The North Carolina Department of Transportation (NCDOT) proposes to upgrade Pearman Quarry Road (SR 2035) from an unpaved to a paved secondary road to reduce future maintenance needs and increase traffic safety. This activity will result in impacts to a stream due to the replacement and extension of a crossline pipe to facilitate travel lane and shoulder widening. Total project length is 1.48 miles. The replacement, which is occurring in a US water within the Roanoke River Basin, is as follows: Site Existing Pipe Proposed Pipe Impacts (ft) 1 (STA 68' of 36" RCP f8oof 81" X 59" CMPA 12(en), 20(tmp), 76+00) 40(rp) Cumulative Impacts 12(en), 20(tmp), 40(rp) RCP = reinforced concrete pipe; CMP = Corrugated metal pipe; GIVIYA = Uorrugated metal pipe arcn. en = enclosure; tmp = temporary, rp = rip rap energy dissipaters placed above ordinary high water. PHONE 336-334-3192 FAX 336-334-3637 Permanent impacts will result from stream enclosure and placement of rip rap energy dissipaters above the ordinary high water mark. Rip rap energy dissipaters will be placed on each side of the newly installed pipe (the downstream energy dissipater will be located within the confines of the silt screen). The placement of a rock silt screen downstream from the pipe outlet will result in 20 linear feet of temporary impact per crossing. Within 15 working days of the of the pipe replacement activity the rock silt screen will be entirely removed, and natural stream contours will be restored and seeded. On-site detours will not be provided due to the short duration of the pipe replacement activity. Required mitigation is not anticipated, as the impacts do not exceed 150 feet. The project is not located in a High Quality Water. The project will not impact an Essential Fisheries Habitat. No Threatened or Endangered species were observed during field surveys conducted by Len Smith for species known to occur in Guilford County. Records from the NCDOT Historic Architect indicate that no National Register, Study List, or Determination of Eligibility properties are located within the project area. Secondary impacts will be minimized by strict enforcement of Best Management Practices for the protection of surface waters, restrictions against the staging of equipment in or adjacent to waters of the US, and coordination with the Division Environmental Officer. The NCDOT anticipates that the pipe replacement activities will be authorized under Nationwide Permit 14. This letter is a request for authorization under General Water Quality Certification #3375 from the NC Division of Water Quality. Enclosed, please find seven (7) copies a Pre- Construction Notification package for you review. Construction is anticipated to begin as soon as practicable following authorization and take 5 days to complete. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Pine replacement and widening activities are necessary to increase travel lane and shoulder width to current construction standards. Impacts will be minimized by strict enforcement of Best Management Practices for the protection of wetland and surface waters, restrictions against the staging of equipment in or adjacent to waters of the US, and coordination with the Division Environmental Officer. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 5 of 8 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at ttp://h2o.cur. state.nc.us/ncwetlands/strmSide,htm1. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. A finding of insignificant impact is anticipated. Cumulative impacts are less than 150 feet. The maximum amount of impact to a single stream is 52 linear feet. No Outstanding Resource Waters, federally protected species or their habitats, or essential fishery habitats occur in the project area. The project is not located in a High Ouality Water. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. For additional information regarding the application process for the NCWRP, check the NCWRP website at hhU://h2o.enr.state.nc.us/wrp/index.htm. We have map-checked all submitted roads at the NC State Historic Preservation Office (SHPO) for the following currently designated historic property types: National Register (NR), Study List (SL), and Determined Eligible (DOE) properties. Based on the map- check reviews, we are writing (1) to inform you of the current historic compliance status for your SR Rural Paving Program; (2) to notify you of the SR projects that definitely will require our fieldwork; (3) to provide you with information that can be included (or attached) in your cover letter for a Pre-Construction Notification. If coordination is required, the NCDOT staff architectural historian will notify the Division/District Maintenance Engineers to start a mitigation effort involving environmental commitment agreeable to all parties. Documentation will be coordinated by the staff architectural historian with the Division Environmental Officer. When additional SR projects are added to a Program, individual updates will be sent to the Division/District Maintenance Engineers and the DEO. All status updates can be tracked on the Division Support website. If there are errors or omissions in this letter or on the website, please e-mail your NCDOT staff architectural historian or call the Division Coordinator, Richard Silverman, 919-733-7844 x293. Historic Properties Present (NR, SL, or DOE) Status: THE DIVISION WILL NOT PROCEED until compliance work is completed by NCDOT Historic Architecture and Concurrence has been obtained from the NC State Historic Preservation Office Further Information & Scheduling: Contact your assigned Architectural Historian or go to http://www.dot.state.nc.us/planning/pe/histarchi/divsupport/ Based on a review of USGS county survey quad maps at the SHPO, the following roads have properties that are currently designated as historic. Please do not proceed with construction until compliance work is completed by the Historic Architecture Section. We will be in contact with the Division/District Maintenance Engineers and the Division Environmental Officer to coordinate this effort. Please note: not all NR, SL, or DOE properties will necessarily require mitigation. We will work with the Division and District Maintenance Engineers if environmental commitments are required. At any time, if you arc not in agreement with the proposed mitigation efforts, please contact Richard Silverman, Division Coordinator at 919-733-7844 x298. The Division may proceed with construction with the following conditions: If the Division applies for a Federal Permit, the NC State Historic Preservation Office (SHPO) may request additional fieldwork, (usually to identify Potentially Eligible properties). Typically this request is made for counties where historic resource surveys have not been completed or are out-of-date. If additional historic properties are identified, further coordination, including environmental commitments, may be required as part of the project. For SR Projects where no Federal Permit is to be applied for, no further compliance work is anticipated by NCDOT. Those projects may proceed unconditionally.
