APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Hunsinger:
You have our approval, in accordance with the attached conditions and those listed below, to impact
20 linear feet of Little Matrimony Creek for the purpose of replacing one 60-inch corrugated metal
pipe under SR 1514 (Hutchinson Road) in Rockingham County. The project should be constructed in
accordance with your application dated 2 March 2001 (received 14 March 2001). After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification No.
3289 corresponding to the U.S. Army Corps of Engineers General [Regional] Permit Number
198200031. In addition, you should acquire any other federal, state or local permits before you
proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change,'you must notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below:
• Placement of culverts and other structures in waters, streams, and wetlands must be placed below
the elevation of the streambed to allow low flow passage of water and aquatic life
• Existing stream dimensions are to be maintained above and below locations of culvert extensions.
Use of rip-rap for bank stabilization is to be minimized; rather native vegetation is to be planted -------
when practical
• Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for
stormwater sheet flow.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and
binding unless you ask for a hearing.

Hutchinson Road (SR 1514)
Dear Mr. Alsmeyer:
The North Carolina Department Of Transportation (NCDOT) proposes to replace one (1) line of 41-
feet long 60-inch CM pipe with one (1) 60-feet long 84-inch x 55-inch CM pipe arch as part of a
project to convert Hutchinson Road from a gravel surface to a paved surface road. Replacement
with a new pipe is necessary to bring the road up to current construction standards and increase
safety. No Wetlands, High Quality Waters, or Outstanding Resource Waters occur in the project
area. No federally protected aquatic species were observed during a survey conducted on November
29, 2000 by Tim Savidge and Lenwood Smith, II and no protected terrestrial species were observed
during a survey conducted on October 4, 2000 by Lenwood Smith, II.
The NCDOT anticipates that this activity will be authorized under General Permit 19820031.
Enclosed please find the project site map and the pre-construction notification form for the above
referenced projects. By copy of this letter we are also requesting a General Water Quality
Certification #3289 from the NC Division of Water Quality. Construction is anticipated to begin in
June.

Replacement of one line of 40' long 60" CM pipe with 60' of 84" x 55" pipe arch resulting in 20 linear
feet of impact to a perennial stream.

Hutchinson Road (SR 1514 ) from a gravel surface road to a paved surface road to improve safety
and traffic flow.

The pipe is substandard for protect improvement. In addition the activity is part of a linear project where
waters of the Unites States cannot be avoided.

Construction Sequence and Erosion Control Plans for Pipe
Replacement with Pipe Rockingham County SR -1514
We are scheduled to start in May.
Construction is anticipated to takelweeks. IJ.-I., C ?
3 1. Dig a diversion channel to dewater the construction area. The diversion channel will
be approximately the same width as the existing channel width.
2. Line the channel with plastic to prevent sediment from the diversion channel.
. Install silt dams to allow water to flow into the diversion channel.
4 Install a rock silt dam downstream of the diversion channel outlet to prevent
incidental downstream sediment loss from the diversion channel.
5. Breach the inlet and outlet dams of the diversion channel.
6. Remove existing line of 40' long 60" CM pipe.
7. Excavate to sufficient depth to allow burial of the pipe to 1', place base stone, and
single line of 60' long 84" X 55" CM pipe arch.
8. Backfill this line and place rip-rap at ends.
9. After the new pipe is placed, ABC aggregate will be placed at each end of the pipe
forcing the flow through the pipe. The diversion channel will then be dewatered and a
suitable backfill material will be placed and compacted.
10. Upon completion of the construction activity, notify landscape department for final
seeding.
11. Silt fences to be placed as site conditions require.
12. PROVIDE SPECIFICATIONS. A 10'x 15' "dirt bag" will be used for dewatering.
13. Site conditions and weather may alter these plans. _
