HistoricalC + •�'sAr�• SUPERFUND DELETION FACT SHEET Region CHEMTRONICS SUPERFUND SITE Swannanoa, Buncombe County, North Carolina May 2003 INTRODUCTION This fact sheet on the Chemtronics Superfund Site located in Swannanoa, Buncombe County, North Carolina, has been prepared by the Environmental Protection Agency (EPA) Region IV office. The purpose of this fact sheet is to inform interested citizens and local officials that the Agency intends to remove the Site from the National Priorities List (NPL) and allow all future Site and environmental restoration efforts to occur under the Resource Conservation and Recovery Act (RCRA). This fact sheet also invites all interested parties to attend a public meeting the evening of Tuesday, June 17, 2003 at the Charles D. Owen Middle School, Swannanoa, NC. EPA, North Carolina Department of Environment and Natural Resources (NCDENR), and'the Potentially Responsible Parties (PRPs) will present information on the current status of the Site and the rationale for making this change and solicit input from the public on this potential change. Contact EPA @ Jon Bornholm 404-562-8820 or 1-800-435-9233,.ext.28.820 or Diane Barrett 464-562-8489 or 1-800-435-9233, ext. 28489 BRIEF SITE DESCRIPTION/HISTORY The Chemtronics Site is located at 180 Old Bee Tree Road in a rural area of Swannanoa, Buncombe County, approximately 8 miles east of Asheville, North Carolina. The Chemtronics property encompasses approximately 1,027 acres and was first developed into an industrialfacility in 1952. The Site consists essentially of two valleys separated by a ridge. The topography of the Site is steep, ranging from 2,200 to 3,400 feet above mean sea level. The Front Valley contains an unnamed stream and the Back Valley is drained by Gregg Branch. The Site lies on the southeast side of Bartlett Mountain and is moderate to heavily vegetated. All surface water from the Site drains into small tributaries of Bee Tree Creek or directly into Bee Tree Creek. This creek flows into the Swannanoa River which ultimately, empties into the French Broad River. The following companies were identified as the PRPs: • Oerlikon Tool and Arms Corporation of America (1952-1959) • Amcel Propulsion, Inc. (1959-1965) (under both Oerlikon and Celanese) • Celanese Corporation of America (Hoechst Celanese Corporation) (1959-1965) • Northrop Carolina, Inc. (Northrop Corporation) (1965-1971) • Chemtronics, Inc., as apart of Airtronics, Inc. (1971-1978) • Chemtronics, Inc.. (1978 - present) (Chemtronics Inc. is a subsidiary of the Halliburton Company). Waste disposal occurred over a small portion (approximately eight acres) of the Site. Twenty- three individual on -site disposal areas and three off - site areas were identified and investigated. Disposal practices prior to 1971 are not well defined. From 1971-1975, most of the liquid wastes generated on -site went to the Buncombe County Sewer System following some form of neutralization and equalization. Small volumes of liquid and solid wastes were dumped in on -site pits/trenches during this time -frame. From 1975-1979, pits/trenches were constructed as needed for the disposal of spent acid and various organic wastes. In 1980, the State of North Carolina ordered all on -site waste disposal to stop. The Remedial Action (RA) construction phase at the Superfund areas began in January 1992 and ended in December 1992. The RA was conducted in accordance with the approved July 1991 Final Design Specifications. The Site remediation included controlling both source and groundwater. The source control involved capping the disposal areas and surrounding each area with a six-foot security fence. The groundwater remediation phase involved the installation of eleven extraction wells and two groundwater treatment systems (one in each valley). Both groundwater treatment systems use air strippers to remove volatile organic compounds. The Front Valley treatment system includes carbon adsorption to remove semi -volatile organic compounds and the Back Valley treatment system includes caustic injection for pH control (buffer the water). All treated groundwater is discharged to the Metropolitan Sewer District (MSD) sewer system. As of April 30, 2003, over 54 million gallons of groundwater has been extracted, treated, and discharged. Since treatment of waste continued until 1984, the Site also fell under the provision of the RCRA programs of the EPA and the North Carolina Hazardous Waste Section (NCHWS). In 1997, the PRPs signed an Administrative Order on Consent (AOC) with the NCHWS. The AOC addresses investigation and remediation of areas on the Site not covered under CERCLA jurisdiction. CURRENT STATUS Two recent reports have been prepared for the Chemtronics facility. The first report, entitled "Phase II Site Investigation Report - Volumes 1 & 2," dated May 31, 2002, was an outcome of recent environmental investigative work conducted by the PRPs in areas of the facility covered under RCRA. This report and follow-up sampling efforts have identified some additional sources of contamination (primarily building drains as sources of groundwater contamination). The second report, entitled "Five -Year Review Report," dated August 2002, stems from the requirements of Superfund. A third document was generate as a result of . the findings/ conclusions reached in these two referenced reports. This document, entitled, "Holistic Site Management Plan," dated January 2003, envisions taking a holistic approach to the Chemtronics facility as well as moving all Site and environmental restoration efforts under one environmental law. "Holistic" can be defined as relating to or concerning the entire Chemtronics facility rather than analyzing or treating individual areas of the facility. This approach starts at the boundaries of the Chemtronics facility and looks inward toward the sources. One of the key recommendations in the Agency's "Five -Year Review Report" was to complete and then implement the "Holistic Site Management Plan". In a letter dated, March 6, 2003, the PRPs petitioned the Agency to move all current and future Site and environmental restoration efforts under one Program (i.e., one law). Therefore, the PRPs have requested all work be performed under the RCRA Program. This will allow the PRPs to respond to only one regulatory entity instead of two. The RCRA Program has been delegated to NCDENR, therefore, the State of North Carolina will assume the lead role for the Chemtronics Site. In order to allow this transfer, the Chemtronics Superfund Site needs to be deleted from the NPL. The NPL is a list of all Superfund sites. The deletion process will. follow the requirements specified in the Agency's October 9,1989 deferral policy. WHAT TO EXPECT NEXT The next major milestone is forNCDENR to issue an enforcement document which legally commits the signatories to continue Site/environmental restoration at the Chemtronics facility under RCRA. Once this document is in place, the Agency will issue the Superfund Site Closeout Report followed by the preparation of the deletion docket. The Agency will then issue a "Notice of Intent to Delete," which initiates a 30-day public comment period. The last step is the publication of the "Notice of Deletion" in the Federal Register by the Agency. During this same timeframe, NCDENR plans to hold several public meetings. The DEVELOPER desires, to construct a wastewater collection system with pumps, wastewater treatment works, and/or disposal facilities (hereinafter Disposal System) to provide sanitary sewage disposal to serve the Development on said lands. 3. The DEVELOPER has applied to the COMMISSION for the issuance of a permit pursuant to G.S. 143- 215.1 to construct, maintain, and operate the Disposal System. 4. The DEVELOPER has created or shall create unit ownership in said dwellings units, other improvements and lands through filing of a Declaration of Unit Ownership (hereinafter Declaration), pursuant to Chapter 47C or 47F of the North Carolina General Statutes. The DEVELOPER has caused to be formed or will cause to be formed at the time of filing of the Declaration, the (Enter Proposed Unit Owners' Association) (hereinafter Association), a non-profit corporation organized and existing under and by the virtue of the laws of the State of North Carolina, for the purpose, among others, of handling the property, affairs and business of the Development; of operating, maintaining, re -constructing and repairing the common elements of the lands and improvements subject to unit ownership, including the Disposal System; and of collecting dues and assessments to provide funds for such operation, maintenance, re -construction and repair. 6. The COMMISSION desires to assure that the Disposal System of the Development is properly constructed, maintained and operated in accordance with law and permit provisions in order to protect the quality of the waters of the State and the public interest therein. NOW, THEREFORE, in consideration of the promises and the benefits to be derived by each of the parties hereto, the COMMISSION and DEVELOPER do hereby mutually agree as follows: The DEVELOPER shall construct the Disposal System in accordance with the permit and plans and specifications hereafter issued and approved by the COMMISSION, and shall thereafter properly operate and maintain such systems and facilities in accordance with applicable permit provisions and law. 2. The DEVELOPER shall not transfer ownership and/or control of the Disposal System to the Association until constriction has been completed in accordance with the permit and approved plans, and the staff of the Division of Water Quality has inspected and approved of the facilities. In order to change the name of the permit holder, the DEVELOPER must request that the permit be reissued to the Association. The request must include a copy of the Association Bylaws and Declaration. The DEVELOPER shall not transfer, convey, assign or otherwise relinquish or release its responsibility for the operation and maintenance of its Disposal System until a permit has been reissued to the DEVELOPER's successor. NPDES Permit Number NC0087602 carried an expiration date of October 31, 2007. Renewal of NPDES Permit Number NC0087602 was never requested and therefore the permit is no longer a valid authorization to discharge. . On August 4, 2006 Authorization to Construct Number 087602A01 was issued to the Whittier Sanitary District for construction of a, wastewater treatment plant in the Whittier community. The sewage and wastewater collected by this system shall be treated in the Metropolitan Sewerage District of Buncombe County's Wastewater Treatment Facility (Permit No. NC0024911) prior to being discharged into the receiving stream. Construction of the subject wastewater collection system shall not commence until approval for the construction and operation of these sewers has been obtained from the Metropolitan Sewerage District of Buncombe County. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an. adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Ambient samples were collected on November 18 and 21 by Keith Haynes for use in a chronic Ceriodaphnia dubia pass/fail toxicity test. The test using these samples resulted in a pass.
