RHODES, AICP DIRECTOR This is to advise you that the Pitt County Technical Review Committee conditionally approved the soil erosion and sedimentation control plan and stormwater plan for TURNBERRY on August 12, 2020. Conditions and requirements as a part of this approval are attached below. Copies of the draft minutes from the meeting will be available upon request prior to the next Technical Review Committee meeting. As stipulated on the financial responsibility form, you are responsible for ensuring compliance with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control Ordinance. Your primary objectives include, but are not limited to, preventing offsite sedimentation, preventing sediment from entering watercourses, and establishing vegetation on all disturbed areas within 7-14 calendar days, following any completion of a phase of grading. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.nc.gov/NCGO1. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Please be aware that your project will be covered by requirements of the NPDES Construction Stormwater General Permit NCGO10000. Please become familiar with all the requirements and conditions of this permit in order to achieve compliance. Upon discovery of noncompliance by our office, the following actions may be taken: No further permits for building or other construction will be issued. 2. The authority to continue construction, other than for erosion control measures, will be terminated. 3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately comply upon notice of noncompliance will result in injunctive and/or criminal action. Other Comments: 4. This erosion control plan shall expire three years following the date of approval if no land disturbing activity has been undertaken. 5. The Division of Water Quality may pursue legal action against you in order to enforce requirements of the NPDES, Phase II permit. 6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes County officials to inspect sites to ensure compliance with the Sedimentation Pollution Control Act. Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. Land disturbance shall not begin until a preconstruction meeting has taken place. Existing ditch along Lots 10-14 needs labeling. 3. Install additional silt fence along northern limits of disturbance on Lots 38 through 42. 4. Ditch along rear of Lots 6 through 14 cannot discharge into riparian buffer unless sheet flow is achieved or ditch is existing. [Pitt County Emergency Management] 5. Lots must be within 400' of a fire hydrant, per Emergency Management at the direction of the State Fire Marshal. [NCDOT] 6. A nonaccess easement shall be placed along lots 1,2, and 42-46 along the NCDOT ROW. An access to the cemetery on lot 44 may remain. 7. Connection to existing waterline should be constructed to not have any valves within the proposed pavement sections or invade 1:1 slope from EOP. 8. Additional ROW or Public Utility Easement should be placed at the street connection to Ivy Road and any internal intersection (more than 10'x70'sight triangles) 9. NCDOT driveway permits and encroachments will be required. 10. There is a PNG permanent easement within this plan. NCDOT will need recorded ROW specific to this area. NCDOT recognizes this easement and has no concerns with its placement in the proposed NCDOT ROW. NCDOT would like the Engineer to be mindful of NCDOT requirements for utility crossings within NCDOT ROW and the roadway design should be such that PNG facilities are expressly protected for design and during construction activities. 11. Waterline should be constructed within 5' or less of the ROW line as with any utility installed. [Pitt County Environmental Health] • A soil analysis map showing proposed septic and repair areas has been received and is on file. • Each lot will be evaluated in accordance with rules .1940 of the Laws and Rules for Sanitary Sewage Collection, Treatment, and Disposal (15A NCAC 18A .1900). • All lots are required to have been permitted or a soil engineer's report must be on file with Environmental Health. • No fill material (including construction spoils) is allowed on any area to be used for a sewage disposal system or 100% repair area. Any amount of fill found on these areas will be grounds for disapproval of the proposed lot. • The location of any proposed berms must be shown on all subsequent maps. The final dimensions of the completed berm must be shown so that the Environmental Health staff can verify that no portion of any berms will interfere with the sewage system or 100% repair locations. • Locations of any soil stock pilings should be shown on the construction plan. These stock pilings should be placed in an area not to be utilized for on -site sewage disposal. • If underground electrical lines or natural gas lines cross the property at any point, they must be flagged by ULOCCO before the site is evaluated by the Environmental Health staff. • The location of any existing or proposed drainage tile must be field located and shown of a surveyed map provided to Environmental Health staff. • A backhoe may be required for the site evaluations (15A NCAC 18A .1939(b)). • Any riparian buffers or floodways must be noted on subsequent maps. [General Comments] Soils located on site include Bb, By, GoA, GoB, Ly, NrB, NrB2, Ra, OcB, and WaB, and possess the following characteristics: ■ Seasonal high water table (Bb, By, GoA, GoB, Ly, Ra, and OcB) ■ Slow Permeability (By) ■ Flooding or Ponding (Bb, Ra) ■ High shrink -swell potential water (By) ■ Unstable for trenching 4 feet or more (Bb) ■ Juniper Branch Watershed ■ Soils are prime farmland or have statewide importance for farming. Development will remove the site from agricultural production. ■ The site is currently in woods. Development will remove the site from future timber production. ■ Development abuts a channel with an existing easement. ■ Sub surface drain tile is located on site with a map on file.
