Wilson, Environmental Engineer Subject: Neuville Avenue Sewer Extension Project NCDENR Project 13-0302 Environmental Review Comments Burke County The project proposal is to acquire funding to run an approximately 700 foot sewer line extension from Zion Industries boundary to the Town of Hildebran sewer line. The following concerns may, or will likely, need to be addressed: The sewer line should be properly permitted through the Division of Water Quality and meet the minimum design criteria. In addition, the applicant should insure that the treatment plant has adequate capacity to accommodate the wastewater type/quantity from the industry. This was not clearly indicated in the document. 2. NPDES Construction Stormwater Permit NCGO10000 —This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000 permit is required. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers for utility line construction, a 401 Water Quality Certification is necessary. Depending on the amount of impact to a stream and/or wetland — written concurrence from this office may be required. From the information submitted, it does not appear that jurisdictional waters or wetlands will be disturbed with the sewer line extension — this should be confirmed by the Town prior to impacts to the site. Wilson, Environmental Engineerl� -- Subject: Grandfather Ranger District — Pisgah National Forest — Prescribed Burn Scoping Comments Project No.: 13-0077 Burke and Caldwell County The Grandfather Ranger District of the Pisgah National Forest proposes to perform several prescribed burns in Burke and Caldwell Counties. The total amount of acres is approximately 12,200 acres. The Division of Water Quality has the following concern: The USDA should ensure that all Forestry Practice Guidelines are met/maintained during and after completion of the prescribed burn, so that sediment due to exposed soils does not enter surface waters. Wilson, P.E., Environmental Engineer g--__'__ Subject: Burke County CDBG Proposal (Amendment #2) — Taylor Ave. Water Line NCDENR Project No. 11-0234 Environmental Review Comments Burke County Burke County has applied for a CDBG to install an 8 inch water line to serve Taylor Avenue/Rhoney Road. Amendment #2 is proposed to extend the water line 3500 LF southwest along Rhoney Road (between NC Hwy. 18 and Corn Hill Rd.). DWQ/ARO offers the same general comments as previously submitted for this project. The following concerns may, or will likely, need to be addressed: 1. NPDES Construction Stormwater Permit NCG010000 —This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the project will disturb greater than one acre, an NCG010000 permit is required. 2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers (USACOE), a 401 Water Quality Certification is necessary. Depending on the amount of impact to streams and/or wetlands along the proposed route — written concurrence from this office may be required. DWQ/ARO is unsure if this extension crosses surface waters — the applicant/consultant should confirm. The following concerns may, or will likely, need to be addressed: NPDES Construction Stormwater Permit NCGO10000 — This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stonnwater discharges from construction activities. If the project will disturb greater than one acre, an NCG010000 permit is required. 2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers (USACOE), a 401 Water Quality Certification is necessary. Depending on the amount of impact to streams and/or wetlands along the proposed route — written concurrence from this office may be required. The application states that Rock Creek (and tributary) will be crossed. Rock Creek is a Class WS-I11 waterbody in the Catawba River Basin. It is likely that the Water Quality Certification 3819 (issued with the USACOE Nationwide Permit, if applicable) will suffice for the project and no written concurrence is necessary (as long as the conditions of 3819 can be met). Wilson, P.E., Environmental Engineer Subject: Barkhouse Picnic Area and Mulberry Picnic Area USDA Pisgah National Forest Environmental Review Record Comments Project No.: 11-02210 Burke and Caldwell Counties USDA — Grandfather Ranger District/Pisgah National Forest proposes to decommission two picnic areas — Barkhouse Picnic area in Burke County and Mulberry Picnic Area in Caldwell County. DWQ/ARO has the following comments: If access roads are decommissioned and there is the opportunity to remove stream culverts that may be in place, that the USDA does so and return the streams to their natural channel dimensions (it is unclear from the documents if the access roads currently have stream culvert crossings). 2. The USDA should minimize any potential impacts to surface waters during the decommissioning (i.e., use BMPs as necessary to ensure no sediment impacts to streams). Wilson, Environmental Engineer Subject: NC Municipal Power Agency No. 1 NCUC E-43, Sub 7 (Various County Locations) This document appears to be a proposal to locate a maximum of 2.5 MW diesel generating capacity at various municipalities across the state (for the purpose of additional/supplemental power supply). Based on the minimal information provided, the following concerns may need to be addressed: 1. NPDES Construction Stormwater Permit NCG010000 —This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If greater than one acre is disturbed in building the generators, a NCG010000 permit is required. 2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a 401 Water Quality Certification is necessary. Depending on the amount of impact to a stream and/or wetland — written concurrence from this office may be required. 3. DWQ recommends that the generators be located outside of the 100 year flood plain. The Commission concludes that NCMPA1 should be required to publish a notice of the application in the manner required in G.S. 62-82(a) and file an affidavit of publication with the Commission. The Chief Clerk of the Commission will deliver copies of the application and the notice to the Clearinghouse Coordinator of the Office of Policy and Planning of the Department of Administration for distribution by the Coordinator to State agencies having an interest in the application. If a complaint is received within 10 days after the last date of the publication of the notice, the Commission will schedule a public hearing to determine whether a certificate should be awarded, will give reasonable notice of the time and place of the hearing to NCMPA1 and to each complaining party, and will require NCMAP1 to publish notice of the hearing in the newspaper in which the notice of the application was published. If no complaint is received within the time specified above, the Commission may, upon its own initiative, order and schedule a hearing to determine whether a certificate should be awarded and, if the Commission orders a hearing upon its own initiative, it will require notice of the hearing be published by NCMPA1 in the newspaper in which the notice of the application was published. If no complaint is received within the time specified and the Commission does not order a hearing upon its own initiative, the Commission will enter an order awarding the certificate. publication. Wilson, Environmental Engineer Subject: Kleen Tech, Inc. — CDBG-ED Development Project NCDENR Project 11-0097 Environmental Review Record Comments Burke County The Kleen Tech Economic Development Project proposes to rehabilitate the former Valdese Hoyle Creek WWTP to construct a pretreatment facility for Kleen Tech, Inc. Kleen Tech will construct a building/loading area and parking lot alongside the pretreatment facility. The following concerns may, or will likely, need to be addressed: 1. Valdese Pretreatment Requirements —The project should ensure that the rehabilitated WWTP will meet any necessary pretreatment requirements for the Town of Valdese. The City may wish to contact the Division of Water Quality's Pretreatment and Emergency Response Unit at (919) 807-6383 to ensure that all requirements are met.
