THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division

The application provides adequate assurance that the discharge of fill material into the
waters of Deep Run Creek in conjunction with the proposed development will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate the applicable portions of Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your
application, as described in the Public Notice. If you change your project, you must notify us
and send us a new application for a new certification. If the property is sold, the new owner must
be given.a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed below. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge
and Water Supply watershed regulations.
Condition(s) of Certification:
1. Appropriate sediment and erosion control practices which equal or exceed those
outlined in the most recent version of two manuals. Either the "North Carolina
Sediment and Erosion Control Planning and Design Manual" or the "North Carolina
Surface Mining Manual" (available from the Division of Land Resources in the
DEHNR Regional or Central Offices). The control practices shall be utilized to prevent
exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh
water streams and rivers not designated as trout waters; 25 NTUs in all lakes and
reservoirs, and all saltwater classes; and 10 NTUs in trout waters);
2. All sediment and erosion control measures placed in wetlands or waters shall be
removed and the natural grade restored after the Division of Land Resources has
released the project;
3. Measures shall be taken to prevent live or fresh concrete from coming into contact with
waters of the state until the concrete has hardened;
4. Should waste or borrow sites be located in wetlands or other waters, compensatory
mitigation will be required since it is a direct impact from road construction activities;

5. Compensatory mitigation shall be done in accordance with the application letter from
DOT 6 August 1999 to credit wetland mitigation at Gurley Mitigation site at the North
Carolina Wetlands Restoration Program for the stream mitigation plus 3.61acres of on-
site restoration.
6. We understand that you have chosen to contribute to the Wetland Restoration Program
in order to compensate for these impacts to streams. In accordance with 15A NCAC
2H.0506(h). According to 15A NCAC 2H.0506(h), 2,483 feet of restoration will be
required. Until the Wetland Restoration Program receives and clears your check (made
payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not
occur. Mr. Ron Ferrell should be contacted at 919-733-5219 if you have any questions
concerning the Wetland Restoration Program. You have one month from the date of
this Certification to make this payment. For accounting purposes, this Certification
authorizes the fill of 5.95 acres of riparian wetland or 2,483 feet of streams, in
0.30502 river and subbasin and 2,483 feet of stream mitigation restoration are
required to be provided by WRP. Please be aware that the Wetland Restoration
Program (WRP) rules require rounding of acreage amounts to one quarter acre
increments (15A 2R.0503(b)).
Violations of any condition herein set forth shall result in revocation of this
Certification and may result in criminal and/or civil penalties. This Certification shall become
null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal
Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA Permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing
upon written request within sixty (60) days following receipt of this Certification. This request
must be in the form of a written petition conforming to Chapter 150B of the North Carolina
General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. If modifications are made to an original Certification, you have the right to
an adjudicatory hearing on the modifications upon written request within sixty (60) days
following receipt of the Certification. Unless such demands are made, this Certification shall be
final and binding.

PUBLIC NOTICE
THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION (NCDOT),
DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina 27611-5201 has
applied for a Department of the Army (DA) permit pursuant to Section 404 of the Clean Water
Act TO DISCHARGE DREDGED OR FILL MATERIAL IMPACTING A TOTAL OF 6.30
ACRES OF WATERS OF THE UNITED STATES, INCLUDING 5.95 ACRES OF SECTION
404 WETLANDS AND 2,483 LINEAR FEET OF STREAM, FOR CONSTRUCTION OF A
2.68 MILE BYPASS ON NEW LOCATION FROM JUST SOUTH OF DEEP RUN TO SR
1158, INCLUDING A NEW BRIDGE OVER SOUTHWEST CREEK, IN LENOIR COUNTY,
NORTH CAROLINA, TIP R-2001B, STATE PROJECT NO. 6.201014. THE PROPOSED
PROJECT CROSSES SOUTHWEST AND DEEP RUN CREEKS, UNNAMED
TRIBUTARIES, AND ADJACENT WETLANDS.
BACKGROUND:
The social, economic, and environmental impacts associated with this project have been
described in a North Carolina State Environmental Assessment (EA) dated October 30, 1990, in
a State Finding of No Significant Impact (FONSI) dated May 18, 1992, and finally, in an
Addendum to the FONSI dated June 11, 1999. According to the 25th edition of the
Transportation Improvement Program (TIP), R-2001B is scheduled for construction in 2003.
On October 10, 1994, the NCDOT submitted a Nationwide Permit application for Sections B
and C of the R-2001 project. At that time, Section C qualified for a Nationwide 26 permit with
no notification needed to the Corps of Engineers since all wetland sites impacted were under an
acre in size and above headwaters. However, three of the wetland sites were greater than one
third of an acre and thus required notification to the North Carolina Department of Environment
and Natural Resources, Division of Water Quality (DWQ) for Section 401 approval. The 401
Water Quality Certification was approved on October 19, 1994, (DEM Project # 94976). The
NCDOT attempted to let Section C twice and in each case the bids came in too high. The 401
Water Quality Certification expired in 1997. On January 15, 1998, the NCDOT submitted an
individual permit application for R-2001 B and C sections and a public notice was circulated.

The Environmental Protection Agency (EPA) responded to the public notice by letter and
stated that Section B, the Deep Run Bypass, did not appear to meet the avoidance and
minimization requirements of the Section 404 (b)(1) guidelines of the Clean Water Act and
requested NCDOT restudy further avoidance and minimization measures. As a result, NCDOT
requested a nationwide permit for Section C only. Section C of the project was let in January
1999 (Action ID No. 199811800). The permit application request for both sections was
withdrawn.
Additional avoidance and minimization measures were addressed in the 1999 Addendum to
the FONSI and include the options of increased bridge lengths and removing the existing bridge
and associated wetland fill on NC 11.
PROJECT DESCRIPTION:
The following description of the work is taken from data provided by the applicant and from
observations made during onsite inspections by a representative of the Corps of Engineers. Plans
submitted with the application show that the NCDOT proposes to upgrade one section of NC 11
from 0.2 miles south of Deep Run Creek to SR 1158. The proposed project is a 2.68 mile bypass
on new location just west of Deep Run and will be a four-lane highway with a 46 foot wide
median. The highway improvements include the construction of a new bridge across Southwest
Creek which will span 687 feet of high quality riverine wetlands. Right-of-way has been
purchased and some relocations have been completed.
The project will involve fill impacts to 0.34 acres on unvegetated waters of the United States.
These impacts to stream channels occur at 5 locations throughout the project. Culverts or pipes
will be used at stream crossings to allow for adequate hydrologic flow underneath the roadway.
Wetland impacts will occur at 4 separate sites and are both riverine and non-riverine wetland
types. Approximately 3.39 acres of forested riverine wetlands will be filled by the proposed
project and 2.55 acres of non-riverine wetlands. Wetlands adjacent to Southwest Creek are of
high quality and total 3.39 acres of forested riverine acres to be destroyed. NCDOT has
committed to bridge 687 feet of these Southwest Creek floodplain wetlands.
NCDOT proposes to mitigate for the wetland losses by removing the existing bridge and
associated fill in the Southwest Creel floodplain which will restore 3.61 acres of riverine
wetlands (See Attached Sheet 26 of 26). This on-site restoration is proposed at a 1:1 ratio which
would lower wetland impacts to 2.34 acres. The applicant proposes to compensate for the
remaining wetland impacts by restoring 4.68 acres of bottomland hardwood wetlands at the
Gurley Mitigation Site (GMS), located in Greene County outside of the project watershed. A
final mitigation plan for the mitigation site has been completed, distributed to the agencies, and is
approved. NCDOT proposed to compensate for stream losses by utilizing the Wetland
Restoration Program (WRP) to mitigate for the 2,149 linear feet of jurisdictional stream impacts.

The purpose of the work is to facilitate the completion of a major rural collector, identified by
NCDOT as a "critical connector" from I-40 near Kenansville to the Virgina State border. The
proposed project improvements are scheduled in conjunction with two other projects (R-2204
and R-2211) forming the southern leg of the connector. A site map is included with this public
notice along with the overall plans showing the proposed construction and wetland impacts. The
environmental documents and application are available for review at the Washington Regulatory
Field Office at 107 Union Drive, Suite 202, Washington, North Carolina.
The State of North Carolina will review this public notice to determine the need for the
applicant to obtain any required State authorization. No Department of the Army (DA) permit
will be issued until the coordinated State viewpoint on the proposal has been received and
reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of
Environmental Management (NCDEM) has determined the applicability of a Water Quality
Certification as required by PL 92-500.
This application is being considered pursuant to Section 404 of the Clean Water Act
(33 U.S.C. 1344). Any person may request, in writing within the comment period specified in
the notice, that a public hearing be held to consider this application. Requests for public hearing
shall state, with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of
Historic Places for the presence or absence of registered properties, or properties listed as being
eligible for inclusion therein, and this worksite is not a registered property or property listed as
being eligible for inclusion in the Register. Consultation of the National Register constitutes the
extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of
the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit. The District
Engineer, based on available information, is not aware that the proposed activity will affect
species, or their critical habitat, designated as endangered or threatened pursuant to the
Endangered Species Act of 1973.
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the
Magnuson-Stevens Fishery Conservation and Management Act. The DE's initial determination
is that the proposed project would not adversely impact EFH or associated fisheries managed by
the South Atlantic or Mid Atlantic Fishery Councils or the NMFS.
The decision whether to issue a permit will be based on an evaluation of the probable impacts,
including cumulative impacts, of the proposed activity and its intended use on the
public interest. Evaluation of the probable impacts which the proposed activity may have
on the public interest requires a careful weighing of all those factors which become relevant in
each particular case. The benefits which reasonably may be expected to accrue from the proposal
must be balanced against its reasonably foreseeable detriments. The decision whether to

authorize a proposal, and if so, the conditions under which it will be allowed to occur, are
therefore determined by the outcome of the general balancing process. That decision should
reflect the national concern for both protection and utilization of important resources. All factors
which may be relevant to the proposal must be considered including the cumulative effects
thereof. Among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in
accordance with Executive Order 11988), land use, navigation, shore erosion and accretion,
recreation, water supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in general, the needs and
welfare of the people. For activities involving the placement of dredged or fill materials in
waters of the United States, a permit will be denied if the discharge that would be authorized by
such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines.
Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be
granted unless the District Engineer determines that it would be contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any comments received will be considered by the Corps
of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal.
To make this decision, comments are used to assess impacts on endangered species, historic
properties, water quality, general environmental effects and the other public interest factors listed
above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act
(NEPA). Comments are also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army (DA) permit will
not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or
waives State certification required by Section 401 of the Clean Water Act. The NCDWQ
considers whether or not the proposed activity will comply with Sections 301, 302, 306, and
307 of the Clean Water Act. The application and this public notice for the DA permit serves
as application to the NCDWQ for certification.
Additional information regarding the Clean Water Act certification may be reviewed at
the offices of the Environmental Operations Section, North Carolina Division of Water Quality
(NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of reproduction costs.

Dear Sir:
Subject: Lenoir County, NC 11 from 0. 2 miles South of Deep Run Creek to SR 1152, By-Pass
of Deep Run, State Project No. 6.201014, T.I.P. No. R-2001B. AID 199705426.
The North Carolina Department of Transportation (NCDOT) proposes to upgrade NC 11 in
Lenoir County from 0.2 miles south of Deep Run Creek to SR 1152. Section R-2001B is a 2.68
mile bypass on new location from just south of Deep Run Creek to SR 1158 and will be a four-
lane roadway with a 46 foot wide median.
NC 11, a major rural collector, has been identified by the NCDOT as a "critical connector" from
I40 near Kenansville to the Virginia State border passing through Kinston and Greenville and
connecting three intrastate corridors. The proposed project improvements are scheduled in
conjunction with two other projects (R-2204 and R-2211) forming the southern leg of the
connector. R-2211 extends from I40 to NC 24 and bypasses Kenansville. R-2204 completes the
Kenansville Bypass between NC 24 and existing NC 11 and extends to SR 1110, providing a
bypass of Pink Hill.
On January 15, 1998 an individual permit application was submitted for R-2001 B and C.
Sections B and C were scheduled to be let to construction at the same time; therefore, the permit
application process for each section was combined into an individual permit application. The
Environmental Protection Agency (EPA) and the DWQ commented that Section B, the Deep Run
Bypass, did not fulfill the requirements for avoidance and minimization of impacts to jurisdictional
waters of the United States. In addition, in an August 3, 1998 letter you stated that avoidance and
minimization requirements were not met for Section B and requested that we study additional
avoidance options and prepare appropriate documentation. We subsequently withdrew the
application. Specifically you requested that we look at the avoidance option of removing the
existing bridge on NC 11 and the associated fill in the Southwest Creek floodplain.

In compliance with the requests by DWQ, EPA, and the USACE we restudied the alternatives and
incorporated further avoidance and minimization measures. These issues were addressed in an
Addendum to the FONSI issued June 11, 1999. This document was transmitted to the resources
agencies. An additional copy is enclosed with this application for your convenience.
Summary of f Impacts: Impacts on jurisdictional areas of Section R-200 1B consist of a total of
5.95 acres of permanent wetland impacts which consist of 4.92 acres of fill, 0.17 acres of
excavation, and X0.86 acres due to mechanized clearing. There will also be 0.35 acres of fill in
surface waters. e°te4will be approximately 2,483 linear feet of jurisdictional stream impacts.
Summary of Nia?Q he project has been redesigned to further avoid and minimize impacts to
the wetlands associated r th Southwest Creek as follows:
• We have lengthened the bridge from 45 meters (148 feet) to 209.5 meters (687 feet)
which will bridge the high quality wetlands adjacent to the creek.
• We will remove the existing bridge on NC 11 and the associated fill in the Southwest
Creek floodplain, which will provide 3.61 acres of on-site wetland restoration.
• We have added a 900mm pipe at Station 26+60 (Sheet 11 of 26) to provide
hydrologic connection across the adjacent wetland as requested by the USACE and
the North Carolina Wildlife Resources Commission (WRC).
• The bridges will be constructed from a work bridge. No construction causeways will
be used in the high quality wetlands associated with Southwest Creek.
• The construction zone for the bridges will be limited to the area between the two
bridges. No equipment will be allowed on the outside edges bridges.
• The area underneath the new bridges will be hand-cleared (chainsaw and brush
hogging). No grubbing will be allowed and no heavy equipment that might compact
the soil will be -allowed in the cleared area (Sheets 9 and 10 of 26).
We will provide 4.68 acres of restoration compensatory mitigation from the Gurley Mitigation
Site for the remaining wetland mitigation requirement. In addition, we propose to use WRP to
mitigate for the 2,149 linear feet of jurisdictional stream impacts.
NEPA DOCUMENT STATUS
A North Carolina State Environmental Assessment (SEA) was submitted by the NCDOT
on October 30, 1990 in compliance with the North Carolina Environmental Policy Act. The
document addressed R -2001A, the widening of the existing two-lane facility from SR 1194 north
of Pink Bill to 0.2 miles south of Deep Run Creels, as well as R -2001B and R 2001 C, the subject
of this application. The SEA explains the purpose and need for the project; provides a description
of the alternatives considered; and characterizes the social, economic, and environmental effects.
After the SEA was approved it was circulated to federal state and local agencies. On May 18,
1992 a FONSI was approved for R-2001. Copies of the EA and FONSI have been provided to
regulatory review agencies involved in the approval process. Additional copies will be provided
upon request.
R-2001 B is in compliance with 23 CFR Part 771.111(f) which lists the FHWA characteristics of
independent utility of a project:

(1) The project connects logical termini and is of sufficient length to address
environmental matters on a broad scope;
(2) The project is usable and a reasonable expenditure, even if no additional
transportation improvements are made in the area;
(3) The project does not restrict consideration of alternatives for other reasonably
foreseeable transportation improvements.
RESOURCE STATUS
Wetland delineations: wetland delineations were conducted using the criteria specified in
the 1987 Corps of Engineers Wetland Delineation Manual. Mr. Bill Biddlecomb of the DOA
WASHINGTON Regulatory Field Office verified the delineations in the field. The attached
permit application package consists of drawings depicting jurisdictional impacts in Sections B.
The construction of Section B will result in a total of 5.95 acres of wetland impacts that consist of
4.92 acres of fill, 0.17 acres of excavation, and 0.86 acres due to mechanized clearing (Clearing
Method III). Sheet 3 of 26 provides site specific quantity breakdowns for the impacts.
• Site 1 has a DWQ Rating of 54. It is located adjacent to Deep Run Creek, a perennial stream,
has sandy soil and is characterized by sweet gum (Liquidambar styraciflua), elderberry
(Sambucus canadensis), and bamboo vine (Smilax laurifolia). Deep Run Creek is a second
order stream with a DEM index 27-80-1 and a water quality designation of C Sw NSW.
• Site 2 is a perennial stream.
• Site 3 is a non jurisdictional ditch system.
• Site 4 has a DWQ rating of 85. It is located adjacent to Southwest Creek, a perennial stream,
and has predominantly muck soils. It is characterized by three types of vegetation: cypress-
gum swamp, herbaceous marsh, and scrub/shrub wetland.
The cypress-gum swamp is characterized by bald cypress (Taxodium distichum), black
gum (Nyssa sylvatica), and wax myrtle (Myrica cerifera). Under Schafale and Weakley
(1990) the natural plant community would be classified as a Coastal Plain Small Stream
Swamp (Blackwater subtype).
The herbaceous marsh wetlands are located adjacent to the creek and characterized by
herbaceous hydrophytic species such as pennywort (Hydrocotyle sp.), arrow arum (Peliandra
virginica), greenbrier (Smilax rotundifolia), and cat-tail (Typha latifolia). Southwest Creek is
braided into several channels in this area.
The scrub/shrub wetlands are located fin ther upslope from the herbaceous marsh and
characterized by red maple (Acer rubrum), sweet gum, and yellow poplar (Liriodendron
tulipifera). This area has been logged 5 to 10 years ago and has grown back in an
impenetrable thicket.
• Site 5 has a DWQ rating of 86. It is located on an unnamed perennial stream that is a
tributary of Southwest Creek, has mineral soils and is characterized by red maple, sweet gum
(Liquidambar styracflua), and red bay (Persea borbonia).

Site 6 has a DWQ rating of 56. It is located in a predominantly ditched area of sandy soils
and characterized by sweet bay (Magnolia virginiana), red maple, and giant cane
(Arundinaria gigantea).
• Site 7 is a perennial stream crossing.

1. Fill , excavation, and mechanized clearing impacts.
2. Non Jurisdictional.
Endangered Species: Plants and animals with Federal classification of Endangered (E) or
Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973, as amended. As of May 1, 1997, the U.S. Fish and Wildlife Service
(Service) lists two species for Lenoir County: the red-cockaded woodpecker (Picoides borealis)
and the sensitive jointvetch (Aeschynomene virginica). A biological conclusion of No Effect was
reached for the sensitive jointvetch based on a plant by plant survey of on-site habitat performed
August 12, 1996. In 1992 surveys were performed for the red-cockaded woodpecker and a
biological conclusion of No Effect was reached. Due to the five years since the original survey,
the NCDOT initiated a reevaluation of protected species for the project. The results of the survey
indicate that there is no RCW habitat and that there will be no effect on the species. The Service
issued a letter of concurrence with the No Effect status on December 3, 1997.
Cultural Resources: We are in the process of finalizing clearance of the historic and
archaeological resources with the SB PO as requested in their letters dated February 6, 1991, July
10, 1992, and November 14,1994. We will survey all the creek crossings along the project to
identify the potential for significant archaeological sites and will submit a management summary
of the findings. If any archaeological sites are identified, we will undertake testing to determine
each site's eligibility for listing in the National Register of Historic Places and, if necessary, carry
out a data recovery program to avoid adversely affecting an eligible site.

MITIGATION OPTIONS
The Corps of Engineers had adopted, through the Council on Environmental Quality
(CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and
sequencing. The purpose of this policy is to restore and maintain the chemical, biological, and
physical integrity of the Waters of the United States. Mitigation of wetland and surface water
impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts, rectifying
impacts, reducing impacts over time and compensating for impacts (40 CFR 1508.20). Executive
Order 11990 (Protection of Wetlands) and Department of Transportation Order 5660.1A
(Preservation of the Nations Wetlands), emphasize protection of the functions and values
provided by wetlands. These directives require that new construction in wetlands be avoided as
much as possible, and that all practicable measures are taken to minimize or mitigate impacts to
wetlands.
The NCDOT is committed to incorporating all reasonable and practicable design features
to avoid and minimize wetland impacts, and to provide full compensatory mitigation of all
remaining wetland impacts. Avoidance measures were taken during the planning and
SEA/FONSI phases; minimization measures were incorporated as part of the project design.
AVOIDANCE: All wetland areas not affected by the project will be protected from
unnecessary encroachment.
1. No staging of construction equipment or storage of construction supplies will be
allowed in wetlands or near surface waters.
2. The bridge over Southwest Creek (Site 4) was lengthened from 45 meters (148 feet)
to 209.5 meters (687 feet). This longer bridge will decrease the wetland impacts at
this site by 42 percent or 2.14 acres. All of the cypress-gum swamp and herbaceous
marsh wetlands will be bridged as well as a portion of the cutover.
MINIMIZATION: Minimization includes the examination of appropriate and practicable
steps to reduce the adverse impacts. Minimization techniques were implemented as follows:
1. Slopes: Fill slopes in wetlands are at 2:1 except at Site 5 (Station 34+00) where the
slope is 3:1. A 2:1 slope would necessitate the use of a guardrail and an additional three
feet of shoulder width, which would not reduce the wetland impact.
2. Best Management Practices: Strict enforcement of sedimentation and erosion control
Best Management Practices (BMP) for the protection of surface waters and wetlands.
3. Ditchin¢: It is the policy of the NCDOT to eliminate lateral ditching in wetlands as
much as possible, thus preserving the hydrology of adjacent wetlands.
4. Median Width: The project was designed using a 46-foot median width.
5. Clearing: Clearing Method III will be used.

6. Site 1: Station 5+00. This is the location of the proposed channel change. The length of
the existing stream channel, the extension of the existing reinforced concrete box culvert
and the length of the proposed new stream channel are depicted on Sheets 5 and 6 of 25.
The wetland around the new stream channel will be planted with native species. A total of
0.18 hectares (0.44 acres) will be planted.
COMPENSATION: The primary emphasis of the mitigation is to reestablish a condition
similar to that which existed if the project were not built. As previously stated, mitigation is
limited to reasonable expenditures and practicable considerations related to highway operation.
Mitigation is generally accomplished through a combination of methods designed to replace
wetland functions and values lost as a result of construction of the project. These methods
consist of creation of new wetlands from uplands, borrow pits, and other non-wetland areas;
restoration of wetlands; and enhancement of existing wetlands.
All compensatory mitigation must be in compliance with 23 CFR Part 777.9, "Mitigation
of Impacts" that describes the actions that should be followed to qualify for Federal-aid highway
funding. This process is known as the FHWA "Step Down" procedures:
1. Consideration must be given to mitigation within the right-of-way and should include the
enhancement of existing wetlands and the creation of new wetlands in the highway median,
borrow pit areas, interchange areas and along the roadside.
2. Where mitigation within the right-of-way does not fully offset wetland losses, compensatory
mitigation may be conducted outside the right-of-way including enhancement, creation, and
preservation.
Wetland Compensation: As previously mentioned, We will remove the existing bridge on NC 11
and the associated fill in the Southwest Creek floodplain which will provide 3.61 acres of on-site
wetland restoration (Sheet 26 of 26). The existing causeway is 1312 feet long and 120 feet wide.
The material will be removed to the elevation of the surrounding natural terrain. On July 23,
1999 you indicated that we could use this on-site restoration at a credit ratio of 1:1. Therefore,
total wetland impacts of 5.95 acres minus 3.61 acres on-site restoration equals 2.34 acres. We
will mitigate for this remaining 2.34 acres of impact by providing 4.68 acres of off-site restoration
at the Gurley Mitigation Site.
The NCDOT has purchased a tract known as the Gurley Mitigation Site for use as a wetland
mitigation site. A Final Mitigation Plan for the Gurley Mitigation Site has been completed,
distributed to the resource agencies, and is approved. We propose to use this site to mitigate for
the wetland impacts associated with this project. Both the project and the mitigation sites are
located within the Neuse River Basin. The 179-acre Gurley Mitigation Site tract is adjacent to
Nahunta Swamp, immediately west of the confluence of Nahunta Swamp and Beaver Branch in
the Coastal Plain Physiographic Province of North Carolina. It is located approximately eight
miles northwest of Snow Hill, 12 miles northeast of Goldsboro and 16 miles southeast of Wilson
and transected on the north and east by SR 1058 and SR 1253. Specifically, we propose to use
4.92 credits of bottomland hardwood restoration. We have prepared a Status Report updating the
use of the Gurley Mitigation Site for compensatory mitigation. A copy is enclosed with this
application.

Stream Compensation: As previously stated in the summary, we propose to use WRP to
mitigate for the 2,149 linear feet of jurisdictional stream impacts.
REGULATORY APPROVALS
Application is hereby made for a Department of the Army Individual 404 Permit as
required for the above-described activities. We are also hereby requesting a 401 Water Quality
Certification from the Division of Water Quality. In compliance with Section 143-215.3D(e) of the

Re: Permit Issuance
To whom ever reviews this permit application. I recommend permit issuance. The agencies (US Army
Corps, NCDWQ, NC Wildlife Resources Commission, and USFWS) have hammered DOT for years on
this project. We were able to exact several concessions from NCDOT including:
• an extension of the proposed bridge from 148 linear feet to 687 linear feet,
• removal of the old crossing that includes restoring the old grade to original contours, and revegetating
the area,
• use of a temporary work bridge during construction,
• clearing with hand tools and no grubbing below new crossing.
