Center Avenue, Suite 301 Mooresville, North Carolina 28115 Subject: Notice of Violation NOV-2020-DV-0252 Mr. Basinger, JU On April 13, 2020 the City of Kings Mountain experienced a power outage during severe natural conditions. As a result, the City is reporting a 330 gallon SSO. We responded with our vactor truck and removed approximately 4,600 gallons. Power was restored within 55 minutes. Due to the impact of the weather event on April 13, 2020 the discharge was caused by severe natural conditions and there were no feasible alternatives to the discharge. Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required.
