SUBJECT: Review of an application by NCDOT to pave SR 1105 (Laurel Lake Road) and
extend five culverts 20 feet in tributaries along Collis Branch, Mitchell County
The North Carolina Department of'T'ransportation (NCDOT) is requesting a letter of
concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404
permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information
provided by the applicant, and field biologists on our staff are familiar with habitat values of the
project area. These comments are provided in accordance with provisions of the Clean Water
Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661-667d).
As part of the paving project, rive pipes are scheduled to be replaced and/or extended at
stations 1+50 (6' stream), 16+80 (0.5' spring), 43+55 (0.5' spring), 37+68 (small spring) and
38+70 (6' stream). Collis Branch is a tributary to Long Branch, neither of which are NCWRC
Designated Public Mountain Trout Water. The upper reaches of Collis Branch along SR 1105
flows into Laurel Lake (private).
Based on the information provided by the applicant and our information on the range of
trout in the project area, we do not believe this project will cause significant effects to waters
supporting trout. Therefore, we do not object to the project as proposed, provided the following
recommendations are implemented:
Instream work and land disturbance within the 25-foot wide buffer zone are prohibited
during the trout spawning season of October I through April 1 to protect the egg and
fry stages of trout from off-site sedimentation during construction.

2. Stream disturbance at pipe replacements should be limited to only that which is
necessary for pipe replacement/extension. No channel work should occur in the
stream immediately above and below the pipes.
Pipe replacements/extensions at stations 1+50 and 38+70 that have a six foot stream
flowing through them should be buried one foot into the substrate in order to
maintain fish passage through the culvert.
4. Temporary or permanent herbaceous vegetation should be planted on all bare soil
within 15 days of ground disturbing activities to provide long-term erosion control. If
seeding is done after 1 October 1998, then the NCDOT should return after 1 April
1999 to reseed poor growth areas if necessary.

Dear Mr. Stephen Moore:
You have our approval, in accordance with the attached conditions and those listed below for the
purpose of paving SR 1105, Laurel Lake Road , as you described in your application dated April 2, 1998.
After reviewing your application, we have decided that this impact is covered by General Water Quality
Certification Number 3100. This certification allows you to use Nationwide Permit Number 031 when it is
issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds
(T 15A:04B .0024).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919-733-1786.

Mitchell County
I am attaching a straight line diagram with erosion control plan, an
application form for a nationwide permit, and a county map section relative to the
paving of SR 1105, Laurel Lake Road in Mitchell County.
Laurel Lake Road is presently 12-14 feet wide. We plan to pave the road 18
feet wide and increase the typical section. The typical section is also attached.
Grading will be light to moderate. The project begins at SR 1104 and continues in
a northerly direction for a distance of 0.73 mile.
We propose to extend five (5) culverts twenty (20) feet in unnamed at each
location at survey station 1+50, 16+80, 34+55,37+68 and 38+70.
