On February 6, 2020 the City of Kings Mountain experienced a severe weather event. We
received over 5" of rain within a 24 hour period. As a result, the creeks in our area swelled to an
overflow condition causing erosion which in turn washed out 60' of our 24" terracotta sewer main on
Stoney Point Road. We have reported a 3.1 MG spill for this event which was repaired within 11 hours.
We also had inflow and infiltration issues with three lift stations: Phenix Street, Wilson Street,
Beason Creek. We have reported 2,300 gallons for Phenix Street, 1,900 gallons for Wilson Street, and
9,400 for Beason Creek. All three stations were affected by the severe weather event stated above. At
Wilson Street we used a vactor truck to pump and haul sewage from the wet well to minimize the
impact of the SSO. At Beason Creek we again used a vactor truck to haul 30,000 gallons also minimizing
the impact. At Phenix Street a previous concrete repair dropped into the main causing a blockage and
overflow, we repaired a 20' section of the sewer main.
Due to the impact of the weather event on February 6, 2020 we ask that you consider this

Dear Mr. Duncan:
The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by City of Kings Mountain indicates
violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include
failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the
land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for
which a permit is required.

a written response to this Notice of Violation. Your response is to be received by the regional office within 60
business days following receipt of this violation. Please include any additional documentation about this incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations.
