APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Butch:
You have our approval, in accordance with the attached conditions, to fill and excavate in waters for the purpose
of paving SR 1268 at Almond, NC, as you described in your application dated 13 August 1997. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This
Certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below. Sediment and erosion control measures shall adhere to the design standards for sensitive
watersheds (T 15A:04B .0024). DOT will use their stream Relocation/Channelization Guidelines. DOT must receive
written approval from the N.C. Wildlife Resources Commission (WRC) prior to impacting waters/wetlands. DOT
shall provide a copy of WRC's letter to DWQ within 15 days of receipt.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

The North Carolina Department of Transportation (NCDOT) is proposing to
grade, drain, base, and pave SR 1268, Shell Stand Road, primarily along the existing
roadway. In order to construct this project in accordance with our current secondary
road standards and due to the proximity of a trout stream (Shell Stand Creek and
tributaries, DEM Class C - Trout Water) and extension of pipe culverts, we are
requesting authorization under Section 404 of the Clean Water Act.
I am sending a straight-line diagram with the proposed erosion control,
stream, stream bank, and construction limits and various sites along the project where
we will be in conflict with the streams. In addition, I am sending a typical section of
the road, cross sections, drawings for pipe culvert replacements, general notes and
standards on some erosion control measures, and a marked map. We propose to

install all the new culverts slightly below the existing streambed elevations where
bedrock is not encountered to minimize impacts to wildlife habitats and allow the
existing stream gradients to remain as unchanged as is physically possible.
The best management practices will be used to minimize and control
sedimentation and erosion on this project. The construction foreman will review all
erosion control measures daily to ensure sedimentation and erosion are being
effectively controlled. If the planned devices are not functioning as intended, they
will immediately be replaced with better devices. The rocksilt screens and other
erosion control devices will be in place prior to pipe culvert construction and will
remain in place until the project is stabilized.
By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlife
Resources Commission (NCWRC) Western Mountain Region Coordinator, to
comment directly to you concerning the 404 Nationwide Permit Request.
A request will be made on this project for a temporary encroachment in the
Trout Water Buffer Zone of Shell Stand Creek and I am asking Mr. Davis and Mr. Ed
Ingle, Area Roadside Environmental Engineer (NCDOT) to comment directly to me
concerning the Trout Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting authorization to proceed under
Section 401 of the Clean Water Act from the Division of Environmental
Management.
