APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 71
linear feet of two unnamed tributaries to Beaver Creek in order to improve SR 1182 (Mash Road) in Ashe
County.. The project must be constructed in accordance with your application dated July 18, 2002
(received July 23, 2002). After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification No. 3375, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits
before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying
404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and submit a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and adhere to the requirements contained in "Sedimentation and Erosion Control
Guidelines for Sensitive Watersheds" [ 15A NCAC 4B .0124 (a) - (d)] prior to any ground-disturbing
activities to minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous
vegetation shall be planted on all bare soil within 10 days of ground-disturbing activities to provide
long term erosion control. These streams are subject to special management conditions and drain to
Outstanding Resource Waters according to the DWQ stream classification schedule.
2. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, or other conditions as determined by the
North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
3. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
4. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.

5. The dimension, pattern, and profile of the stream and floodplain above and below each structure shall
not be modified by widening the stream channel or reducing the depth of the stream.
6. All work shall be performed during low flow conditions.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
8. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
9. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the 401/Wetlands
Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N. C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The NC Department of Transportation is scheduled to grade, drain, base and pave SR 1182 in
Ashe County. Total project length is approximately 0.66 miles. The roadway will be widened
from 16 feet to 18 feet. Impervious surface area will increase by 0.16 acres or 4%. This project
will require the replacement of two (2) wet cross lines as shown below:
1) Replace existing 34'x 24" CMP at station 6+53 with a 60'x 36" CMP.
2) Replace existing 30'x 24" CMP at station 29+67 with a 55'x 24" CMP.
Miscellaneous rip-rap impacts will total 20 linear ft. or less. New stream impacts = 71 linear ft.
*X Please note that the wet pipe at station 6+53 is currently perched approximately 2 feet.
Burying this pipe 20% would create a slope too steep to accommodate aquatic life passage
and would likely result in a blowhole on the outlet end. As a result, we will place the new
pipe as low as possible but it probably will not be buried 20%.
Construction of this project will require impacts to waters of the United States in the New River
Basin. The above noted wet cross lines carry different unnamed tributaries to Beaver Creek
(Class: C, Trout +). The Division 11 Environmental Officer reviewed this project for the
presence of threatened and endangered species on June 5, 2002. This project will have no effect
on any federally listed endangered plant or animal species. According to the NCDOT web site,
the NCDOT Historical Architecture Section has reviewed this project and determined that there

are no NR/SL/DOE properties along this roadway that will be impacted by the proposed project
(see attachment).
The project impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the
erosion control measures outlined in the attachments to this application, downstream water
quality standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. Please note that a trout buffer zone
encroachment variance will be requested from stations 8+00 -18+50 (Beaver Creek).
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetlands Unit, for her review. It is
requested that any comments related to the 401 certification be forwarded directly to me with a

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing roadway must be widened to achieve an acceptable section width, thus increasing
public safety. The existing pipes must be replaced for the same reason. By utilizing
the erosion control measures as shown in the attached drawings adverse impacts to streams in
the area will be minimized Since this is an existing roadway, the stream impacts cannot be
avoided However, the replacement pipe lengths will be the minimum needed to construct the
widened roadway. All appropriate BMPs will be used during construction.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be installed before
clearing and grubbing operations begin.
(2) As construction progresses, temporary and permanent erosion control
devices shall be installed in a timely matter, according to any special permit
requirements and or requirements set out in G. S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S.113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be accomplished within 15
working days or 30 calendar days following completion of
construction or development, whichever period is shorter, except
as provided in 15A NCAC 413.0024 (e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G. S. 113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be provided for any portion of a
land-disturbing activity in a HQW zone within 15 working days or 30
calendar days following completion of construction or
development, whichever period is shorter.
(3) All siltation and erosion control devices shall be properly maintained until no
longer needed.
(4) On projects performed by D.O.T. Maintenance Forces, request will promptly
be made to the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on the condition of established
ground cover of that area the device is serving.
HIGH QUALITY WATERS
1. Uncovered areas are limited at any given time to a maximum total area of
20 acres.
2. Erosion and sedimentation control measures shall be designed to provide
protection from the 25-year storm.
3. Large Type-A basins shall be designed and constructed with a settling
efficiency of at least 70% for the 40 micron soil particle size transported
by runoff from the 2-year storm.
4. Newly constructed channels shall be constructed with side slopes no
steeper than 2:1, unless slopes are to be stabilized by methods other than
vegetation
5. A ground cover sufficient to restrain erosion must be provided for any
disturbed area.

RIP RAP MATERIALS
1042-1 PLAIN IZIP IZAI'.
Stone for plain rip rap shall consist of field stone or rough unhev. n gtiarry
slone_ The stone shall be sound, tough, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Wliere broken concrete from demolished structures or pavement is avail-
able, it may be used in place of stone provided that such use meets with the
approval of the Engineer'..llo\vever', the use of broken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements.
1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds.
At least 30 per-cent of the. total weiglrt of the rip rap shall be in
individual uieces weighing a minimum of 60 pounds each. Not more
than 10 percent of tilt', total Weight, of the rip rap may be in in
pieces weighing less than 15 bounds each.

pounds. At least 60 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of 100 pounds each. Not more

SUBJECT: North Carolina Department of Transportation (NCDOT), SRI 182, Mash
Road, Unnamed Tributaries Beaver Creek (Class C, Trout +), Ashe
County
These comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina
Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT
proposes to grade, drain, base and pave the referenced road.
The project will widen the existing roadway from 16' to 18' and require two (2) wet cross
lines. Impacts will occur at stations 6+53 and 29+67. Total additional impacts
associated with the two cross lines will be 71 linear feet. Piping is perched at station
6+53. This pipe will remain perched after construction. Brook trout are known to be in
associated drainages.
We will not object to the project provided the following conditions are implemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the brown and brook trout spawning season of October 15
through April 15 to protect the egg and fry stages of trout from off-site
sedimentation during construction.
2. Except as indicated above, culverts less than 48 inches in diameter should be
buried to a depth equal to or greater than 20% their size to allow for aquatic life
passage. These measurements must be based on natural thalweg depths. The
pipes should be large enough so that waters can flow through without freefalling
or damming on either end during low flow conditions to maintain aquatic life
passage. The dimension, pattern, and profile of the stream above and below the

pipes should not be modified by widening the stream channel or reducing the
depth of the stream. Previously disturbed floodplains and streams should be
restored to natural geomorphic conditions whenever practicable. {Note: If
possible during construction, perched piping should be avoided due to brook
trout's ability to live in small tributaries and current drought conditions. }
3. If concrete will be used, work must be accomplished so that wet concrete does not
contact stream water. This will lessen the chance of altering the stream's water
chemistry and causing a fish kill.
4. Heavy equipment should be operated from the bank rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of
introducing other pollutants into the stream.
5. Sediment and erosion control measures shall adhere to the design standards for
s s tivc %vatersbeds (15A NCAC 4B .0024).
6?empora>y or permanent herbaceous vegetation should be planted on all bare soil
within 10 days of ground disturbing activities to provide long-term erosion
control. We encourage NCDOT to utilize onsite vegetation and materials for
streambank stabilization when practicable.
