After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3109. This Certification allows you to use Nationwide Permit Number 27 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. NCDOT was subsequently informed that additional information that outlined the bioengineering techniques that would be used for banl; stabilization was needed in order to issue the Certification. NCDOT proposes to perform stream restoration of Four Mile Creek. As indicated in the original application, restoration activities include the removal of accumulated sediment from approximately 1120 feet of Four Mile Creek, reshaping of the stream banks to a 2:1 slope, and vegetative plantings on the banks and along the top of the stream banks within the floodplain. In addition to these activities and what was not mentioned in the original application, coir fiber matting will be placed along the stream banks. The black willow and silky dogwood plantings will then be placed through the matting. This bioengineering technique is detailed in the attached drawing. TIP U-2510 BB. On November 12, 1997, your office issued a General Permit No. 198200031, Action ID # 199707383, to widen NC 16 in Mecklenburg County. In the original application, North Carolina Department of Transportation (NCDOT) committed to provide a greenway crossing where NC 16 crossed Four Mile Creek. This was coordinated with the Mecklenburg County Parks And Recreation Department. Four Mile Creek is heavily impacted by sedimentation in this area. Water flow is restricted by the accumulation of over four feet of sediment at the culverts. In order to construct the greenway and restore the hydraulic opening to accommodate a 50-year storm, NCDOT proposes to remove the sediment from 4 of the 5 box culverts as well as the sediment 100 feet up river and 1017 feet down river. The fifth culvert will be tilled to raise the elevation and paved to accommodate the greenway traffic. However, this activity is not covered under the existing permits. It is NCDOT's contention that removing this sediment will restore much of the lost hydrologic functions of the stream. Additionally, NCDOT will plant black willow (Salix nigra) and silky dogwood (Corpus amomum) on the channel banks and sweetgum (Liquidambar styracglua), sycamore (Platanus occidentalis), black cherry (Prunus serotina), and river birch (Benda nigra) on top of the banks along the floodplain throughout the restoration project. 7 NCDOT is in the process of obtaining a 3-year easement throughout the project area in order to monitor the success of the stream restoration project. Any failures (i.e.. stream bank collapse, tree mortality) during this period will be rectified. A copy of this request as well as details of the stream restoration are attached. The NCDOT hereby requests authorization for the project under a NW 27 for Wetland and Riparian Restoration and Creation Activities. By copy of this information, the DWQ is requested to review this project for authorization. NCDOT is?currently constructing the subject project. The crossing of Fourmile Creek will require-dredging in the stream for approximately 100 feet upstream and 1000 feet downstream. NCDOT has already obtained a temporary drainage easement in this area. The Army Corps of Engineers has stated that a Nationwide Permit (NWP) 27 for stream restoration will be required to authorize this activity. The NWP 27 will require a three year monitoring period following completion of the project to ensure success. NCDOT will be responsible for remediation of any stream restoration failures during this time. Therefore, NCDOT is asking your assistance in obtaining a three-year easement, beginning from the completion of the stream restoration activities. TIP U-2510 BB. On November 12, 1997, your office issued a General Permit No. 198200031, Action ID # 199707383, to widen NC 16 in Mecklenburg County. In the original application, North Carolina Department of Transportation (NCDOT) committed to provide a greenway crossing where NC 16 crossed Four Mile Creek. This was coordinated with the Mecklenburg County Parks And Recreation Department. Four Mile Creek is heavily impacted by sedimentation in this area. Water flow is restricted by the accumulation of over four feet of sediment at the culverts. In order to construct the greenway and restore the hydraulic opening to accommodate a 50-year storm, NCDOT proposes to remove the sediment from 4 of the 5 box culverts as well as the sediment 100 feet up river and 1017 feet down river. The fifth culvert will be tilled to raise the elevation and paved to accommodate the greenway traffic. However, this activity is not covered under the existing permits. It is NCDOT's contention that removing this sediment will restore much of the lost hydrologic functions of the stream. Additionally, NCDOT will plant black willow (Salix nigru) and silky dogwood (Corms amomum) on the channel banks and sweetgum (Liquidumhar styrac{flea), sycamore (Platanus occidentalis), black cherry (Prunes serotina), and river birch (Benda nigru) on top of the banks along the floodplain throughout the restoration project. 1) NCDOT is in the process of obtaining a 3-year easement throughout the project area in order to monitor the success of the stream restoration project. Any failures (i.e.. stream bank collapse, tree mortality) during this period will be rectified. A copy of this request as well as details of the stream restoration are attached. The NCDOT hereby requests authorization for the project under a NW 27 for Wetland and Riparian Restoration and Creation Activities. The stream restoration project is necessary due to the accumulation of instream sediment in the existing highwav's box culverts as well as upstream and downstream of the culverts. The proposal will involve dredging of the stream to remove the accumulated sediment as well as vegetative I?gs along the top of the stream banks within the floodplain. Restoration activities also include reshaping of the stream banks to a :1 slope. The applicant, however, did not mention any b, ioengineering techniques that are to be used for bank stabilization. Prior to ap rp oval, applicant should provide details regarfflng specific stream bank stabilization techniques that are to be used.
