Regulation 15 NCAC 211 .0404; LFFLULNT LIMITAIIONS IN WA1ER QUALITY
LIMITLD SLGMLNTS; has been amended and reads as follows:
(a) Effluent limitations more stringent than minimum treatment
requirements shall be developed by the statf and approved by the
director for all existing or proposed dischargers to water quality
limited segments of the surface waters of Lhe state. The basis of
these water quality effluent_ limitations shall be maintenance of
water quality standards.
(b) The staff shall also provide on a case -by -case basis for
seasonal variation in the discharge of.oxygen-consuming wastes.
In order to be considered eligible for seasonal eftluent limitations,
a request must be submitted to the director along with a rationale as
to the need for such limitations. Permit rei,suance or modification
during the remaining time of an existing hermit will he considered
on the basis of demonstrated need. In no cane :hall this variation
cause or be expected to cause a receiving water body to violate
applicable water quality standards.
(c) For the purpose of detennining seasonal effluent limitations,
the year shall consist of a summer and a winter discharge period. The
summer period will begin April 1 and extend thruugh October 31. 1he
winter period shall be that portion of the year from November 1 to
March 31. the summer oxygen -consuming wasteload allocation shall be
developed using the flow criteria specified in 15 NCAC 28 .OZ06. The
winter oxygen -consuming wasteload allocation shall in no case be less
stringent than two times the summer oxygen -consuming waste load
limitations nor shall it be less restrictive than minimum treatment
requirements.

Enclosed is our original request for effluent limitations with a
map of the potential discharge points. As can be seen on the map
discharge point #1, the existing plant site, is not on Lick Creek
but rather on an unnamed tributary to Lick Creek.
Please confirm that the effluent limitations for site #1 developed
by DEM (copy enclosed) are still valid. If they are correct, the
NPDES permit for the Denton Facility should be modified.
