Please note, the virtual site visit is scheduled for this Friday at 1pm. The below referenced FINAL As -Built Monitoring Report review has been requested by Environmental Banc & Exchange, LLC. Per Section 332.8(o)(9) of the 2008 Mitigation Rule, this review follows the streamlined review process, which requires an IRT review period of 15 calendar days from this email notification. Please provide any comments by 5 PM on the 15-day comment deadline shown below. When providing comments please indicate if your concerns are great enough that you intend to request an ADDITIONAL site visit prior to the as - built release. Comments provided after the 15-day comment deadline (shown below) may not be considered. At the conclusion of this comment period, a copy of all comments will be provided to Environmental Banc & Exchange, LLC and the NCIRT along with District Engineer's intent to approve or disapprove this Final As -Built and as -built implementation credit release. RES calculated the effect of this change during preparation of the As - Built Baseline Monitoring Report, and we wish to present this information here in support of a modification. The Mitigation Plan and As -Built Credits are shown in Table 1. Table 1. During permitting and design, RES had designed UT2-C to tie into a channel along the property boundary with an adjacent landowner, which would have required minor grading/land disturbance impacts on their property. The adjacent property owner was in support of the original design, and both parties reached a verbal agreement for a temporary construction easement. Unfortunately, the written agreement was never completed due to unforeseen concerns from the adjacent property owner. The need for the change arose due to this failed negotiation to establish a temporary construction easement. Fortunately, RES was able to revise the design to eliminate the need for a temporary construction easement by realigning the stream to meet Back Creek without the need for grading on the adjacent property owner's parcel. In doing so, this change increased the length of the UT2-C alignment within the easement by 84 linear feet as well as eliminated an impact to Wetland F, preserving 0.02 acre of wetlands. Figure 1 presents a visual to summarize the change from design to as -built. Figure 1. Showing proposed UT2-C in yellow and as -built condition in blue. Overall, the net difference in stream lengths between mitigation plan and as -built was an increase of 71 linear feet. After running the Non -Standard Buffer Width Tool on the as -built, the total project stream credits increased by 78. Project wetland credits remained the same as proposed in the mitigation plan: 8.20 WMUs. RES herby requests a modification to use the as -built credit yield for this site instead of Mitigation Plan credits as the changes were due to design considerations and not a result of construction or survey inconsistencies.
