RE: Letter of Refinement, CAMA Major Development Permit No. 149-09, Beach Nourishment
at S-curves of Pea Island Wildlife Refuge, Dare County.
Dear Mr. Willis:
This letter is in response to the N.C. Department of Transportation's (NCDOT's) letter dated -
December 9, 2009 requesting a Minor Modification of CAMA Major Permit No. 149-09.
NCDOT is requesting to add an additional 4,000 to 5,000 cubic yards of sand to the area to
compensate for sand removed to construct sand bags. Upon further review of request we have
determined that a Letter of Refinement to the permit would adequately be sufficient in this case
as there will be no,additional environmental resource impacts associated with this adjustment.
Please be advised that through this Letter of Refinement, The Division of Coastal Management
(DCM) conveys its determination that the above referenced request is consistent with existing
State rules and regulations and is in keeping with the original purpose and intent of CAMA
Permit No. 149-09 with the following conditions:
1. This Letter of Refinement does not eliminate the need to obtain any additional state,
federal or local permits, approvals or authorizations that may be required.
2. This Letter of Refinement shall be attached to the original of Permit No. 149-09
which was issued on November 18, 2009, and copies of both documents shall be
readily available on site when a Division representative inspects the project for
compliance.
3. All conditions and stipulations of the active permit remain in force under this Letter
of Refinement unless altered herein:
