APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 173
linear feet of Silas Creek and Old Field Creek and their unnamed tributaries, as well as an unnamed
tributary to North Fork New River, in order to improve SR 1541 (Landmark Church Road) in Ashe
County. The project must be constructed in accordance with your application dated July 2, 2002
(received July 5, 2002). After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Nos. 3366 and 3375, corresponding to the U.S. Army Corps of
Engineers Nationwide Permit Numbers 33 and 14. In addition, you must acquire any other federal, state
or local permits before you proceed with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change,. you must notify the DWQ in writing and submit a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A
NCAC 4B .0024) prior to any ground-disturbing activities to minimize impacts to downstream
aquatic resources. Temporary or permanent herbaceous vegetation shall be planted on all bare soil
within 5 days of ground-disturbing activities to provide long term erosion control. These streams are
subject to special management conditions and drain to Outstanding Resource Waters.
2. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, or other conditions as determined by the
North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
3. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
4. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.

5. The dimension, pattern, and profile of the stream and floodplain above and below each structure shall
not be modified by widening the stream channel or reducing the depth of the stream.
6. All work shall be performed during low flow conditions.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
8. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
9. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the 401/Wetlands
Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to grade, drain, base and pave SR 1541 in
Ashe County. Total project length is approximately 1.6 miles. The existing roadway width will
remain at 18'. This project will require the replacement of four (4) wet cross lines as shown
below:
1) Replace existing 20'x 82" CMP at station 2+18 with a 50'x 103"x 71" CSPA with a
concrete headwall.
2) Replace existing 37'x 18" CMP at station 18+67 with a 75'x 24" CSP.
3) Replace existing 50'x 36" CMP at station 41+16 with a 65'x 48" CSP.
4) Replace existing 20'x 60" CMP at station 85+12 with a 50'x 72" CSP with a concrete
headwall.
Miscellaneous rip-rap impacts will total 60 linear ft. or less. New stream impacts =173 linear ft.
** Please note that the wet pipe at station 41+16 carries water from a pond overflow pipe. This
overflow pipe is currently perched and as a result, upstream aquatic life passage is obstructed
at this location.
Construction of this project will require impacts to waters of the United States in the New River
Basin. The above noted wet cross line at station 2+18 carries Silas Creek (Class: C, Trout). The
wet pipe at station 18+67 carries a small unnamed tributary to Silas Creek. The wet pipe at
station 41+16 carries an unnamed tributary to the North Fork of the New River (Class: C+). The
wet pipe at station 85+12 carries Old Field Creek (Class: C+). The Division 11 Environmental

Officer reviewed this project for the presence of threatened and endangered species on June 19,
2002. This project will have no effect on any federally listed endangered plant or animal species.
According to the NCDOT web site, the NCDOT Historical Architecture Section has reviewed
this project and determined that there are no NR/SL/DOE properties along this roadway that will
be impacted by the proposed project (see attachment).
Replacing the wet pipes at stations 2+18 and 85+12 will require temporary dewatering.
Impervious sandbag dikes will be constructed approximately 20 feet upstream of the existing
pipes at both locations. Clean water will temporarily be pumped around both construction areas
and will be discharged into a buffer area located approximately 90 feet downstream of the
sandbag dikes at both sites. Any dirty water located inside the construction areas will be pumped
into a silt bag. The dewatered area at station 2+18 will total approximately 630 square feet or
0.014 acres. The dewatered area at station 85+12 will total approximately 450 square feet or
0.01 acres. Once the new structures are in place, the impervious dikes will be removed and
preconstruction streambed elevations will be restored.
The project impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the
erosion control measures outlined in the attachments to this application, downstream water
quality standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. Please note that a trout water buffer zone
encroachment variance will be requested from stations 2+50 - 13+00 (UT to Silas Creek).
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetlands Unit, for her review. It is
requested that any comments related to the 401 certification be forwarded directly to me with a
copy sent to the US Army Corps of Engineers.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing _typical section width must be increased to improve public safety. The existing -
pipes must be replaced for the same reason. By utilizing the erosion control measures as shown
in the attached drawings, adverse impacts to streams in the area will be minimized Since this is
an existing roadway, the stream impacts cannot be avoided. However, the replacement pipe
lengths will be the minimum needed to construct the road. All appropriate BMPs will be used
during construction.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

CONSTRUCTION SEQUENCE FOR INSTALLING ROADWAY CULVERTS
1 - Clear only enough area and install the downstream measures such as silt check dams,
silt screens, and basins as noted on plans.
2 - Excavate the 2' base tail ditch.
3 - Excavate and install the roadway culvert.
4 - Install sediment control measures at inlet as noted on plans.
5 - install additional pipe outlet protection and inlet protection as noted.
EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be installed before
clearing and grubbing operations begin.
(2) As construction progresses, temporary and permanent erosion control
devices shall be installed in a timely matter, according to any special permit
requirements and or requirements set out in G. S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S.113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be accomplished within 15
working days or 30 calendar days following completion of
construction or development, whichever period is shorter, except
as provided in 15A NCAC 413.0024 (e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G. S.113A-57 (3) provisions for a ground cover
sufficient to restrain erosion must be provided for any portion of a
land-disturbing activity in a HOW zone within 15 working days or 30
calendar days following completion of construction or
development, whichever period is shorter.
(3) All siltation and erosion control devices shall be properly maintained until no
longer needed.
(4) On projects performed by D.O.T. Maintenance Forces, request will promptly
be made to the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on the condition of established
ground cover of that area the device is serving.

RIP RAP MATERIALS

10 42-1 PLAINT

Where broken concrete from demolished structures or pavement is avail-

HIGH QUALITY WATERS
1. Uncovered areas are limited at any given time to a maximum total area of
20 acres.
2. Erosion and sedimentation control measures shall be designed to provide
protection from the 25-year storm.
3. Large Type-A basins shall be designed and constructed with a settling
efficiency of at least 70% for the 40 micron soil particle size transported
by runoff from the 2-year storm.
4. Newly constructed channels shall be constructed with side slopes no
steeper than 2:1, unless slopes are to be stabilized by methods other than
vegetation
5. A ground cover sufficient to restrain erosion must be provided for any
disturbed area.
