Randall Turner Restoration Systems LLC 1101 Haynes Street Suite 209 Raleigh, North Carolina 27604 Dear Mr. Turner: v'E ^"DSOWABRANCH On January 21, 2010 we contacted the IRT and requested preliminary review of the Draft Prospectus for the Pancho Stream and Wetland Mitigation Bank that you are developing approximately 11 miles west-southwest of Goldsboro (35.33363N -78.19267W) on North Carolina State Road 1008 in and adjacent to Kennedy Mill Branch in Wayne County, North Carolina. After review of the draft prospectus, the North Carolina Division of Water Quality (NCDWQ) provided comments in email dated February 1, 2010. NCDWQ expressed concern about expanding the service area outside of the River Basin. In addition, the USACE has several concerns. There is a break in ecoregion within the proposed subbasin that includes the proposed ban. When there is a distinct break in a physiographic ecoregion exist within a given 8-digit HUC, at the discretion of the IRT, the size and location of the GSA may be limited to the 8-digit HUC and the specific physiographic ecoregion within which the bank property is located. Use of a bank site to compensate for impacts beyond the GSA may be considered by the Corps or other permitting agency on a case-by-case basis. Additionally, we are concerned that the proximity of the hog waste lagoons to the preservation has a high risk of failure. We have some questions concerning project design including the increased sinuosity in the northern reaches of Kennedy Mill Branch and the proposed braided channel in the southern portions. It is Department of the Army policy to provide a project proponent the opportunity to furnish a proposed resolution or rebuttal to all comments and/or objections from the public and government agencies before a final decision is made.
