If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. The following documentation be kept on file at the job site: a. City of Asheville Permit b. The approved E&SC plan as well as any approved deviation. c. The NCG01 permit and the Certificate of Coverage. d. Records of inspections made during the previous 30 days. e. Records of third party inspections. Per Title 15A NCAC 413.0118(a), City of Asheville UDO, and the NCG01 permit. 2. Site must stay in compliance with all federal, state and local regulations. Failure to maintain compliance for any of the agency's stated above may result in issuance of a Notice of Violation against the project or revocation of the Grading Permit. 3. If any of the minimum best management practices fail to adequately keep sedimentation or stormwater on the site, it shall be the responsibility of the professional designer of record to supply the Contractor/Owner with a correction, as well as submit correction to the Development Services Department for approval. 4. For sites with greater than 25,000 square feet of disturbance, a contract is required between the person financially responsible and a licensed professional for the initial inspection ensuring erosion and sediment control measures have been installed consistent with the approved plan. A notarized certificate of inspection agreement on a form has been received and approved by the Stormwater administrator and a copy is included as part of this grading and stormwater permit is issued. 2
