Subject: Stanly County. Widen NC 24-27 from Canton Road to NC 740. Federal Aid
Project No. STP-24(2), State Project No. 8.T680301, TIP Project No. R-2530A.
On June 21, 1999, the North Carolina Department of Transportation (NCDOT) submitted a
request for verification of Nationwide Permit (NWP) 23 for the widening of NC 24/27 from
Canton Road to NC 740. The NWP 23 verification (I.D. #199931256) was received on October
4, 1999. As described in the original submittal, the proposed project consists of widening the
existing facility to a five-lane curb and gutter highway, however, the original stream and wetland
impacts were calculated as 897 linear feet of stream and 0.272 acres of jurisdictional wetland
impacts. The design for the project has not changed; however, an additional 19 linear feet of
stream impacts were calculated at Site 7, for a total stream impact of 916 linear feet. This
request for a modification, therefore, addresses changes in the length of total stream impacts and
the proposed mitigation. A summary of all stream and wetland impacts is included in Table 1.

Impact in wetland due to mechanized clearing beyond construction limits.
In the June 21, 1999 application letter, NCDOT had originally proposed 224 ft of stream channel
relocation for on site mitigation credit. A stream analysis by Richard Scarce & Associates and
the NCDOT hydraulics section indicates, however, that Sites 6 and 7 are not good candidate sites `
for natural stream relocation. We therefore propose crediting all stream mitigation requirements
from the Shepards Tree Mitigation Site. The study results are as follows:
L-Station 55+60 (Site 6): Based on the absence of observed biological function for the
intermittent stream located at Site 6, NCDOT does not propose mitigation for the
resulting 43 m (141 ft) of construction impacts. Additionally, approximately 15 m (53 ft)
of stream relocation are being proposed. Due to the angle of the incoming stream to the
proposed roadway fill slope, two near 90 degree bends are needed to change the stream
channel to the proposed pipe extension. With a 10 year storm discharge of 160 cfs and a
resulting 10 year storm velocity of 11 fps, rip rap is required, as a minimum, at least in
the bends. Rip rap is also required in the channel at the outlet of the 40005 pipe. This
leaves only about a 2 m (6.5 ft) portion of stream that could be designed with natural
channel techniques. Such a small amount does not warrant consideration for natural
channel restoration.
L-Station,57 + 40 rt (Site 7): Currently, approximately 52 m (171 ft) of stream relocation
is proposed. Only 28 m (91 ft) of stream does not require rip rap. Proposed excavation
of possible flood prone area has been shown on provided attachment. The additional
excavation will result in the clearing of about 0.2 acres of existing hardwoods and woody
vegetation. The clearing could create an adverse impact by increasing potential erosion.
Based on these facts, NCDOT proposes crediting all stream mitigation requirements from the
Shepherds Tree Mitigation Site in Iredell County. Proposed mitigation ratios again include 1:1
stream mitigation ratios for impacts occurring at Site 8, and 2:1 stream mitigation ratios for
impacts occurring at Site 7. Total proposed stream mitigation requirements are 968 feet [Site 7
(2 x 259 ft) + Site 8 (1 x 450 ft)].

In addition to the standard Nationwide Permit #23 Conditions, the General Nationwide Permit Conditions,
Section 404 Only Conditions, Regional Conditions, State Consistency Conditions, General Certification
Conditions, and Section 401 Conditions of Certification, the following special commitments have been agreed to
by NCDOT:
Commitments Developed through Project Development and Design
The status of these commitments is shown in Italics.
Division 10 Engineer/Structures Unit/Roadside Environmental
All practical and standard procedures and measures, including Best Management Practices will be implemented to
avoid or minimize environmental impacts to the human environment.
Division 10 Engineer/Hydraulics Unit
Because this project will involve crossing a regulated floodway, NCDOT,will coordinate with the Federal
Emergency Management Agency and local authorities to ensure compliance with applicable floodplain
ordinances. A floodway modification has been prepared for Poplin Creek at US 52. Coordination with the
Federal Emergency Management Agency Authorities has occurred. The Hydraulic Design Unit received
approval from the Federal Emergency Management Agency on March 23, 1999.
Commitments Developed through Permitting
Division 10 Engineer/Hydraulics Unit
In order to allow for the continued passage of aquatic organisms, the bottom of the authorized pipes and box
culverts will be buried 1 foot below the existing bed of the stream channel.
PD&EA Unit
The permittee shall mitigate for unavoidable impacts to perennial stream channel associated with this project by
utilizing 968 linear feet of successfully restored stream channel at the Shepherds Tree Mitigation site in
accordance with the permittee's "Shepherds Tree Mitigation Plan, Iredell County, North Carolina, State Project
No. 6.76900 IT, TIP No. R-2239" dated February 1, 1999. In order to be considered successful, the stream
restoration success of this mitigation plan must be met. Monitoring of restored streams will be implemented and
the property will be preserved in perpetuity according to this plan. The permittee will provide a survey
identifying the location of the 968 feet of channel that will satisfy this mitigation requirement.

Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.247 acres of wetlands and 897 linear feet of streams for the purpose of constructing the above
referenced project. Further the authorization permits impacts to 0.025 acres of jurisdictional wetlands
resultant from mechanized clearing activities. The widening of NC 24/27 from Canton Road to NC 740 in
Stanly County should be constructed as described in your application dated June 21, 1999. After reviewing
your application, it is our determination that your proposed activities are covered by General Water Quality
Certification Number 3197. Certification 3197 corresponds to Nationwide Permit Number 23 issued by the
Corps of Engineers. Prior to initiating any work in jurisdictional areas you should obtain the necessary
permit(s) from the Corps of Engineers as well as any other, federal, state or local permits, including (but not
necessarily limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 permit expires, unless otherwise
specified in the General Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby
responsible for complying with all the conditions. Since the proposed fill is in excess of 150 linear feet of
stream length, compensatory mitigation is required as described in 15A NCAC 2H.0506 (h) (6) and (7). ).
For this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
Additional Conditions:
1) The plan for construction of the Sheppard's Tree Mitigation Site needs to be completed and approved by
the NCDWQ within one year of issuance of the 401 Water Quality Certification,
2) All stream relocations will be constructed in accordance with the NCWRC stream restoration guidelines
as specified in the 404 permit issued by the Corps of Engineers.

The permit application proposes 897 linear feet of impacts to streams. 149 linear feet of
relocated stream will be considered as acceptable onsite mitigation. The relocated streams shall
be constructed according to the information presented in your application and should adhere to
NC-RC standards for stream restoration. Based on the aforementioned information, 748 linear
feet of stream mitigation is required for the proposed project. We understand that you will
credit the Sheppard's Tree Mitigation Site for the 748 linear feet of required mitigation. For
accounting purposes, this Certification authorizes the fill of 897 linear feet of streams in the
Rocky River Basin in Cataloging Unit 03040105.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.

On December 30, 1999, NCDOT submitted a permit modification of a Nationwide
Permit 23 (ID # 199931256) for the widening NC 24-27 from Canton Road to NC 740 in Stanly
County,. North Carolina. As described in that permit modification, the proposed project would
result,in stream and wetland impacts including 916 linear feet of surface water and 0.272 acres of
jurisdictional wetlands. It has since been determined that two temporary causeways will be
needed for construction access to facilitate the placement of drilled shafts for Bridge 39 over
Long Creek (DEM# 13-17-31, Class C) and Bridge 46 over Little Long Creek (DEM # 13-17-31-
1, Class Q. Consequently, NCDOT will require a Nationwide Permit 33 for the proposed
activity.
STREAM IMPACTS
Temporary fill resulting from the proposed causeways for Bridges 39 and 46 will include
131 yd3 and 92 yd3, respectively, of Class II riprap. The resulting surface area impact will be
0.032 ac and 0.02 ac, respectively, for a total of 0.052 acres. Construction for each bridge will
consist of widening the existing structure. There is no incidental fill anticipated for the proposed
project.
RESTORATION PLAN
Restoration Plan: The materials used to construct the temporary causeway will be removed to an
upland location once the new bridge and approaches are complete. The stream will be restored
to its original condition and fill areas will be graded back to the original contours. Elevations
and contours near the proposed stream crossing are available from the field survey notes.

Restoration Schedule: The project was let to construction on December 19, 2000, with work
commencing on, January 29, 2001. It is expected that the contractor will place the temporary
access as soon as possible. The temporary access will remain in place for approximately 3
months at each bridge.
Disposal Plan: The contractor will use excavating equipment to remove the rip rap used for the
causeway. All material placed in the creek will be removed from the creek. All causeway
materials not reused on the end bent slopes shall become the property of the contractor. The
contractor will be required to submit a reclamation plan for removal and disposal of all unused
materials.
REGULATORY APPROVALS
In addition to the previously requested Nationwide Permit 23, NCDOT requests a
authorization for the additional impacts under a Nationwide Permit 33 in accordance with the
Federal Register of December 13, 1996, Part VII; Vol. 61, No. 241. Attached for your
information are a copy of the Preconstruction Notification (PCN) and Permit drawings for the
subject project. Additionally, a request is made to the Division of Water Quality by copy of this
application for the appropriate 401 Water Quality Certification.
