APPROVAL of 401 Water Quality Certification

Dear Mr. Riddick:
You have our approval, in accordance with the attached conditions, to place fill material in 0.24 acres of wetlands or
waters for the purpose of road improvement as you described in your application dated July 20, 1999. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This
Certification allows you to use National Permit Number 26 when the Corps of Engineers issues it. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment
and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h), For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Subject: Gates County, Paving of SR 1225 (Sheppard Lane) from SR 1220 to SR
1217.
The North Carolina Department of Transportation (NCDOT) proposes to pave SR
1225 for approximately 0.69 miles beginning at the intersection with SR 1217. Sheppard
Lane is currently a gravel road with a travel width of 22.0 feet. The typical section will
be expanded to accommodate two 10.0 foot paved travel lanes and 5.0 foot grassed-
shoulders.
The project will impact one area of jurisdictional wetlands associated with Flat
Branch Creek. A total of 0.24 acres of wetland will be impacted by the proposed work.
The four 95.0" X 67.0" metal arch pipes currently in place at Flat Branch Creek will
remain in place. Additionally, pipes crossing two wet weather drainages will be
replaced. The existing pipes are 30.0 feet in length and 15.0 inches in diameter. They
will be replaced with pipes 40.0 feet in length and 18.0 inches in diameter.
Enclosed please find the project site map, a pre-construction notification form and
drawings for the above referenced project. The NCDOT anticipates that these activities
will be authorized under Nationwide Permit 26. By copy of this letter, the NCDOT is also

requesting a 401 General Water Quality Certification from the NC Division of Water

Dear Mr. Riddick :
This letter is in reference to vour June 23, 1999 request and June 23 and July 6
platwork regarding a Coastal Area Managemert Act (C.ANIA) Permit jurisdictional
determination concerning die replacement or repair associated with the above road
crossing.
SR 1225 and Flat Branch are located approximately 5 miles northeast of Gatesville
near Roduco in Crates County. Flat Branch is a tributary to Cole Creek and the
Chowan River. After review of this proposed work, as well as a site visit, it is the
Division's determination that the proposed roadways and development associated with
this road crossing are outside of any CANIA Ana of Environmental Concern (AEC).
This letter does not relieve you of the responsicility to insure that all other State
authorizations and/or permits requirements are :net prior to the implementation of this
project. If you have any additional questions concerning CAMA permit junsdiction,
