NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 to N.C. Department of
Transportation resulting in 3.52 acres of wetland impact in Pitt County pursuant to an application
filed on the 21 st day of May, 1997 to widen US 13/NC 11 from NC 903 to NC 30.
The application provides adequate assurance that the discharge of fill material into the waters
of Grindle Creek in conjunction with the proposed development will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302,
303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and
conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application,
as described in the Public Notice or as modified below. If you change your project, you must
notify us and you may be required to submit a revised application. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow
the conditions listed below. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion
control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations.
Condition(s) of Certification:
1. Appropriate sediment and erosion control practices which equal or exceed those
outlined in the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available
from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be
utilized to prevent exceedances of the appropriate turbidity water quality standard (50
NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all
lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters);
2. All sediment and erosion control measures placed in wetlands or waters shall be removed
and the natural grade restored after the Division of Land Resources has released the
project;
3. Should waste or borrow sites be located in wetlands, compensatory mitigation is
required since it is a direct impact from road construction activities;
4. Should waste or borrow sites.be located in wetlands, compensatory mitigation will be

5. We understand that you have agreed to contribute to the Wetland Restoration Program in
order to compensate for part of these impacts to wetlands. In accordance with 15A
NCAC 2R.0500, this contribution will partially satisfy our compensatory mitigation
requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 2H.0506(h)(7),
7.04 acres of mitigation will be required. You have agreed to contribute funds according
to 15A 2R .0503 (b) for 3.52 acres of restoration plus to debit 3.52 acres from N.C.
DOT's Huskanaw Swamp Mitigation site. Until the Wetland Restoration Program
receives and clears your check (made payable to DEHNR-WRP), wetland or stream fill
shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 (ext. 358) if you
have any questions concerning the Wetland Restoration Program. You have one month
from the date of this Certification to make this payment. For accounting purposes, this
Certification authorized the fill of 3.52 acres of non-riparian wetlands in Tar River and
subbasin and 7.04 acres of restoration are required.
Violations of any condition herein set forth shall result in revocation of this Certification and
may result in criminal and/or civil penalties. This Certification shall become null and void unless
the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act
Permit. This Certification shall expire upon expiration of the 404 or CAMA permit.
If this Certification is unacceptable to you you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must be
in the form of a written petition conforming to Chapter 150B of the North Carolina General
Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.
27611-7447. If modifications are made to an original Certification, you have the right to an
adjudicatory hearing on the modifications upon written request within sixty (60) days following
receipt of the Certification. Unless such demands are made, this Certification shall be final and
binding.

impacts through the restoration, creation, enhancement or preservation of wetlands and surface waters as outlined below prior to
conducting any activities that impact or degrade the waters of the state.
Note: Acreage requirements proposed to be mitigated through the Wetland Restoration Programs must be

The North Carolina Department of Transportation (NCDOT) proposes to upgrade a section of
US 13/NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. An
application for a Section 404 permit and a Section 401 Water Quality Certification was
submitted May 21, 1997. The permit application stated that the construction of Section A will
result in 3.32 acres of permanent and 0.20 acres of temporary impacts in jurisdictional wetlands.
Based on a discussion at the June 19, 1997 agency review meeting, the NCDOT hereby agrees
that the permanent impact from the project is 3.52 acres. This figure includes the 0.20 acres of
impact from the mechanized clearing and grubbing.
At the June meeting, the Corps of Engineers indicated that the proposed mitigation of 12.32 acres
of enhancement from the Huskanaw Mitigation Site would not be acceptable. At that time it was
stated that the Huskanaw site had not been planted according to the schedule presented in the
final mitigation plan. We explained that the planting did not occur because the site was too wet
to burn in the fall of 1996 due to unusually wet weather, which included Hurricane Fran in
September. In March 1997 approximately 28 acres of the site were planted consisting of 10 acres
of upland pine-oak, 9.8 acres of upland oak-hickory, and 8.1 acres of wetland wet-hardwood
forest. On-August 4, 1997 the Corps of Engineers met at Huskanaw with representatives of the
NCDOT.

Approximately 40 acres of enhancement still needs to be planted. Based on the discussions
during the August 4 site visit, the NCDOT hereby commits to planting the site during the late
fall/winter of 1997/98. We will spray the enhancement area in September and burn the site in
October. We will initiate planting in mid December 1997. If conditions are not favorable for
burning, then the site will be cleared using a combination of hand clearing and mechanized
clearing (e.g., bush hog). No grubbing will occur. The debris will be windrowed or removed
from the site.
Based on the above commitment, we respectfully request that the Corps of Engineers accept our
offer of 12.32 acres of enhancement from the Huskanaw Mitigation Site. It is our understanding
that there are no other issues to be addressed for the Section 404 application. We therefore
request that the Corps of Engineers issue a Section 404 permit for the subject project.

Enclosed is the application of the North Carolina Department of Transportation
(NCDOT) for Department of the Army (DA) authorization and a State Water Quality
Certification to fill >42 acres of 404 wetlands adjacent to Grindle Creek, and unnamed
tributaries. NCDOT proposes to widen 8.3 miles of U.S. 13/N.C. 11, from just south
of N.C. 903 to N.C. 30, South of Bethel, Pitt County, North Carolina, TIP No. R-0218A,
State Project No. 8.1221101. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the
Clean Water Act, and we have determined that a water quality certification is required under
the provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt
of a request for certification is a reasonable time for State action. Therefore, if you have
not acted on the request, or asked for an extension of time, by August 18, 1997, the
District Engineer will deem that waiver has occurred.

Subject: Pitt County, Widening of US 13/NC 11 from NC 903 to NC 30, Federal Aid
Project No. F-102-1(3), State Project No. 8.1221101, T.I.P. R-0218A.
The North Carolina Department of Transportation (NCDOT) proposes to upgrade a
section of US 13/NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. An
application for a Section 404 permit and a Section 401 Water Quality Certification was
submitted May 21, 1997. On June 3, 1997 the Corps of Engineers requested that the 0.20 acres
of temporary wetland be reclassified as permanent impacts. This letter addresses the question
and provides wetland mitigation for the 0.2 acres.
The permit application stated that the construction of Section A will result in 3.32 acres of
permanent and 0.20 acres of temporary impacts in jurisdictional wetlands. The temporary
impacts result from mechanized clearing and grubbing actions using NCDOT Clearing
Method II. We respectfully request that the 0.2 acres of clearing and grubbing impact be
considered temporary.
1. The wetlands will not be permanently filled. Any material that falls into the wetland
as a result of this clearing and grubbing will be from incidental fallback resulting from
the grubbing and/or from the emplacement of erosion control features. The material that
would fall back into the wetland will have originated in the wetland. According to recent
guidance from the Corps of Engineers (USACE, Tulloch Guidance, 5/22/97) this activity
may not fall under the Federal Clean Water Act.

The placement of the erosion control structures will ensure that no offsite material will be
allowed to enter the wetland and that water quality will not be affected. The erosion
control structures will be removed when the construction is complete.
2. The Corps of Engineers noted that the heavy machinery could cause the soil in the
wetlands to be compacted. We agree that such compaction is possible and further agree
to mitigate for that impact. Our proposed mitigation will consist of disking and
harrowing the soil to a depth of 12 to 18 inches in the area of temporary impact to loosen
and aerate the soil. This action should restore the soil to approximate pre-project texture.
These mitigation procedures in the temporary impact areas provide consideration for
mitigation within the right-of-way and are thus in accord with the FHWA "Step Down"
procedures. They are also in compliance with 23 CFR Part 777.9, "Mitigation of Impacts" which
describes the actions that should be followed to qualify for Federal-aid highway funding.

Subject: Pitt County, Widening of US 13/NC 11 from NC 903 to NC 30, Federal Aid
Project No. F-102-1(3), State Project No. 8.122110 1, T.I.P. R-0218A.
The North Carolina Department of Transportation (NCDOT) proposes to upgrade a
section of US 13/NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. An
application for a Section 404 permit and a Section 401 Water Quality Certification was
submitted May 21, 1997. On June 3, 1997 the Corps of Engineers requested that the 0.20 acres
of temporary wetland be reclassified as permanent impacts. This letter addresses the question
and provides wetland mitigation for the 0.2 acres.
The permit application stated that the construction of Section A will result in 3.32 acres of
permanent and 0.20 acres of temporary impacts in jurisdictional wetlands. The temporary
impacts result from mechanized clearing and grubbing actions using NCDOT Clearing
Method II. We respectfully request that the 0.2 acres of clearing and grubbing impact be
considered temporary.
1. The wetlands will not be permanently filled. Any material that falls into the wetland
as a result of this clearing and grubbing will be from incidental fallback resulting from
the grubbing and/or from the emplacement of erosion control features. The material that
would fall back into the wetland will have originated in the wetland. According to recent
guidance from the Corps of Engineers (USACE, Tulloch Guidance, 5/22/97) this activity
may not fall under the Federal Clean Water Act.

The placement of the erosion control structures will ensure that no offsite material will be
allowed to enter the wetland and that water quality will not be affected. The erosion
control structures will be removed when the construction is complete.
2. The Corps of Engineers noted that the heavy machinery could cause the soil in the
wetlands to be compacted. We agree that such compaction is possible and further agree
to mitigate for that impact. Our proposed mitigation will consist of disking and
harrowing the soil to a depth of 12 to 18 inches in the area of temporary impact to loosen
and aerate the soil. This action should restore the soil to approximate pre-project texture.
These mitigation procedures in the temporary impact areas provide consideration for
mitigation within the right-of-way and are thus in accord with the FHWA "Step Down"
procedures. They are also in compliance with 23 CFR Part 777.9. "Mitigation of Impacts" which
describes the actions that should be followed to qualify for Federal-aid highway funding.

NORTH CAROLINA DEPARTMENT OF TRANSPORTATION (NCDOT), DIVISION OF
HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina 27611-5201 has
applied for a Department of the Army (DA) permit TO FILL 3.52 ACRES OF
SECTION 404 WETLANDS ADJACENT TO GRINDLE CREEK, AND UNNAMED TRIBUTARIES.
THE NCDOT PROPOSES TO WIDEN 8.3 MILES OF U.S. 13/N.C. 11, FROM JUST SOUTH
OF N.C. 903 TO N.C. 30, SOUTH OF BETHEL, PITT COUNTY, NORTH CAROLINA, TIP
NO. R-0218A, STATE PROJECT NO. 8.1221101.
The following description of the work is taken from data provided by
the applicant and from observations made during a March 17, 1997, onsite
reconnaissance by a representative of the Corps of Engineers. Plans submitted
with the application show that the NCDOT proposes to widen an existing two-
lane section of U.S. 13 to a four-lane, median-divided roadway from just south
of N.C. 903 to N.C. 30, south of Bethel. The 8.3 miles of improvements will
include a median width of 60 feet.
The wetlands impacted by this project will occur at 11 sites and are
predominately wet pine flatwoods systems. The wetland systems are
predominately vegetated with red maple (Acer rubrum), black gum (Nyssa
sylvatica), loblolly pine (Pinus taeda) and sweet gum (Liquidambar
styraciflua). Recently cutover areas account for 1.77 of the 3.52 wetland
acres to be destroyed.
NCDOT proposes to mitigate the wetland impacts by enhancing 12.32 acres
of wetlands at the Huskanaw Swamp Mitigation Site in Martin County. The
Huskanaw Swamp Mitigation Site is located within the Tar River basin and a
plan has been approved to enhance 44 acres of existing wetlands. The wetland
enhancement efforts have been delayed and the Corps of Engineers has
prohibited the area to be used for mitigation at this time.
The purpose of the proposed work is to improve the level of service and
reduce traffic accidents on U.S. 13 between Greenville and Bethel. A site map
is included with this public notice. Copies of the application and plans of

The applicant has determined that the proposed work is consistent with
the North Carolina Coastal Zone Management Plan and has submitted this
determination to the North Carolina Division of Coastal Management (NCDCM)
for their review and concurrence. This proposal shall be reviewed for the
applicability of other actions by North Carolina agencies such as:
a. The issuance of a Water Quality Certification under Section 401 of
the Clean Water Act by the North Carolina Division of Water Quality (NCDWQ).
b. The issuance of a permit to dredge and/or fill under North Carolina
General Statute 113-229 by the North Carolina Division of Coastal Management
(NCDCM).
C. The issuance of a permit under the North Carolina Coastal Area
Management Act (CAMA) by the North Carolina Division of Coastal Management
(NCDCM) or their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration (NCDA) and the
North Carolina Council of State.

e. The approval of an Erosion and Sedimentation Control Plan by
the Land Quality Section, North Carolina Division of Land Resources
(NCDLR), pursuant to the State Sedimentation Pollution Control Act of 1973
(NC G.S. 113 A-50-66).
The requested Department of the Army (DA) permit will be denied if
any required State or local authorization and/or certification is denied.
No DA permit will be issued until a State coordinated viewpoint is received
and reviewed by this agency. Recipients of this notice are encouraged to
furnish comments on factors of concern represented by the above agencies
directly to the respective agency, with a copy furnished to the Corps of
Engineers.
This application is being considered pursuant to Section 404 of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held
to consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not a registered property or property listed as being
eligible for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware
that the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species
Act of 1973.
The decision whether to issue a permit will be based on an evaluation
of the probable impacts, including cumulative. impacts, of the proposed
activity and its intended use on the public interest. Evaluation of the
probable impacts which the proposed activity may have on the public interest
requires a careful weighing of all those factors which become relevant
in each particular case. The benefits which reasonably may be expected
to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. The decision whether to authorize a proposal, and
if so the conditions under which it will be allowed to occur, are therefore
determined by the outcome of the general balancing process. That decision
should reflect the national concern for both protection and utilization of
important resources. All factors which may be relevant to the proposal must
be considered including the cumulative effects thereof. Among those are
conservation, economics, aesthetics, general environmental concerns, wetlands,
cultural values, fish and wildlife values, flood hazards and flood plain

values (in accordance with Executive Order 11988), land use, navigation,
shore erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare
of the people. For activities involving the placement of dredged or fill
materials in waters of the United States, a permit will be denied if the
discharge that would be authorized by such permit would not comply with the
Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the
preceding sentence and any other applicable guidelines or criteria, a permit
will be granted unless the District Engineer determines that it would be
contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment (EA) and/or an Environmental
Impact Statement (EIS) pursuant to the National Environmental Policy Act
(NEPA). Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Water Quality
(NCDWQ) issues, denies, or waives State certification required by Section 401
of the Clean Water Act. The NCDWQ considers whether or not the proposed
activity will comply with Sections 301, 302, 306, and 307 of the Clean Water
Act. The application and this public notice for the Department of the Army
(DA) permit serves as application to the NCDWQ for certification.
Additional information regarding the Clean Water Act certification may
be reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management (NCDEM), Salisbury Street,
Archdale Building, Raleigh, North Carolina. Copies of such materials will be
furnished to any person requesting copies upon payment of reproduction costs.
All persons desiring to make comments regarding the application for
Clean Water Act certification should do so in writing delivered to the North
Carolina Division of Water Quality (NCDWQ), Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before July 7, 1997, Attention: Mr. John

The North Carolina Department of Transportation (NCDOT) proposes to upgrade a
section of US 13/NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. The
proposed improvements will consist of widening 8.3 miles of the existing US 13/NC 11 to a
four-lane divided highway. Shoulder widths will be 10 feet paved. The median will be 60 feet in
width.

NEPA DOCUMENT STATUS
A Federal Highway Administrative Action, Environmental Assessment and
Programmatic Section 4(f) Evaluation and Approval was submitted by the USDOT-FHWA and
the NCDOT and approved on November 10, 1994. The document addressed R-0218A, the
widening of the existing two-lane facility, and R-021 8B, a bypass of the town of Bethel
connecting to the interchange with US 64 (T.I.P. Project R-2111). The EA explains the purpose
and need for the project; provides a description of the alternatives considered; and characterizes
the social, economic, and environmental effects. After the EA was approved and circulated, a
Design Public Hearing was held on March 9, 1995. It was determined that separate FONSI
documents would be prepared for the two sections. On September 27, 1995 a FONSI was
approved for R-0218A. Copies of the EA and FONSI have been provided to regulatory review
agencies involved in the approval process. Additional copies willbe provided upon request.

RESOURCE STATUS
Wetland delineations: wetland delineations were conducted using the criteria specified in
the 1987 Corps of Engineers Wetland Delineation Manual. The delineations were verified in the
field by Mr. Henry Wicker of the DOA Washington Regulatory Field Office. The attached
permit application package consists of drawings depicting permanent and temporary wetland
impacts in Section A. The construction of Section A will result in 3.32 acres of permanent and
0.20 acres of temporary impacts in jurisdictional wetlands. The temporary impacts result from
mechanized clearing and grubbing actions using NCDOT Clearing Method II. Sheet 28 of 30
provides site specific quantity breakdowns for the impacts.
The wetlands are all disturbed, channelized and ditched. They are composed of 0.57 acres
of forested vegetation, 1.07 acres of a cut-over, 0.98 acres of wet pine flatwoods (Schafale and
Weak-ley, 1990) and 0.70 acres of disturbed emergents. The forested wetlands are wet flats
dominated by red maple (Ater nwbnun) and black gum (Nvssa sylvatica); the wet pine flatwoods
by loblolly pine (Pious taeda) and sweet gum (Liquidambar stvracif ua); the cut-over by soft
rush (Juncos effusus) and giant cane (Anindinaria giggntea) and the disturbed emergents by soft
rush and giant cane.

Endangered Species: In September 1992 the Natural Resources Technical Report issued a
Biological Conclusion of No Effect for the red-cockaded woodpecker (Picoides borealis) and the
Tar River spinymussel (Eliptio steinstansana). Due to the five years since the original NRTR,
the NCDOT initiated a reevaluation of protected species for the project. Biological conclusions
of No Effect were reached for the Tar River spinymussel, the bald eagle (Haliaeetus
leucocephalus), and the manatee (Tt-ichechus manatzus) due to no suitable habitat being present.

On February 5, 1996 the USFWS stated that based on the info7ation in the FONSI, they were
unable to state that the requirements of Section 7 of the Endangered Species Act had been
fulfilled. Accordingly, a survey was conducted to clarify the Biological Conclusion for the
RCW. Suitable habitat was surveyed by NCDOT visually searching for RCW signs (cavity trees,
start holes, etc.). There were no RCW cavities observed within the project vicinity and no record
in the Natural Heritage Program (NHP) of RCW nesting or occurrences within 1.0 miles (1.6
km) of the project. Therefore, it was concluded that the project will have no impact on protected
species.
MITIGATION OPTIONS
The Corps of Engineers had adopted, through the Council on Environmental Quality
(CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and
sequencing. The purpose of this policy is to restore and maintain the chemical, biological, and
physical integrity of the Waters of the United States. Mitigation of wetland and surface water
impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts,
rectifying impacts, reducing impacts over time and compensating for impacts (40 CFR 1508.20).
Executive Order 11990 (Protection of Wetlands) and Department of Transportation Order
5660.1A (Preservation of the Nations Wetlands), emphasize protection of the functions and
values provided by wetlands. These directives require that new construction in wetlands be
avoided as much as possible, and that all practicable measures are taken to minimize or mitigate
impacts to wetlands.
The NCDOT is committed to incorporating all reasonable and practicable design features
to avoid and minimize wetland impacts, and to provide full compensatory mitigation of all
remaining wetland impacts. Avoidance measures were taken during the planning and
SEA/FONSI phases; minimization measures were incorporated as part of the project design.
AVOIDANCE: Since the project is the widening of an existing highway the options for
avoiding impacts to wetlands are restricted. All wetland areas not affected by the project will be
protected from unnecessary encroachment. No staging of construction equipment, or storage of
construction supplies will be allowed in wetlands or near surface waters.
MINIMIZATION: Minimization includes the examination of appropriate and practicable
steps to reduce the adverse impacts. Minimization techniques were implemented as follows:
Slopes: The NCDOT is committed to reducing impacts in wetlands to the greatest extent
possible and to mitigating unavoidable losses. Whenever possible, 2:1 fill slopes will be used in
wetlands. When 2:1 slopes are used, guard rails must be installed and the shoulder width of the
highway increased by one meter to meet the AASHTO safety standards. When the road bed
elevation is low and the terrain flat, the footprint of the project can be eater using 2:1 slopes
than 4:1. This project is a case in point. Therefore, most of the side slopes are 4:1 resulting in a
footprint equal to or less than that in a 2:1 scenario. `?,

Best Management Practices: Strict enforcement cif sedimentation and erosion control Best
Management Practices (BMP) for the protection of surface waters and wetlands.
Ditching: It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much
as possible, thus preserving the hydrology of adjacent wetlands. Lateral ditches, typically sized to
handle large volumes of water, are constructed to provide drainage where the land slopes toward
the highway. Where the prevailing topography slopes away from the highway only shallow
ditches are needed, sized to handle roadway runoff. On project R-0218A the existing road is
drained by shallow roadside ditches that do not appear to affect the hydrology of the contiguous
wetlands and are sized to handle roadway runoff. Similar ditches will be constructed to provide
road drainage to the expanded facility. Neither the existing or new ditches should affect the
hydrological functions of the contiguous wetlands.
Median Width: The project was designed using 60 foot median widths. The FONSI
documented the resource agency request that the wetland impacts be evaluated using a 46 foot
median width. In response to that request, a site visit was conducted by the NCDOT on March
17, 1997 attended by the Corps of Engineers (COE) the, North Carolina Wildlife Resources
Commission (NCWRC) and the N. C. Division of Water Quality (NCDWQ). The result of the
evaluation was that the agencies (COE, NCWRC, NCDWQ) agreed that the reduction of wetland
impacts would not be significant enough to require changing the project design. Therefore, 60
foot median widths will be used.
COMPENSATION: The primary emphasis of the mitigation is to reestablish a condition
similar to that which existed if the project were not built. As previously stated, mitigation is
limited to reasonable expenditures and practicable considerations related to highway operation.
Mitigation is generally accomplished through a combination of methods designed to replace
wetland functions and values lost as a result of construction of the project. These methods
consist of creation of new wetlands from uplands, borrow pits, and other non-wetland areas;
restoration of wetlands; and enhancement of existing wetlands.
All Compensatory Mitigation must be in compliance with 23 CFR Part 777.9,
"Mitigation of Impacts" that describes the actions that should be followed to qualify for tederal-
aid highway funding. This process is known as the FHWA "Step Down" procedures:
1. Consideration must be given to mitigation within the right-of-way and should include the
enhancement of existing wetlands and the creation of new wetlands in the highway median,
borrow pit areas, interchange areas and along the roadside.
2. Where mitigation within the right-of-way does not fully offset wetland losses, compensatory
mitigation may be conducted outside the right-of-way including enhancement, creation, and
preservation.

The NCDOT has purchased a tract known as Huskanaw Swamp for use as a wetland
mitigation site. A Final Mitigation Plan for Huskanaw Swamp has been completed and
distributed to the resource agencies.
Both the project and the mitigation sites are located within the Tar River Basin. The
Huskanaw Swamp is located approximately 0.5 miles west of Everetts along SR 1405 in Martin
County. The site consists of approximately 112 acres of forest and agricultural land situated
between Huskanaw Swamp and US 64. Most of the site had been clear-cut along alluvial stream
terraces. Seventy percent (78 acres) contain hydric soils (Rains and Bibb series). We propose to
use the Huskanaw Swamp Mitigation Site to mitigate for the wetland impacts associated with
this project.
The wetlands impacted by this project are marginal and not connected to any type of
riverine systems. They are all disturbed or surrounded by disturbed lands. Taking this into
account as well as the low DEM scores, the NCDOT proposes compensation for the unavoidable
wetland impacts associated with this project at a 3.5:1 ratio for enhancement. Accordingly,
11.62 acres of enhancement will be provided at the Huskanaw Swamp site. We have prepared a
Status Report updating the use of the Huskanaw site for compensatory mitigation. A copy is
enclosed with this application.
REGULATORY, APPROVALS
Application is hereby made for a Department of the Army Individual 404 Permit as
required for the above described activities. In addition, we are hereby requesting a 401 Water
Quality Certification from the Division of Water Quality. We are providing seven copies of this
application to the North Carolina Department of Environment, Health and Natural Resources,

The North Carolina Department of Transportation (NCDOT) proposes to upgrade a section of US 13/
NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. An application for a Section 404
permit and a Section 401 Water Quality Certification was submitted May 21, 1997. On July 3, 1997 the Corps of
Engineers requested a copy of the design for the new bridge over Grindle Creek. The existing bridge will be
replaced with a new structure that completely spans Grindle Creek. The attached Bridge Survey and Design
Report provides information describing both the existing structure and the proposed replacement structures. The
existing structure has bents in the creek. The new structures will completely span the creek with all supports
outside the creek bed. No wetlands or jurisdictional surface waters will be filled by the proposed bridges.

Subject: Pitt County, Widening of US 13/NC 11 from NC 903 to NC 30, Federal Aid Project
No. F-102-1(3), State Project No. 8.122110 1, T.I.P. R-0218A.
The North Carolina Department of Transportation (NCDOT) proposes to upgrade a section of US 13/
NC 11 in Pitt County from just south of NC 903 to NC 30 south of Bethel. An application for a Section 404
permit and a Section 401 Water Quality Certification was submitted May 21, 1997. On July 3, 1997 the Corps of
Engineers requested a copy of the design for the new bridge over Grindle Creek. The existing bridge will be
replaced with a new structure that completely spans Grindle Creek. The attached Bridge Survey and Design
Report provides information describing both the existing structure and the proposed replacement structures. The
existing structure has bents in the creek. The new structures will completely span the creek with all supports
outside the creek bed. No wetlands or jurisdictional surface waters will be filled by the proposed bridges.
