as practicable following authorization and take 2 week to complete.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Pipe replacement and widening activities are necessary to increase travel lane and shoulder width
to current construction standards. Impacts will be minimized by strict enforcement of Best
Management Practices for the protection of wetland and surface waters restrictions against the
staging of equipment in or adjacent to waters of the US and coordination with the Division
Environmental Officer.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
httl2://h2o.enr.state.nc.us/ncwetlands/stnngide.html.

Construction Sequence and Erosion Control Plan for Replacement of
Pipe with Pipe using an On-site Detour - Rockingham County, SR 2404
Work to begin as soon as practicable following authorization.
Construction is anticipated to take 2 weeks.
1. Install a rock silt dam downstream of the work area to prevent incidental sediment
loss.
2. Install ABC aggregate or a less intrusive dewatering device to allow dewatering of the
work area.
3. Install pumps to divert flow around the work area.
4. Place a temporary extension at one end of the existing pipe to allow a travel lane
shift.
5. Place a temporary detour over the temporary extension.
6. Opposite the detour, remove existing RC pipe to at least the centerline of the
roadway.
7. Excavate to sufficient depth to allow burial of the pipe to 1', place base stone, and
sections of 20' long 48" RC pipe.
8. Backfill the new section of pipe and place riprap only as needed.
9. Place the temporary detour over the new sections of pipe.
10. Remove remaining sections of pipe.
11. Excavate to sufficient depth to allow burial of the pipe to 1', place base stone, and
sections of 20' long 48" RC pipe.
12. Backfill the new section of pipe and place riprap riprap only as needed.
13. Remove the dewatering device and restore the natural stream contours.
14. Place final roadway in desired location.
15. Notify landscape department for final seeding.
16. Silt fences to be placed as site conditions require.
17. A 10' X 15' dirt bag will be used to remove excess water in the hole where the new
pipe is being replaced.
18. Site conditions and weather may alter these plans.
19. A pump around system may not be utilized if site conditions allow.

fences and slope drains; redistribute all stone from silt

The NCDOT I-Estoric Architecture Section has received your county commission-approved 2001-2002
Secondary Roads Rural Paving Program. We have map-checked all submitted roads at the NC State
Historic Preservation Office (SHPO) for the following currently designated historic property types:
National Register (NR), Study List (SL), and Determined Eligible (DOE) properties. Based on the map-
check reviews, we are writing (1) to inform you of the current historic compliance status for your SR
Rural Paving Program; (2) to notif< you of the SR projects that definitely will require our fieldwork; (3) to
provide you with information that can be included (or attached) in your cover letter for a Pre-Construction
Notification.
If coordination is required, the NCDOT staff architectural historian will notify the Division/District
Maintenance Engineers to start a mitigation effort involving environmental commitment agreeable to all
parties. Documentation will be coordinated by the staff architectural historian with the Division
Environmental Officer.
When additional SR projects are added to a Program, individual updates will be sent to the
Division/District Maintenance Engineers and the DEO. All status updates can be tracked on the Division
