Preston Howard, Jr., P.E., Director 'AIT NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES April 8, 1998 Burke County DWQ Project 980274 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Stephen Moore NC DOT Route 1 Box 169C Marion NC 28752 Dear Mr. Stephen Moore: You have our approval, in accordance with the attached conditions and those listed below for the purpose of paving a road at SR 1728, as you described in your application dated March 26, 1998. After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must fullow the conditions listed in the attached certification and any additional conditions listed below. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (T 15A:04B .0024). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Tunnel Road is presently 12-14 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The typical section is also attached. Grading will be light to moderate. The project begins at SR 1729 and continues in a northerly direction to US 64-70, a distance of 0.47 mile. We propose to extend two (2) culverts a length of twenty (20) feet at each location in unnamed tributaries into Double Creek at survey station 1+30 and 11+20. By copy of this letter, we request Joe Mickey, North Carolina Wildlife Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request.
