Road (SR 1008) to the Chapel Hill Bypass, Federal Aid Project

The North Carolina Department of Transportation proposes to widen US 15-501 from
South Mt. Carmel Church Road to the Chapel Hill Bypass from a two lane shoulder
section to a four lane curb and gutter facility with a 15 foot raised grassed median. On
January 30, 1998, we submitted a Nationwide 14 permit application. We subsequently
received comments from the N. C. Wildlife Resources Commission (WRC) regarding the
design of the stream relocation at Site I (Station 11+39-L Rev- to 12+54-L Rev). The
WRC requested that the riprap be eliminated and coconut fiber liners be used. We have
revised the design to incorporate these features. Revised Sheets 3 and 4 of 8 are enclosed
with this letter.
As mentioned in the original application, this stream relocation is located above
headwaters and will be completed before December 13, 1998 and therefore qualifies for a
Nationwide 26 permit. We hereby request that the application submitted on January 30,
1998 be modified to incorporate the revised stream relocation design, and request that a
Nationwide 26 and Section 401 General Water Quality Certification be issued for the
proposed project.

Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to place fill material in waters for the purpose
widening NC 15/501 from South Mount Carmel Church to Chapel Hill Bypass, as you described in your application dated
January 30, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Numbers 3104 and 3108. These Certifications allow you to use Nationwide Permit Numbers 14 and 26
when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

The North Carolina Department of Transportation proposes to widen US 15-501 from
South Mt. Carmel Church Road to the Chapel Hill Bypass from a two lane shoulder
section to a four lane curb and gutter facility with a 15 foot raised grassed median. The
project is approximately 0.82 kilometers (0.51 miles) in length. Construction of the
proposed project'will result in 0.18 acres of fill in surface waters from a 23 foot culvert
extension at Site II (Station 10+04 -Y- ) and a stream relocation at Site I (Station 11+39-
LRev- to 12+54-LRev). There will be no impact to jurisdictional wetlands.
The stream relocation will consist of 80 meters (262 feet) of stream (Obies Creek)
relocated into a new stream channel 76 meters (249 feet) in length for a total stream loss
of 4 meters (13 feet). The relocation has been designed to resemble the existing stream to
the greatest extent possible. The principles embodied in the Rosgen methodology have
been used with the creation of meanders and stabilization of the stream banks with native
plantings. The use of riprap has been minimized. The design of the stream has been
coordinated with the North Carolina Wildlife Resources Commission.
We anticipate that Site II, culvert extension, will be permitted under Section 404
Nationwide permit 14. Site I, the stream relocation, is located above headwaters and all
work in waters will be completed before December 13, 1998 and will, therefore, qualify
for a Nationwide 26 permit.

A Federal Highway Administrative Action, Environmental Assessment was submitted by
the USDOT-FHWA and the NCDOT and approved on April 30, 1996. The EA explains
the purpose and need for the project; provides a description of the project and the
alternatives considered; and characterizes the social, economic, and environmental effects
of the project. On March 26, 1997 the FONSI was approved for R-0942. Copies of the
EA and FONSI have been provided to regulatory review agencies involved in the
approval process. Additional copies will be provided upon request.
Enclosed please find the project site map, the preconstruction notification form, and
drawings for the above referenced project. We anticipate a 401 General Certification will
apply to this project, and are providing one copy of these documents to the North
Carolina Department of Environment, Health and Natural Resources, Division of Water
Quality, for their review.
