On March 12, 2015, Mike Mickey of this office ,met with Rusty Evans to perform a Compliance
Evaluation Inspection on the stormwater discharge from the Apex Oil Company Terminal located at
6900 West Market Street in Greensboro, NC. The inspection findings are detailed below and an
inspection checklist is attached.
I. Permit
The NPDES permit expires August 31, 2016.. Please note that at the next renewal the permit will require
that the monthly self -monitoring reports (DMRs) for the Greensboro Terminal be submitted
electronically per new EPA rules. Additionally, it was noted that the facility is now known as the
Center Point Termimal. If ownership has changed or if the facility or owner name changed, then a
Permit Name/Ownership Change Request Form would need to be submitted to the Division's Raleigh
office. The form can be found under the Miscellaneous Forms Tab in the following web link:

U. Self -Monitoring Program
The DMRs were reviewed for the period January 2014 through December 2014. The facility was found
to be compliant with the effluent limits for the above period. In regards to the permit monitoring
requirements, it was noted that the retention pond sampling was performed per the frequencies specified
in the permit.
III. Facility Site Review
The Apex Oil Terminal stormwater management system consists of the following:
stormwater from the truck loading -rack drain area flows to a 1,000 gallon underground tank with
pump located beside the office building. The tank volume is controlled by a float and is pumped
to the oil/water separator in the maintenance building prior to discharge.
the diked secondary containment area for the AST's has two retention basins. The upper basin
flows by gravity via a manual valve to the lower retention basin (or it can be allowed to
overflow to the lower basin). Accumulated stormwater in the lower basin is pumped via a Single
pump to the maintenance building oil/water separator prior to discharge.-

IV. Flow Measurement
The permit requires episodic flow monitoring. Effluent flow from the lower retention basin is calculated
using the run time of the effluent pump. This discharge is controlled manually by turning on the pump.
Records were kept that documented the effluent release date, pump run time and discharge volume
(-12;000 GPH). The discharge flow volume from the truck loading -rack drain is not measured or
sampled. This discharge needs to be metered and sampled per the monitoring requirements of the
permit. One solution would be to simply pump this stormwater directly to the lower retention basin so it
can be monitored and metered as one discharge source.
V. Records/Reports
A review of the facility files showed that all records, except for the loading -rack discharge, were being
maintained according to the permit. A comparison of the August 2014 DMR with the corresponding
certified laboratory data sheets from R&A Labs showed that all results were properly transcribed onto
the self -monitoring report. No discharge from the diked area occurred during the months of February,
May, June, July, September, October, November and December. It is not known when discharges from
the truck loading -rack area occurred.
The only paperwork issue noted during the inspection involved the incorrect conversion of the
naphthalene -and MTBE values from ug/L (as reported on the R&A Laboratory data sheets) to mg/L on
the DMR. It is not necessary to convert the concentration value. You can simply list the same
concentration on the DMR as reported on the R&A Labs data sheet.
VI. Effluent/Receivin2 Waters
The system discharges into the storm drain that runs along West Market Street. The effluent eventually
reaches a tributary of Horsepen Creek, class "WS-III; NSW" waters of the Cape Fear River Basin.
In regards to the truck loading -rack drain area discharge, you are requested to respond in
writing to our Winston-Salem Regional Office on or before April 10, 2015, providing information
on how this issue will be resolved. Should you have any questions concerning this report, please

6900 West Market Street in Greensboro, NC. The facility was found to be in compliance with the NPDES permit.'
The inspection findings are detailed below and an inspection checklist is attached for.your records.
I. Permit
The NPDES.permit was issued effective October 1, 2011. The permit expires next on August 31, 2016.
11. Self -Monitoring Program _
Monthly self -monitoring reports (DMRs) were reviewed for the period January 2013 through January'2014.1 The
facility was found to be compliant with the final NPDES effluent limits for the above period. In regards to the
permit monitoring requirements, it was noted that all sampling was performed per the frequencies specified in the
permit. In order to assist our data entry staff, please write "No Disch" in the flow column on the DMR instead of
"Discharge" to eliminate any confusion.
III. Flow Measurement

VI. Facility Site Review
The Apex Oil Terminal has the following stormwater control structures:
• The .truck loading -rack drain at the fueling area is routed to a 1,000 gallon pump tank that is followed by an
oil/water separator. .
• The diked secondary containment area for the above ground storage tanks has two retention basins. The
upper basin flows by gravity via a locked valve to the lower retention basin. The accumulated stormwater
in the lower basin is .pumped to the above mentioned oil/ water separator prior to discharge.

Jim,
I stopped by Apex this afternoon and checked on the breach in the dike. Obviously, it is still not repaired. I spoke with
Rusty since Charlie was not there. He pretty -much explained the same thing Drew did in his email below. However, I am
not comfortable with that explanation and have directed Rusty to notify Charlie that the dike needs to be repaired by
COB on Monday or civil penalties will begin to be assessed by our division on a daily basis thereafter.

Additionally, I contacted Ken Fenton in St. Lois with Apex. He is the corporate manager of all their US terminals. I advise
him of our concerns with the timeline of the repairs and that penalties would be assessed beginning COB on Monday. He
called me back later this afternoon and confirmed the repairs would be completed within that time frame. I did not
discuss the check dam with him and will refer to you and Peter on that issue. However, I did begin a dialogue with him
on the fire protection of the existing ethanol tanks and loading rack. We will discuss that in more detail later.
Thanks for your help on this matter and let me know if anything changes as described above.

The excavation and exposed piping runs are being covered with soils next week and the check dam will be removed
post -covering. Again, this is to ensure that no possibility for contamination going downstream from ongoing emergency
repair operations can occur. When replacing petroleum pipeline or repairing any damage, no matter the size; there are
significant Federal regulatory testing requirements for each section of pipeline replaced that preclude a quick fix so that
is the cause of the delay. I am copying the facility manager Charlie Bowden on this email chain. I will advise you on the
progress post -covering and before we start the restoration process. Thank you for the input and assistance on this
ongoing project. It is good to have a productive partnership with the City and Fire Department folks on an ER such as this
and I can tell you that it has been a very good experience on my part.

We have been making sure that the banks and trail are protected from erosion but are still waiting on the certification of
the pipeline repair to cover the pipeline up and then restore the larger portions of the excavations on the tank farm site.
As a consequence, we are leaving the check dam in place until we can be sure that no possibility exists for contamination
to be released into the creek through the storm drains. I wanted you to be aware of that and also that once the check
dam is removed, we will be performing riparian restoration per your specifications and request. I will keep you advised

As a preventative measure for temporary erosion control, we have laid a thick layer of straw along the stream banks
where disturbed and then on the trail itself today per our conversation Friday.
As a status on the leak: we did find the leak and the pipe has been evacuated and inerted. However, due to the nature of
the leak and the area where it was, we will have to maintain the erosion control and diversion dam for at least a few
more days while the pipeline folks repair the pipeline and pressure test it. That process I am told is very involved and not
a fast one. Following conclusion of activities on the pipeline and recovering of the ground surface in those areas, we will
install all permanent erosion controls as specified in your communication. Again, my concern is that we leave all
preventative measures in place until the pipeline has been determined to be fully functional and no threat of release is
present. I really shudder at the thought of a big volume of product washing down to the creek and beyond so I am being
ultra conservative with the environmental protections we put in place.
Please feel free to contact me at any time regarding the incident or our continuing response. As a side note, I have
express orders from our client to protect all areas with any means required from a product release. Thank you for your

You and I discussed the issues surrounding the use of the stream bank and how to properly address this issue. It would
be Stormwater's suggestion that no removal or stabilization efforts be conducted until the effected spill area is free of
product and the stream is not in danger of receiving anymore product. Listed below are the requirements for properly
addressing the erosion concerns within the stream and the associated bank:
• When removing the inverted dam, do not disturb the streambed deeper than the existing streambed.
• The stream bank that was disturbed can be adequately addressed by installing a seasonal mix of grass seed and
woven coir matting (North American Green SC250BN would be minimum matting). We recommend the use of the
manufacturer's specification for the staking of the woven coir matting.
• The ingress/egress route should be stabilized with a seasonal mix of grass seed and hand strewn straw covering
the affected area.

Ill. Flow Measurement
The permit requires episodic.flow monitoring. Flow is calculated by using pump run times of the effluent
pumps at the settling pond. The discharge is controlled manually by turning on the pumps.
VI. Facility Site Review
The Apex Oil Terminal facility has truck loading -rack drains followed by a 1,000 gallon pump tank which
is routed to an oil/water separator. The diked secondary containment area for the above ground storage
tanks has two settling :basins. The upper basin is pumped (or can overflow) to' the main settling pond
near West Market Street. The accumulated stormwater in the main pond is pumped to the same oil/
water separator prior to discharge.

V. Records/Reports
A review of the facility files showed that all records Were being maintained according to the permit. No
discharge occurred'in the.months of January, February, April, June, October, November and December.
A comparison of the January 2013 DMR with the corresponding certified laboratory data sheets from
R&A Labs showed that all results were properly transcribed onto the self -monitoring report. A log book is
also kept for recording pump run time readings that are used to compute daily flow values from the main
settling basin.
VI. Effluent/Receiving Waters
The system discharges to the storm drain system that runs along West Market -Street and the effluent
eventually reaches a tributary of Horsepen Creek, class "WS-III; NSW" waters of the Cape Fear River
Basin. The storm drain re -surfaces approximately 100 yards before the stream flows under West
Friendly Avenue.

stormwater-management system consists of truck loading -rack drains at the fueling area. _

A Compliance Evaluation Inspection was performed on Apex Oil Company wastewater treatment facility on October 12,
2010 by Corey Basinger of the Winston-Salem Regional Office. Mr. Charlie Bowden, ORC was present for the subject
inspection. The inspection consisted of two parts: an on -site inspection of the treatment facility and an in -office file
review. The following are the findings from the subject inspection.
I. Permit
The NPDES permit for Apex Oil Company became effective on September 1, 2006 and expires on August 31, 2011.
II. Records/Reports
A review of the laboratory reports and Discharge Monitoring Reports (DMRs) revealed no discrepancy between the
generated data and the data submitted to DWQ. A copy of the laboratory data is kept on file. All applicable data is
collected as per the NPDES permit requirements.
II1. Facility Site Review
The permit states that the treatment works consist of truck loading rack drains, an oil/water separator, waste holding tank
(with optional pump -out for offsite disposal), gravity drains to dike containment areas, discharge control valves (for pre-
tested wastewater), and dry ditch drains to an unnamed tributary to Horsepen Creek. Since the previous inspection, four (4)
74,000 barrel tanks and a new dike structure have been added.
IV. Effluent & Receiving Waters
The Apex Oil Company discharges to an unnamed tributary to Horsepen Creek (Class WS-III NSW waters in the Cape
Fear River Basin). On the date of the inspection, the stream was free of solids, grease, and foam.
V. Flow Measurement
Flow is measured by a calculation using pump run time.
VI. Self -Monitoring Program
A review of the discharge monitoring reports (DMRs) for the time period of August 2009 through July 2010 showed that
the Apex Oil Company experienced no permit effluent limitation violations
VII. Compliance Schedules
No compliance schedule to evaluate.
VIII. Laboratory
All of the samples are taken to a contract lab for analysis.

INTRODUCTION
Apex Oil Company (herein referred to as Apex or the permittee) requires a National Pollutant
Discharge Elimination System (NPDES) permit to dispose treated wastewater to the surface waters of
the state. The Permittee's 5-year NPDES permit has expired and they have requested renewal from
the Division of Water Quality (the Division). This Fact Sheet summarizes background information
and rationale used by the Division's NPDES Unit to determine permit limits and conditions. This
document also contains references to information sources relevant to this permit renewal
(superscripted numbers in order of appearance, See References).
FACILITY RECORDS REVIEW
Facility Description. Apex (Table 1) operates the Apex Oil Company, Greensboro Terminal, a bulk storage
petroleum fuel distribution center in Guilford County. Discharge from the facility consists of stormwater
runoff controlled by a Water Pollution Control System consisting of: loading rack drains; oil/water
separator; waste holding tank with optional offsite disposal; pumps to empty dike containment areas trough
the oil -water separator; and discharge control valves. Discharge travels to an unnamed tributary (UT) of
Horsepen Creek.

stager the renewal workload, the Division extended the expiration date to expire June 30, 2001.1'2

effluent limits and monitoring requirements based on an in -stream waste concentration (IWC) of
100% (zero -flow stream) .6 The Division judges these limits and monitoring requirements to be
appropriate for this renewal with the exception of additions and deletions listed below (see
PERMITTING APPROACH SUMMARY).
Verifying Existing Stream Conditions. This facility discharges to a "zero -flow" stream, an
unnamed tributary (UT) Horsepen Creek, a Class WS-III NSW stream within the Cape Fear River
Basin. Horsepen Creek is not listed as an "impaired" waterbody [not 303(d) listed].5
COMPLIANCE REVIEW
Discharge Monitoring Reports (DMR) -- Effluent Data Review. DMRs were reviewed from
January 1999 through June 2001.' Discharges from Outfall 001 occurred episodically, zero to four
times per month — non -discharge months reported as "no flow." The permittee reported a maximum
discharge of 0.0.096 MGD (June 2000). Therefore, this flow was used for reasonable potential
calculations (see below). Monitoring parameter results are summarized in Table 2:

Based on the Division's our review of the DMRs, twice annual EPA 624/625 scans did not detect
semi -volatile or volatile organic compounds. Total suspended residue (TSR) results do not exceed
recommended levels.
Notices of Violation (NOVs). No NOVs were issued to this facility during this permit cycle.$
Facility Inspections. This facility was last inspected September 1995 in connecting to an
Authorization To Construct (ATC) an oil —water separator. Beginning with this permit cycle, the
Winston-Salem Regional Office has scheduled regular annual inspections for this and all bulk -
petroleum storage facilities in the Greensboro area.
Whole Effluent Toxicity (WET) Test. The facility has passed its annual acute toxicity test for four
(4) years, from 1998 through year 2001.
Total Suspended Solids (TSS). During 24 of 25 discharge months (January 1999 through June
2001) TSS levels are reported in excess of the permit Daily Maximum of 45.0 mg/L. Annual averages
are 79.5 mg/L (1999), 67.1 mg/L (2000), and 63.5 mg/L (2001). A maximum was reported in June
2000 of 272 mg/L. These violations have not been assessed. According to the Compliance and
Enforcement Unit, future discharges in excess of 45.0 mg/L will be assessed as a violation.9 A
note to this effect will be added to the permit cover letter.
PERMITTING STRATEGY
Revised Standard Operating Procedures (SOP). The Division has revised permitting strategies
and SOP for this and all oil terminals in the state based on a 1996 SOP. This document, hereafter
referred to as the 2001 SOP,10 addresses issues and delineates monitoring frequencies and permit
limits for contaminants commonly found at these facilities.
Summary of Compliance Under 2001 SOP. Under the 2001 SOP, flow monitoring will be
changed from "monthly" to "episodic" (Parts L.A. ). Compliance for acute toxicity, TSS, and oil and
grease (Parts L.B. through I.D.). In place of EPA Methods 624/625 monitoring requirements [eight
(8) chlorophenols specified in the previous permit], the permittee shall now monitor monthly for
phenol only (Part LE.), required for all WS (water supply) waters, and for BTEX (Part III.A.). The
Division shall also require monthly monitoring for MTBE (2001 SOP Part I.I.) considering WS
waters. to
Footnotes to the Effluent Limits and Monitoring Requirements page shall reflect no direct discharge
of tanks solids, tank bottom water, or the tank rag layer. Footnotes also stipulate no direct discharge
of hydrostatic test water if benzene and/or toluene concentrations exceed their respective water
quality standard (2001 SOP, Parts I.G. and LH).
Phenol — Monitoring and Limits Calculations. When combined with chlorine, phenol can cause
taste and odor (organoleptic) problems in drinking water, and can also result in the tainting of fish
tissues. Therefore, in accordance with SOP 2001, all dischargers to state water supply (WS) waters
shall conduct monthly effluent monitoring for total phenol.10 Moreover, if analytical results suggest
"reasonable potential," a phenol limit shall be included in the permit.'
A phenol limit magnitude depends on dilution. Ideally dilution would be calculated at the Lake
Townsand Dam water plant intake where chlorine is introduced, but it is impractical at this time to

measure dilution under lake conditions at the intake. Therefore, the Division calculated flow at the
assumed headwaters of this water supply. Secondly, the Division used 1 µg/L (the aesthetic limit for
phenol) to calculate a wasteload allocation in pounds per day (lbs./day) at these headwaters. Finally,
the wasteload allocation was distributed equally among phenol dischargers as a permit limit, but only
as each facility's data -set showed reasonable potential to exceed the water quality stream standard.
Currently two (2) bulk storage facilities discharge to Horsepen Creek draining to Lake Townsand, the
nearest downstream intake waterbody. An EPA stream gauge (0209400000) located on Horsepen
Creek was assumed for the following calculations to approximate the headwaters of Lake Townsand.
The Division used published 30Q2 flows from this stream gauge to calculate a wasteload allocation
for phenol. The 30Q2 flow, not the 7Q10, was deemed appropriate because the standard for phenol is
aesthetic.

This letter transmits your draft NPDES individual discharge permit for the subject facility.
Please review this draft carefully to ensure thorough understanding of the information,
conditions, and requirements of dischargers to water supply (WS) waters contained therein.
The Division of Water Quality (the Division) has revised permitting strategies and Standard
Operating Procedures (SOP) for this and all bulk storage petroleum facilities and terminals in
North Carolina. As part of permit renewal, the Division has also conducted EPA -required
Reasonable Potential Analysis (RPA) on this facility's effluent data to determine the "reasonable
potential" for identified parameters to exceed North Carolina Water Quality Stream Standards
and criteria. The following summarizes changes to your previous permit in compliance with the
new 2001 SOP:
• Incorporated BTEX monitoring, frequency Monthly per SOP 2001.
• Benzene; no limit added because no "reasonable potential"
• Removed EPA Method 624 monitoring; "no parameters detected."
• Method EPA 625 monitoring remains at 2/Year per SOP 2001.

BTEX. The permittee is now required to monitor monthly for BTEX (benzene, toluene,
ethyl benzene and xylene) parameters. Please note that this replaces the requirement for EPA
Method 624. These renewal parameters are not permit -limited currently because the RPA
indicates no "reasonable potential," based on data submitted. For example, benzene's RPA
"maximum predicted" effluent level of 0.05 µg/L (based on submitted data) does not exceed the
1.19 µg/L "allowable concentration." This suggests that there is no "reasonable potential" to
exceed receiving -stream Water Quality Standards.
EPA Methods 624/625. Method 624 has been eliminated from facility monitoring if it did
not detect compounds other than BTEX. However, because the majority of facilities now store,
or have stored in the past, heavy -component fuels such as fuel oil and diesel, the Division has
retained EPA Method 625 monitoring to detect naphthalene and related indicators of middle
distillate compounds commonly found in these heavier fuels. Should the permittee wish to
document that the subject facility does not now, nor has ever stored heavier -component fuels,
the Division will consider a request to discontinue this monitoring.
Phenol. The Division recalculated a phenol stream-wasteload allocation of 0.002 lbs./day
at the USGS stream gauge (0209400000) on Horsepen Creek — the assumed beginning of Lake
Townsand Water Supply. This allocation was distributed equality among two (2) potential
phenol dischargers upstream (0.001 µg/L per discharger). The Division then calculated a phenol
limit of 1.25 µg/L using Apex's highest reported flow of 0.272 MGD. These calculations are
available upon request. Although the RPA suggests that there is "reasonable potential" based on
2.5 µg/L (1/z PQL), Apex did not detect phenol at 5.0 µg/L in 37 sample events. Therefore, the
Division has not included a permit limit despite the "reasonable potential" because there is
currently no analytical method more sensitive.
MTBE is a gasoline component recently identified by the EPA as a potential human
carcinogen. Therefore, monthly monitoring has been added to this and all oil terminal permits
discharging to WS waters within the state. After collecting additional data, the permittee may
request the Division to reduce the MTBE monitoring frequency (See Special Condition A. 2.).
Granting this request shall constitute a minor modification to the NPDES permit.
Lead was limited in the previous permit and will also be limited in the new permit. The
RPA "maximum predicted" effluent level of 140.0 µg/L (based on submitted data) exceeds the
allowable concentration of 25.0 µg/L. This indicates "reasonable potential" to exceed water
quality stream standards.
Oil & Grease. Similar to lead, oil and grease were also limited in the previous permit. This
limit will continue because the RPA "maximum predicted" effluent level of 51.6 µg/L exceeds
the allowable concentration of 30.0 µg/L, based on data submitted by the permittee.

Concerning Total Suspended Solids (TSS). During 24 of 25 discharge months (January

publishing a notice in newspapers having circulation in the general Guilford County area, per
EPA requirements. Please provide your comments, if any, to DENR / DWQ / NPDES Unit no

The old oil/water separator was removed by DOT when Hwy
421 was widened. The company hasn't provided plans for
the replacement oil/water separator for the facility.

substantially constructed wastewater treatment
facilities: Stormwater and any spillage associated
with the bulk tank area gravity flows to an existing
impoundment (low area) within the tank berm. This
water is then pumped to an oil/water separator (non
existent at this time). Additional stormwater and
spillage from the loading facility would enter into a
surface collection system and flow to this same non
existent oil/water separator. Discharge is to storm
sewer.
f. Please provide a description of proposed wastewater
treatment facilities. Unknown. No plans have been
submitted with the application for replacement or
addition of treatment facilities.

4. Alternative Analysis Evaluation: Has the facility evaluated

separation of stormwater from petroleum contact water.

5. Other Special Items: This company should consider
providing a completely new site approach concerning the
oil/water separation discharge and an enhanced design and
implementation of a Spill Prevention and Containment Plan
(especially the truck filling station area). It appears
that additional consideration and some consolidation of
these issues (and subsequent modifications to the site such
as roof extensions, relocation of spill collection basins
and asphalt driveway berms) could further reduce potential
stormwater contact with petroleum products.
PART IV - EVALUATION AND RECOMMENDATIONS
WSRO recommends that since this facility is currently not
operational that issuance of the Permit be delayed until the
company submits proposed and actual site engineering plans
for modifications to the site with regards to the SPCP, RCRA
and specifications for the existing treatment works onsite
(sized to fit existing and proposed conditions) as well as
any potential remediation requirements, if necessary. As
this discharge is to a water supply, the DHS may also need
to comment on this facility. Phenol, TSS and oil/grease
limits may be reasonable.

• The Groundwater Section should also comrrant on this permit
' request. It would be advisable to find out about the
current conditions of the tanks on site and what steps have
or will be taken to provide proper seals and leak detection
for the tanks. Previous site leaks (if any) should be
investigated, eliminated as a concern or reviewed for
remedial activities.
The company name change should be included in the permit.
