You are correct about the new ditches replacing the existing ones. We have included sufficient BMPs on our erosion, sediment and pollution control plans to address them. We have also prepared a very comprehensive erosion, sediment and pollution control plan for the remaining portions of the project site. You are also correct about the proposed concrete headwalls. The existing culverts do not have headwalls at all. We did propose to add concrete headwalls to the ends, but if it causes permitting complications, we can use riprap instead. Our goal is to avoid a long permitting process (i.e. NC DENR WQ Permit, ACOE Permits, etc) as the contractor is scheduled to mobilize within the next 30 days. If we replace the concrete headwalls with riprap, will we be permitted to move forward with the Express Permit Review Process with Land Quality? Please let me (as well as Brad and Karyn) know as soon as possible. I was hoping to have our initial review meeting next week. Thanks. I checked this over with Brad last Friday after we spoke ...while looking at the plans I realized there were two (?) new stormwater outfalls being constructed with the grading of two new ditches. Since these ditches replace the old ones, these will need to provide BMP's for nutrient reduction and diffuse flow prior to entering the buffer. Also, please make sure this is done for all the grading which may create new stormwater outfalls... In addition, after our conversation 1 was thinking the headwall of the existing culvert would be secured using rip rap on top of existing grade which would be exempt as protection of an existing structure. It appears the headwall is going to be a concrete installation, which would constitute additional disturbance of the riparian buffer, and possibly the stream channel. Check with Thomas Brown at the Corps regarding impacts to the stream channel ...you can reach him at 919 554 4884 x 22. Both of these activities are Allowable under the Neuse Buffer Table of Uses. You will need to submit our PCN to account for the nutrient reduction of the stormwater outfalls and include the sqft of the disturbance to account for headwall installation. Also, if Thomas indicates you need a nationwide then you'll want to include that on the PCN. I just want to confirm the scope of the project with you and Martin that the proposed improvements do NOT include extensions of either culverts that carry the blue line streams. I was told by John Holley as part of my pre-design due diligence, that this project would likely fall under the exemption for railroad crossings (related to Water Quality) if we did not extend the culverts. What I am unsure of is if you need written authorization to utilize a pump around to temporarily impact the stream, if indeed you need the pump around to construct the headwall. Land Quality cannot review/approve the project until authorization is obtained from DWQ. The good news is that DWQ also has an express program to get authorization quickly. We are about to submit our plans for this project for Express Permitting and Brad needed a determination from you as to whether or not a Water Quality Permit is required. I have attached a pdf of our grading plans for your review. Please note that the two existing culverts that cross under the rail road carry blueline streams. Our plans call for leaving the culverts intact with no additional stream encapsulation. In order to accommodate the grading associated with the additional rail siding, and so as not to require additional culvert, we are proposing the addition of headwalls at the ends of the existing culverts. In order for Brad to proceed with his permit review, he is looking for an email from you with your assessment. I would appreciate it if you would copy me on your email as well. If this assessment is correct, it appears that we must also receive a determination from the NC DENR that there are no practical alternatives to the requested use and that mitigation must be provided.
